										<content:encoded><![CDATA[<h3><strong>Family Pension: After the death of any government employee, according to the Central Civil Services (Pension) Rules, 2021, a fixed amount is given to his family every month. This amount is called family pension.</strong></h3>
<p>For this family pension, the employee gives the names of his family members, so that his family continues to get financial assistance after his death.</p>
<p>Central Civil Services Rule 54 Central Civil Services Rule 54 is a social welfare scheme. Under this scheme, financial relief is given to the spouse or children of pensioner employees who have died.</p>
<p>Who is entitled to get pension under Rule 54? Under Rule 54, the following people are entitled to receive pension after the death of a pensioner: 1. Spouse of the pensioner 2. Children of the pensioner 3. Parent or guardian of the pensioner 4. Disabled siblings of the pensioner</p>
<h3><strong>Can a daughter get family pension?</strong></h3>
<p>Now the question is, can a pensioner&#8217;s daughter get family pension? So the answer is yes. According to the Central Civil Services (Pension) Rules, 2021, unmarried, married, and widowed daughters are eligible for family pension. Under this rule, the name of the daughter cannot be removed from the list of family members eligible for family pension of a government employee. To get family pension, the daughter must be more than 25 years of age. All other children in the family should also be more than 25 years of age and they should have some source of income.</p>
<h3><strong>How long is the daughter eligible?</strong></h3>
<p>A daughter remains eligible to receive family pension until she gets married, gets a job, or has a mental or physical disability. If someone&#8217;s father or mother was in government service and their daughter is unmarried, divorced, or widowed, then in the absence of such employees, the daughter is entitled to receive family pension.</p>
<p>Under what circumstances will lifelong pension be available? If a government employee has included his daughter&#8217;s name in Form 4, then she is officially considered a member of the family. If the daughter is mentally or physically handicapped, then she can get family pension for life. A widowed or divorced daughter can also get family pension for life. If any child in the house is handicapped, then he gets the first right to get pension.</p>
<h3><strong>What are the rules for unmarried daughters?</strong></h3>
<p>The Government of India has made some rules for eligible unmarried daughters to get family pension. The rules explain how and in which state an unmarried, widowed or divorced daughter is eligible for family pension. Let us know whether an unmarried daughter can get family pension or not. All single and widowed daughters are eligible to get family pension. If the daughter&#8217;s divorce decree is passed, then the daughter of the pensioner father is entitled to family pension.</p>
<p>Eligibility for Unmarried Daughter Under Sub-rule 6 (iii) of Rule 54, an unmarried daughter is fully entitled to family pension until she gets married or starts earning on her own.</p>
<p><strong>Eldest in the family:</strong> If an unmarried daughter is the eldest among all the siblings, she is entitled to receive family pension in case the parents are not alive.</p>
<p><strong>Twins:</strong> If the unmarried daughter has a twin sister, then the amount will be divided equally between the sisters.</p>
<p><strong>Two pensions:</strong> If both the mother and father were affiliated with the pension scheme, then the daughter is also entitled to receive two pensions. But the amount of both the family pensions should not exceed Rs 1,25,000 per month.</p>
<p><strong>Income:</strong> If an unmarried daughter is the beneficiary of the scheme, then the first pension will not be considered as her income.</p>
<p><strong>Adopted child:</strong> If the unmarried daughter is an adopted daughter of the husband or wife then family pension can be denied.</p>
<p><strong>Disabled daughter:</strong> In case the daughter is physically or mentally disabled, pension can be given for life or till the age of 25 years.</p>
<p><strong>Divorced parents:</strong> If the deceased parents of the unmarried daughter had filed a petition for divorce or were divorced, then in that case also the unmarried daughter is entitled to family pension.</p>

										<content:encoded><![CDATA[<p><strong>The Department of Pension and Pensioners&#8217; Welfare has issued an office memorandum in this regard on October 18. The Department of Pension and Pensioners&#8217; Welfare is the nodal department for formulating policies related to pension and other retirement benefits of central government employees covered under the Central Civil Services (Pension) Rules, 1972.</strong></p>
<p>There is good news for the employees who retired under the old pension scheme. The Pension and Pensioners Welfare Department of the Government of India has prepared a plan to increase the pension of retired employees by 20 to 100 percent. To get additional pension or additional compassionate allowance, retired employees will have to fulfill the age condition.</p>
<p>If they are between 80 years to 85 years of age, then their basic pension will be increased by 20 percent. That means they will get 20 percent additional pension or additional compassionate allowance. After crossing a certain age, the pension of retired employees can increase by 100 percent as additional pension or additional compassionate allowance.</p>
<p>An office memorandum in this regard has been issued by the Department of Pension and Pensioners&#8217; Welfare on October 18. The Department of Pension and Pensioners&#8217; Welfare is the nodal department for formulation of policies relating to pension and other retirement benefits of Central Government employees covered under the Central Civil Services (Pension) Rules, 1972. Conditions have been laid down for grant of additional pension to retired civil servants of the Central Government covered under the Central Civil Services (Pension) Rules, 2021.</p>
<p>As per the provisions of sub-rule 6 of rule 44 of the CCS (Pension) Rules, 2021 read with erstwhile rule 49(2-A) of the CCS (Pension) Rules, 1972, retired Government servants after attaining the age of eighty years or above shall be granted additional pension or additional compassionate allowance in addition to the pension or compassionate allowance admissible under the rules.</p>
<p>Additional pension or additional compassionate allowance will be paid from the first day of the calendar month in which it becomes payable. For example, a pensioner born on August 20, 1942 will be eligible for additional pension at the rate of twenty per cent of the basic pension from August 1, 2022. A pensioner born on August 1, 1942 will also be eligible for additional pension at the rate of twenty per cent of the basic pension from August 1, 2022.</p>
<p>The Central Government has requested all Ministries/Departments and Pension Disbursing Authorities/Banks to inform all concerned parties for compliance with the above provisions of the Central Civil Services (Pension) Rules, 2021.</p>
<p>If the age of the retiring employee is between 80 to 85, he will get 20 percent additional pension. If the age of the employee is between 85 to 90 years, then he will be entitled to 30 percent additional pension. If the age of the employee is between 90 to 95 years, then the basic pension will increase by 40 percent. Similarly, if the age of the employee is between 95 to 100 years, then his basic pension will increase by an additional 50 percent. If a retiring employee has crossed 100 years, then his basic pension will increase by an additional 100 percent.</p>
<p>Dr. Manjit Singh Patel, National President of &#8216;National Mission for Old Pension Scheme India&#8217; says, this formula has been decided by the Government of India on the basis of Central Civil Services Rules 2021. He has urged the Government of India to also give the benefit of this rule to those who choose option 1 in the case of death and disability covered under the National Pension System Amendment Act 2021 (CCS Rules 1972) of the Government of India.</p>
<p>The reason is, in case of death and disability, the Government of India has given freedom to the employees to choose any one option between NPS Exit Rules 2015 and CCS Rules 1972. In such a situation, this rule should also apply to those who have opted for the option of CCS Rules 1972.</p>

										<content:encoded><![CDATA[<p><strong>Along with giving the gift of bonus and DA hike to the central employees on Diwali, the government has also issued a strict instruction. It states that if any employee is found to be indulging in negligence or serious crime while on the job, then strict action will be taken against him. His pension and gratuity can also be stopped.</strong></p>
<p>New Delhi. Amidst the gifts of DA and bonus to central employees, the government has also issued a stern warning. In this, it has been said to be vigilant about work and not to be careless and in doing so, instructions have been given to stop pension and gratuity after retirement. At present, this order will be applicable to the central employees, on which the states can also implement.</p>
<p>The Central Government has said in a notification issued recently that if the Central employees are found guilty of any serious offense or negligence during their service, then their gratuity and pension will be stopped after retirement. These instructions have been issued under the Central Civil Services (Pension) Rule 2021. The Central Government had recently changed Rule 8 of the CCS (Pension) Rules 2021, in which these new provisions have been added.</p>
<p>Information about the changes in the rules from the Center has also been sent to all the concerned authorities. In this it has been said that if the information of the guilty employees is received, then action should be initiated to stop their pension and gratuity.</p>
<p><strong>Who will take action</strong></p>
<p>President who has been involved in the appointing authority of the retired employee. They will have the right to stop gratuity or pension.</p>
<p>Secretaries who are attached to the Ministry or Department under which the retiring employee has been appointed. They will also have the right to stop pension and gratuity.<br />
If an employee has retired from the Audit and Accounts Department, then the CAG will have the right to stop the pension and gratuity of the guilty employees after their retirement.</p>
<p><strong>Such action can be taken</strong></p>
<p>According to the change in the rules on October 7, the competent authorities will have the right to stop the pension or gratuity or both partly or wholly of the found guilty employees. If any departmental or judicial action is taken against these employees during the job, then it will also be necessary to inform the concerned officers. If an employee is re-employed after retirement, then the same rules will apply to him.</p>
<p>If an employee has taken the payment of pension and gratuity after retirement and is found guilty, then full or partial amount of pension or gratuity can be recovered from him. It will be assessed on the basis of loss caused to the department. If the authority wants, the pension or gratuity of the employee can be stopped permanently or even for some time.</p>
<p>Suggestions will have to be taken before the final order Any authority will have to take suggestions from the Union Public Service Commission before giving the final order. Further, in any case where pension is withheld or withdrawn, the minimum amount should not be less than Rs 9000 per month, which is already prescribed under Rule 44.</p>

										<content:encoded><![CDATA[<p><strong>In fact, by the Department of Pension and Pensioners&#8217; Welfare (DoPT) for pension and gratuity by a government employee under suspension under the 7th pay commission of employees under the Central Civil Services (Pension) Rules, 2021 CCS(Pension) Rule 2021.</strong></p>
<p>Important updates are provided on the condition of time passed as qualifying service or otherwise. In the order issued by DoPT, new rules have been set regarding the pension of suspended employees, which is very important for the employees to know. Employees will be provided pension and gratuity benefits under this rule.</p>
<p>It has been said in the issued order that the Department of Pension and Pensioners&#8217; Welfare has notified the Central Civil Services (Pension) Rules, 2021 in supersession of the Central Civil Services (Pension) Rules, 1972.</p>
<p>As per rule 23 of the Central Civil Services (Pension) Rules, 2021, in the case of a Government servant who has been previously suspended for an inquiry into his conduct and who on the conclusion of such inquiry would have been wholly acquitted or only a minor fine is imposed and the suspension is deemed to be wholly unreasonable.</p>
<p>Wherein the time spent by him under suspension is required to be counted as qualifying service. In other cases, the period of suspension should not count as qualifying service, unless the authority competent to pass an order under the rule governing such matters expressly declares at that time that it as may be declared by the competent authority.</p>
<p>In all cases of suspension, the competent authority is required to pass an order specifying that, in this regard, the Government servant, if any, shall count the period of suspension as qualifying service and shall be in the service book. A certain entry will be required.</p>
<p>All Ministries/Departments are requested to take strict implementation of the above provisions in respect of calculation of time elapsed as qualifying service for pension and gratuity under the Central Civil Services (Pension) Rules, 2021 or otherwise. To be brought to the notice of the concerned personnel along with pensionary benefits in the Department and attached/subordinate offices under it.</p>
