In this petition, the 2016 order of the Allahabad High Court was challenged, which asked to make the flyway toll free. The court reprimanded the Noida Authority along with the Uttar Pradesh and Delhi governments, who illegally handed over the project to the Noida Toll Bridge Company Limited (NTBCL). The Supreme Court said, “The contract given to NTBCL was unfair, unjust and contrary to constitutional norms.”

A bench of Justices Suryakant and Ujjal Bhuiyan said there was no reason to continue collecting tolls. Justice Suryakant wrote a 53-page judgment, rejecting all arguments of NTBCL, including claims of additional recovery of ₹30 crore presented by senior advocate A M Singhvi. He said that NTBCL collected much more money than the project cost, which led to “unfair benefit to NTBCL in exchange for the suffering of the public”. The court said that the contracts with NTBCL were full of such unfair and impractical conditions, which “not only shock this court, but are against public policy.”

Recovery completed by 2016, no reason to continue toll

The court said that NTBCL had recovered the project cost, maintenance expenses and sufficient profit on its initial investment by March 31, 2016. There was no justification for collecting user charges/toll after that. Justice Suryakant said, “IL&FS and NTBCL collected hundreds of crores of rupees from the public in the name of essential public infrastructure. This was not possible unless there was collusion between both the state governments and Noida officials, who ignored the contractual obligations.”

Pointing to corruption, the court made strong comments on the formula for project cost escalation and the process of increasing leases to collect user charges. “It is unimaginable that several levels of governments, including the most accomplished financial experts, could not see that this formula would put an undue burden on the public.”

CAG report revelations

The court said, “The CAG report has revealed shocking facts that the directors of NTBCL, including Pradeep Puri (who was a senior bureaucrat), did not shoulder any responsibility. Yet, all their expenses, including high salaries, were added to the total cost of the project.”

On March 6, Delhi CM Arvind Kejriwal opened the Ashram flyover extension to the general public. Its opening eased the traffic load on the three busiest routes of Maharani Bagh, Ring Road-DND Junction and the road leading from Ring Road to Sarai Kale Khan. With the opening of the Ashram flyover, the motorists have also got relief from three traffic lights from Ashram Chowk to DND flyway.

But after crossing the toll plaza, the road leading from DND towards Noida has become more narrow. At present, the DND going towards Noida Sector 16 has shrunk from 8 lanes to 3 lanes. Two loops at this intersection, one connecting Noida’s Sector 14A and Delhi’s Mayur Vihar and another Noida-Greater Noida Expressway, left the road with only two lanes. Which is not enough for the traffic coming from Delhi.

1 lakh vehicles come everyday

Significantly, everyday 1 lakh vehicles from Delhi come to Noida via DND. Apart from this, about 55 thousand vehicles use this route during the weekend. Noida resident Gaurav Kumar says that after the opening of the Ashram flyover, it seems that traffic jams have started happening in Noida. He said that earlier we had to face heavy traffic at Ashram Chowk. Now there is traffic jam on DND Flyvo loop. The authority should take some steps to get rid of this problem.

Due to this increased traffic

DCP Traffic, Gautam Budh Nagar, Anil Kumar Yadav said that more traffic police have been deployed at the DND loop. He said that we are trying every possible solution to get rid of the traffic jam. When the flyover was closed, many people used Chilla Road and Kalindi Kunj Road and avoided coming to DND. But now the passengers passing through there are also using DND. This has increased the traffic pressure in Noida. We are trying to widen the loop here so that the traffic pressure can be relieved.

On Monday, Noida Traffic Inspector Ashutosh Singh said that he had visited the DND loop and got an idea of ​​the traffic coming towards Noida. He said that in the evening the traffic of DND mixes with the traffic of Film City, due to which the situation of jam is created. He said that we will ask the commuters to go directly towards Noida Sector 16 from DND. After this, he will be asked to take a U-turn for Film City so that the traffic jam situation on the loop can be dealt with.
