										<content:encoded><![CDATA[<h3><strong>The bench said that the main question is whether the officer should be arrested by the state police if he belongs to the central government. If the central government had allowed action against that officer, the situation would have been completely different.</strong></h3>
<p>The Tamil Nadu Police said that the ED officer has been caught red-handed while accepting a bribe of Rs 20 lakh and the investigation under the Prevention of Corruption Act is almost complete. The state police was ready to file a charge sheet, but had to wait as the ED approached the Supreme Court.</p>
<p><span>In the past, it has been seen that many cases have been registered by the state governments against the CBI and ED officials during the action of the central agencies. Now the Supreme Court has given an important decision in this matter. The country&#8217;s top court said central authorities need to balance each other to protect them from retaliation. The court held that the state police should not be prevented from investigating allegations of corruption. It also said that conflict between central and state agencies could lead to a constitutional crisis.</span></p>

<p>The bench is hearing a case related to the arrest of an ED officer by the Tamil Nadu police on charges of alleged corruption. The court said that the accused has no right in the investigation, but he has the right to a fair investigation. The bench said that the main question is whether the officer should be arrested by the state police if he belongs to the central government. If the central government had allowed action against that officer, the situation would have been completely different.</p>
<p>The Tamil Nadu Police said that the ED officer has been caught red-handed while accepting a bribe of Rs 20 lakh and the investigation under the Prevention of Corruption Act is almost complete. <h3><strong>The accused has no role in the investigation</strong></h3>
<p>The Supreme Court bench said, &#8220;The accused cannot have any role in the investigation, but he has the right to a fair investigation.&#8221; In a federal structure each component should be allowed to retain its own domain of jurisdiction. If a state police retaliated by arresting central government officials, it would create a constitutional crisis. So to say that the state would have exclusive power of arrest would be dangerous to the federal structure. But the State Police cannot be deprived of the power to investigate any offense within its jurisdiction.”</p>
<h3><strong>Supreme Court to frame system</strong></h3>
<p>The Supreme Court said that we will discuss the arguments of both sides to strike a balance between these two competing aspects of police power. This is a classic example of state vs union. We will consider planning a larger federal structure and determine the system for investigating such matters. The interim bail granted to the arrested ED officer in the present case has been extended till further orders.</p>

										<content:encoded><![CDATA[<p>The Enforcement Directorate (ED) has issued an order to temporarily attach assets worth crores of rupees of Associated Journals Limited (AJL). This action has been taken by ED in the money laundering case. Under which assets worth Rs 751.9 crore have been attached.</p>
<p>Let us tell you that the agency has already interrogated Sonia and Rahul Gandhi in this matter. The Central Investigation Agency said that among the seized assets, AGL has properties in many places including Delhi, Mumbai and Lucknow. Its total price is Rs 661.69 crore. ED said that the value of Young India&#8217;s property is Rs 90.21 crore.</p>
<p><strong>Congress leader called this action inspired by elections</strong></p>

<p><strong>The Congress leader has targeted BJP on this action of ED. Abhishek Manu Singhvi wrote on</strong></p>
<p>PMLA action can take place only as a result of a predicate or principal offence. There is no transfer of any immovable property. There is no movement of money. There is no proceeds of crime. In fact, there is no complainant who claims to have been defrauded: not a single one!!</p>
<p><strong>&#8216;Such actions cannot prevent BJP&#8217;s defeat&#8217;</strong></p>
<p>He further wrote, this is a pre-built structure of deceit, lies and falsehood by and for the BJP to divert attention in the midst of elections. None of the BJP&#8217;s alliance partners &#8211; CBI, ED or IT &#8211; can prevent the BJP&#8217;s imminent defeat.</p>
<p><strong>What is the matter?</strong></p>
<p>The ED initiated the money-laundering investigation based on the procedure issued by the court of Metropolitan Magistrate of Delhi after taking cognizance of a private complaint vide order dated June 26, 2014. During this, the court admitted that seven accused including Young India had prima facie committed criminal breach of trust under section 406 of IPC, criminal conspiracy under section 403 of IPC and criminal conspiracy under section 120B, cheating and dishonestly obtaining property under section 420 of IPC. Inducing delivery, dishonest misappropriation of property have been committed.</p>
<p>The court held that the accused persons had hatched a criminal conspiracy to acquire assets worth hundreds of crores of rupees of AJL through a special purpose vehicle, M/s Young Indian. M/s AJL was given land at concessional rates in many cities of India for the purpose of publishing newspapers. AJL shut down its publishing operations in 2008 and began using the properties for commercial purposes. AJL had to repay a loan of Rs 90.21 crore to Congress.</p>

										<content:encoded><![CDATA[<p>The Enforcement Directorate (ED) raided the house of former deputy director Sachin Sawant in Lucknow on Wednesday. The team seized several documents, bank account details and electronic devices from his apartment. The ED team has arrested Sawant and taken him to Mumbai. It is being told that they have to be produced in the court.</p>
<p>IRS officer Sachin Sawant is currently posted in Lucknow. He is working for Customs and GST. Sawant was on the ED&#8217;s radar for a long time. When he was in the ED in Mumbai, he was found suspicious in the Rs 500 crore embezzlement of Diamond Company.</p>
<p>There were complaints related to corruption against Sawant. Regarding this, the ED team reached Lucknow from Mumbai. The ED team raided Sawant&#8217;s residence at Shalimar One World. In the prolonged campaign, the ED team took many documents in their possession.</p>
<p>Along with this, the details related to the bank were also collected. ED has taken all the things recovered from Sawant&#8217;s house in its possession. The team has also arrested Sachin Sawant and left for Mumbai.
