ECI increased honorarium: The Election Commission has given a gift to the employees who perform duty during the elections. The commission has increased the honorarium given to all these employees during the elections.

The Election Commission has suspended four officials on charges of adding fake names to the voter list, data security violations and sharing login credentials with unauthorised persons. The action involved two electoral registration officers, two assistant electoral officers and a data entry operator. The number of people to be removed is said to be 4 in some places and 5 in others.

The Election Commission of India has directed the state Chief Secretary to register an FIR against all of them and initiate departmental action. As soon as the Election Commission gave this order, Chief Minister Mamata Banerjee became furious in Bengal. She clearly said that she is not going to remove any officer. She raised questions on the Election Commission for this.

Mamata Banerjee asked, “Elections are held after a long time, which law allows such an action?” Describing it as a move in favour of the BJP, she called the Election Commission a bonded labourer of the BJP.

Linking this action with steps like Special Intensive Revision (SIR), he called it a hidden conspiracy to implement the National Register of Citizens (NRC). He said he would protect state officials and not allow FIRs to be registered.

Question – Can the Election Commission remove state government employees in this manner?

Yes…The Election Commission has the power to ensure the freedom of the electoral process under the Constitution (Article 324) and the Representation of the People Act, 1950. If election officials act in a corrupt manner. Do not prepare the electoral roll properly or violate the data protection policy, the Election Commission of India can take suspension, FIR and other disciplinary action.

Question – Can the Election Commission do this even before the elections, i.e. before the election code of conduct comes into effect?

– The Election Commission of India has previously removed or transferred senior officials in other states in view of the risk of unrest to ensure the fairness of elections, such as the transfer of DGP Rajiv Kumar in Bengal ahead of the Lok Sabha elections in 2024.

Question – Then why is Mamata Banerjee challenging this action of the Election Commission?

– Mamata Banerjee is challenging this action of the Election Commission because she feels that the “timing” and “intent” of the Election Commission’s action is questionable.

Mamata says that neither the elections have been announced nor the model code of conduct is in force, then under which law does the Election Commission have the authority to suspend state officials or register FIRs? That is why she asked, “There is still a lot of time for the elections. Under which law did the Commission take this action?”

Question – Why is Mamata Banerjee calling this an interference in the jurisdiction of the state?

– Mamata Banerjee argues that the state government, and not the Election Commission, has the right to take disciplinary action against officers under the state government, as long as elections are not being held. She says, “The Election Commission is not the boss of the state government. We will not allow FIRs to be registered against these officers.”

Question – Against which other states has the Election Commission taken such a step?

– The Election Commission has taken such drastic administrative action in states many times. In West Bengal, in the year 2021, before the assembly elections, the state ADG and Home Secretary were removed in February-March. Then after the announcement of the elections, DGP Virendra was also removed. In the year 2019, before the Lok Sabha elections in Andhra Pradesh, Chief Secretary Anil Chandra Punetha was removed. Several police officers were transferred. Chief Minister Chandrababu Naidu protested and alleged that this happened under pressure from the Central government.

In Tamil Nadu, ahead of the 2016 assembly elections, the Election Commission had transferred the District Magistrate and the Police Commissioner of Chennai. The opposition had raised questions about impartiality and complained about the biased attitude of these officials. In Uttar Pradesh, in 2012, the Election Commission had transferred several District Magistrates and Superintendents of Police even before the announcement of the elections.

Question – Which law gives the Election Commission of India power over all aspects of elections across the country?

– The Election Commission has already talked about the Representation of the People Act, 1950 and 1951, it has been mentioned above. In it, it has also talked about Section 324, which gives it the power to control all aspects related to elections across the country, even before the elections, if it affects the sanctity of the electoral process.

Question – What will happen if Mamata does not listen to the Election Commission and does not remove the officials?

– The Election Commission can complain to the President that the state government is obstructing the election process. In such a case, the President can submit a report to the Central Government through the Governor. According to Article 356 of the Constitution, if a state is not functioning as per the Constitution, President’s rule can be imposed. However, this would be an extreme situation and usually the ECI tries other options first.

The Election Commission can say this by holding a press conference and issuing a notification. If the state government is not following the instructions of the commission, which is a violation of the constitution. If the conflict escalates, the matter can go to the Supreme Court. The Election Commission can say that the state government is violating its powers under Article 324.

Question – Can the Election Commission directly remove these officials from their duties?

– Absolutely. The Election Commission has the right to say that this officer will no longer be given any election-related work. If the state does not cooperate, the Election Commission can seek administrative assistance from the Government of India (Centre). It can publicly declare the state government as “violator”.

Question: What decision did the Supreme Court give in such a case in 1993?

– In 1993, T.N. Seshan was the Chief Election Commissioner of the Election Commission. Then the Supreme Court accepted that the Election Commission has full authority to conduct and control the election process, including the appointment and removal of officials.

To ensure fair and transparent elections in the country, the Election Commission has now decided to strictly curb irregularities in the voter list. To prevent fake voters and duplicate entries, the Commission is reconsidering the plan to link Voter ID (EPIC) with Aadhaar.

This step will make it possible to identify those who are registered more than once at different places. The Commission has seriously considered this issue and has called an important meeting today, which will be attended by the Union Home Secretary, Secretary of the Legislative Department and CEO of UIDAI.

If this proposal is implemented, the election process will be more transparent in future, which will reduce the possibility of any kind of rigging and fraud in the voter list.

Future decision will be related to important meeting

An important meeting of the Election Commission is going to be held on March 18 regarding this issue, in which the Union Home Secretary, Secretary of the Legislative Department and the CEO of UIDAI will participate. In this meeting, all the legal and technical aspects related to voter ID and Aadhaar linking will be discussed. This meeting has become even more important especially amid the growing concerns about duplicate entries of voter ID in West Bengal.

Fake voters will be banned

According to Chief Election Commissioner Gyanesh Kumar, this initiative will make it easier to identify fake voters and remove them from the list. Many political parties, such as Trinamool Congress, Shiv Sena (UBT), NCP (SCP) and BJD, had raised the issue of voters having the same EPIC number. The commission admitted that in some states the same voter ID number was issued twice due to technical reasons, but this cannot be termed as fraud. Now strict steps are being taken to find a permanent solution to this issue.

Will it be mandatory to link Voter ID with Aadhaar?

In 2023, on a PIL in the Supreme Court, the Election Commission had said that providing Aadhaar number is not mandatory, it is optional. However, now the Commission is considering legal and technical solutions, which can make this process mandatory, just like linking Aadhaar and PAN card was made mandatory.

An important part of the Election Commission’s reform plans

The Election Commission has long been supporting Aadhaar seeding (Voter ID-Aadhaar Linking). In 2017, the Commission also filed an application in the Supreme Court seeking permission to link Aadhaar with Voter ID. The Commission believes that this will make the voter list more accurate and transparent. Apart from this, this initiative will also be helpful in other important efforts of electoral reforms such as advance voting system, remote voting for domestic migrants and strengthening the electoral process.

Duplicate voters will be removed in three months

The Commission has also announced that it will complete the process of removing duplicate voter entries in the next three months. For this, District Election Officers in more than 800 districts have been instructed to organize more than 5000 meetings with local political parties. The feedback received from these meetings will be submitted to the Commission by March 31.

Now it remains to be seen what decision is taken in this meeting on March 18 and whether linking Voter ID and Aadhaar will soon become mandatory in India.

Kejriwal claims CBI will raid Sisodia’s house

Aam Aadmi Party (AAP) chief Arvind Kejriwal, citing “reliable sources”, claimed that the Central Bureau of Investigation (CBI) will raid the house of party leader Manish Sisodia in the next few days. The Bharatiya Janata Party (BJP) hit back at former Chief Minister Kejriwal’s claim, saying that this is his (Kejriwal’s) “trick” to gain public sympathy ahead of the assembly elections next month as he is afraid of losing the elections. The CBI has not immediately reacted to the claim of former Delhi Chief Minister Kejriwal. Kejriwal has made this allegation at a time when elections for the 70-member Delhi Assembly are to be held next month.

The BJP claimed that the CAG report has raised 139 questions related to former Delhi chief minister Arvind Kejriwal’s former residence at Flagstaff Road and exposed his “black deeds”.

Mumbai: Amidst the Maharashtra elections, a big news has come for the women eligible under the Chief Minister Ladli Behan Yojana. So far, more than 2.4 crore eligible women have received five months’ installment under this scheme.

However, during the election period, women will not be able to get further installments. Because the Ladli Behan scheme has been temporarily suspended. Let’s know what are the reasons for this?

Election Commission gave order

Actually the Central Election Commission has announced the schedule of assembly elections in Maharashtra. According to this, voting will be held in a single phase in the state on November 20. Therefore, the code of conduct has been implemented in the state. The Election Commission has directed the state government to stop financial schemes that directly affect the voters during the code of conduct period.

When will the money for Ladli Behan Yojana come?

After the order of the Election Commission, the Women and Child Welfare Department has stopped the funds required for this scheme. Due to this, eligible women will not be able to get the money of Ladli Behan Yojana till the elections. Meanwhile, the state government had made the payment of October and November months together under this scheme. Therefore, now we have to wait for the December installment.

What is the real reason for stopping the scheme?

Schemes that directly influence the voters by giving them financial benefits should be stopped immediately. Instructions for this have been issued by the Chief Electoral Officer’s office to all the administrative departments. Along with this, the schemes giving financial benefits were also reviewed. Chief Electoral Officer S Chokkalingam asked all the departments about this.

During this, it has come to light that the Women and Child Welfare Department is providing a large amount of financial benefits for the Ladli Behan Yojana. Therefore, information about this scheme has been sought from the department. The Commission was told that the department has stopped the distribution of the amount of this scheme four days ago. As a result, the scheme has been temporarily suspended due to the election code of conduct.

Diwali of Ladli Bahan was dull

Actually, before the announcement of elections, Shinde government had announced bonus for the beneficiaries of Ladli Bahan Yojana. Under this, three thousand to 55 hundred rupees were to be given to the beneficiaries. Now after the ban by the Election Commission, the hope of Ladli Bahan getting money on Diwali is over.

What is the eligibility for Ladli Bahan Yojana?

Women of Maharashtra had applied online for this scheme. It is necessary to be a permanent resident of Maharashtra state to apply. The age of the female applicant should be between 21 to 65 years. All married, unmarried, abandoned, divorced and destitute women are eligible. The applicant should have a bank account in his name in any bank. The family income of the applicants should not exceed Rs 2.5 lakh.

Diwali Bonus: Minutes before the Election Commission of India (ECI) announced the dates for assembly elections in Maharashtra on Tuesday (October 15), state Chief Minister Eknath Shinde announced Diwali bonus for government employees, kindergarten teachers and Asha workers.

Shinde said all employees of the municipal body, Brihanmumbai Municipal Corporation (BMC), will get a bonus of Rs 28,000 ($333). Meanwhile, kindergarten teachers and Asha workers in the state will get Rs 3,000 more than last year. It is worth noting that on November 8 last year, Shinde had announced a bonus of Rs 26,000 for the employees.

A press statement issued by the BMC said, ‘After discussion between the Chief Minister and the Municipal Commissioner, the following gratuity grants have been announced to the Municipal Corporation officers/employees for Diwali-2024.’

This announcement was made very cleverly, because the Model Code of Conduct (MCC) comes into force as soon as the election dates are announced and remains in force till the results are declared.

It is noteworthy that the Model Code of Conduct is a set of guidelines issued by the ECI, which states how political parties and candidates should behave during election campaign and voting.

Maharashtra election dates

Chief Election Commissioner Rajiv Kumar announced during a media briefing on Tuesday that the western Indian state will vote in a single phase on November 20, with results to be declared on November 23. The last date for securing nominations is October 29, while candidates can withdraw their names till November 4.

Why is there a difference between the votes cast in EVMs and the total votes counted at some places? The Election Commission itself has answered this. EC says that the reason for this could be some votes not being counted according to the rules.

Actually, questions are being raised about this by internet users on social media. One such person posted on X and asked that there is a difference of thousands at some places between the number of votes cast on EVMs and the number of votes counted. How can this happen?

The Chief Election Officer of Uttar Pradesh has responded to this. He said that such a difference can occur due to special protocols. Votes from some polling stations are not counted due to the following reasons…

Sometimes the presiding officer forgets to delete the mock poll data from the control unit before the real voting begins. Or, sometimes the mock poll slips are not deleted from the VVPAT.

2. There may be a difference between the total votes cast in the control unit and the record of Form 17-C prepared by the presiding officer. In such a situation also, the total votes cast in the EVM and the votes counted may be different.

According to the Election Commission, the votes of such polling stations are counted in the end only if their total is equal to or more than the difference between the first and second candidates. If the total difference is less than the margin, then these votes are not counted. This way there is a difference between the votes cast in the EVM and the votes counted.

On the other hand, the Election Commission dedicated the violence-free Lok Sabha elections to Mahatma Gandhi. The ECI said that the Commission has completely foiled the attempt to derail the election process with rumors and baseless suspicions that could create unrest in the country.

Chief Election Commissioner Rajiv Kumar said that the Election Commission, dedicated to the nation for 76 years, will continue to serve with unwavering dedication. The Commission said, ‘We have foiled the attempt to derail the election process with rumors and baseless suspicions that could create unrest. The will and wisdom of the common man, who has unwavering faith in the democratic institutions of India, has won.’

In fact, in January last, the Election Commission had said that if elections for Lok Sabha and state assemblies are held simultaneously, then the commission will need Rs 10,000 crore every 15 years to buy new EVMs.

The commission had said that the shelf life of EVMs is only 15 years. If simultaneous elections are held, one set of machines can be used for conducting elections three times, but separate machines will be installed for Lok Sabha and Vidhan Sabha. Control Unit (CU), Ballot Unit (BU) and Voter Verifiable Paper Audit Trail (VVPAT) machines will have to be kept in reserve to replace the defective machines on the day of polling.

The Election Commission has sent a notice to Rahul Gandhi for making derogatory remarks on Prime Minister Narendra Modi in an election rally.

The Election Commission has sought a reply from the Congress leader by 6 pm on November 25. Let us tell you that BJP had complained to the Election Commission for making derogatory remarks on PM Modi and demanded action.

In its complaint to the Election Commission, the BJP had said that we request the Election Commission to immediately intervene by taking appropriate legal action against Mallikarjun Kharge and Rahul Gandhi for their continuous fraudulent, baseless and insulting conduct and take preventive action against both of them. Order should be passed. Otherwise, it will vitiate the electoral environment and make it difficult to stop the use of profanity, objectionable language and fake news to defame respected persons.

BJP leaders criticized, said- Rahul Gandhi should apologize immediately.

BJP leaders have said that Congress leader Rahul Gandhi’s derogatory statement on Prime Minister Narendra Modi is highly condemnable and he will have to apologize for it. The delegation that reached the Election Commission included BJP General Secretary Radha Mohan Das Aggarwal, Om Pathak and other leaders.

BJP leader Ravi Shankar Prasad said that Rahul Gandhi has shown his true form by making shameful remarks against Prime Minister Modi. Madhya Pradesh Chief Minister Shivraj Singh Chauhan has also criticized Rahul Gandhi’s statement. He said that the people of the country will never forgive Rahul Gandhi, this statement comes within the limits of treason. There cannot be a greater example of stupidity than this.

Taking cognizance of the false, unverified and derogatory remarks against Prime Minister Narendra Modi, the Election Commission has sent a show cause notice to AAP convenor Arvind Kejriwal and Congress leader Priyanka Gandhi. The Election Commission on Tuesday issued a show cause notice to AAP for its alleged ‘derogatory’ remarks against PM Modi on the social media handle of Aam Aadmi Party (AAP).

AAP party has been asked to respond to the allegation of model code of conduct violation by 16 November. At the same time, EC also issued a show cause notice to Congress leader Priyanka Gandhi Vadra. In fact, the BJP had complained that Priyanka had recently given ‘false’ and ‘unverified’ statements about the PM at an election rally in Madhya Pradesh.

The BJP had on November 10 approached the Election Commission seeking action against AAP for posting ‘highly unacceptable’ and ‘immoral’ video clips and comments on the social media platform targeting Prime Minister Modi. AAP had posted a video story of industrialist Gautam Adani and PM Modi on social media platform ‘X’ last Wednesday. The next day the party posted a picture of Adani and Modi and alleged that the Prime Minister does not work for the people but for industrialists.

After this, a BJP delegation including Union Minister Hardeep Singh Puri, party’s national media in-charge and Rajya Sabha member Anil Baluni and party leader Om Pathak approached the Election Commission on this issue. In a notice issued to AAP on BJP’s complaint, the Election Commission said the national convenor of Aam Aadmi Party has been asked to provide clarification on the statements/allegations/assertions allegedly made in social media posts against the star campaigner of another national party and that political party. Has been asked to give.

The Commission has asked Kejriwal why appropriate action should not be taken against him for violating the Model Code of Conduct. At the same time, acting on BJP’s complaint, the Election Commission has asked Priyanka to give clarification on her statement by 8 pm on Thursday.

In its complaint to the Commission, the BJP had accused Priyanka of making ‘baseless and false’ claims that the Narendra Modi-led government has privatized public sector undertakings (PSUs). Priyanka had reportedly alleged that Prime Minister Modi has given the public sector undertaking Bharat Heavy Electricals Limited (BHEL) to his industrialist friends.

The post Election Commission!

Employees DA Hike: The dearness allowance of employees has been increased by the Central Government. Along with this, orders to increase DA have also been issued by more than a dozen state governments. Now amidst the assembly elections, the CM of the state has given instructions to the officials on DA.

A big announcement has been made by Chhattisgarh Chief Minister Bhupesh Baghel. He said that the government employees of Chhattisgarh will be given normal dearness allowance of the Centre. For this, officials have been instructed to obtain permission from the Election Commission.

In such a situation, the Chhattisgarh government is seeking permission from the Election Commission to give dearness allowance to its employees at par with the Centre. Earlier, the Rajasthan government had also prepared a proposal during the assembly elections and sent it to the Election Commission. After getting the permission, the dearness allowance of the employees and pensioners of Rajasthan was increased. Now Chhattisgarh government has also sought permission.

With the permission from the Election Commission, dearness allowance and dearness relief of employees and pensioners will be increased by four percent. With which his DA will increase to 46%. At present, the employees of Chhattisgarh receiving the seventh pay scale are being given the benefit of dearness allowance at the rate of 42%. The benefit of dearness allowance is provided to the employees on their basic salary.

Earlier this year, the dearness allowance of employees was increased twice by the Chhattisgarh government. Once the dearness allowance was increased by 5% and second time by 4%. An increase in dearness allowance for pensioners was announced in September. Along with this, dearness allowance of employees and officers was increased by 4%. Now once again with the increase in DA, more than 7 lakh employees will get big benefits. With the increase in dearness allowance, the salary of the employees will see an increase of more than Rs 20,000 annually.

The post DA Arrears: Dearness allowance of state employees and pensioners will increase again, DA will increase by 46 percent, Details inside first appeared on Rightsofemployees.com.

Aadhaar Card Link With Voter ID Card: Aadhaar card has become an important document in India. From admission in school to bank, Aadhaar card has become mandatory.

At the same time, it has been made mandatory to link Aadhar card with PAN card. If this is not done, then the PAN card will be cancelled. In such a situation, the Election Commission has also asked citizens to get voter ID linked with Aadhaar.

The Election Commission has given the facility to link Aadhaar with Voter ID on its website. In such a situation, a question also arises that if the Aadhaar card is not linked to the voter ID, then the name will be struck off from the voter list. In a written reply to this question in the Lok Sabha on Friday, Law Minister Kiren Rijiju said that if your Aadhaar card is not linked to Voter ID, then your name will not be deleted from the voter list.

The minister informed that there is a provision in The Election Laws (Amendment) Act, 2021 that Aadhaar card can be linked to Voter ID, but it will depend on the will of the citizen whether he links or not. There will be no problem even if voter ID card is not linked to Aadhaar card and the name of voters will also not be cut from the list.

54 crores linked voter ID with Aadhaar

The minister has informed in a statement that out of about 95 crore voters, more than 54 crore voters have linked their Aadhaar with Voter ID. If you also want to link your Aadhaar with Voter ID, then you can complete this work by visiting the website of the Election Commission or by contacting the Election Officer.

Campaign to link Voter ID

The Election Commission has started a program to link Aadhaar with Voter ID from August 1 in all states and union territories. Under this, Aadhaar is being linked to Voter ID on the basis of the wishes of the people. Election officials are going door-to-door asking about linking Aadhaar with Voter ID.
