The government is working on a plan to clarify the Goods and Services Tax (GST) rules for cab aggregator apps. Sources told CNBC-TV18 that there is disparity in tax rules due to different business models like commission-based and Software-as-a-Service (SaaS) models.

The Central Board of Indirect Taxes and Customs (CBIC) is examining the suggestions of the industry and may soon place the issue before the GST Council. The Karnataka High Court has directed the CBIC to hold discussions with stakeholders and submit suggestions.

Difference between Commission and SaaS model

Commission model : Platforms like Uber and Ola charge 5% (without input tax credit) or 12% (with input tax credit) GST on each ride. This tax is collected from the passenger and deposited by the apps.

SaaS model: Platforms like Namma Yatri and Rapido charge drivers a monthly or daily subscription fee, which is subject to 18% GST. But no GST is charged from passengers for the ride.

What is the problem?

This disparity is leading to price hikes in the market. Industry insiders say that both models offer the same service (traffic), but different taxes are making the commission-based apps more expensive. “Rides are cheaper in the SaaS model, but that is because of tax benefits, not better functionality,” said a senior industry official.

What is legal confusion?

Under Section 9(5) of the CGST Act, services like passenger transport are taxable to the e-commerce platform rather than the driver. But it is not clear whether the SaaS model falls under this ambit, as these platforms claim to only connect drivers and passengers. The Karnataka Authority for Advance Rulings has held Namma Yatri and Myn (Multiverse Technologies) to be outside Section 9(5) as they only provide software. But platforms like Uber and Rapido are taxable due to their active role in ride management and customer service.

Given the growing demand for app-based transport services in India, there is a growing need for uniform tax rules. According to sources, the GST Council may amend Section 9(5) or issue clear guidelines for SaaS and commission models. This will bring clarity in taxation, create a level playing field and prevent revenue loss.

The Government of India has made a lot of changes in the rules of Goods and Services Tax. Under this, the Input Service Distributor System is going to be implemented from April 1, 2025. Earlier, businessmen had two options to allocate common ITC to their other GST registrations.

The Government of India has made a lot of changes in the rules of Goods and Services Tax. Under this, the Input Service Distributor System is going to be implemented from April 1, 2025. The main objective of this system is to ensure proper distribution of tax revenue among the states. With its help, state governments will collect appropriate amount of tax on shared services being provided at one place.

The Central GST Act has been amended under the Finance Act of 2024 to implement the ISD mechanism. This mechanism facilitates businesses that operate in multiple states. Under this, businesses can centralize invoices for common input services at one of their headquarters. This enables equitable distribution of input tax credit among branches that use shared services.

Benefit of input tax credit

Input tax credit is the tax that businesses pay on their purchases. It can be deducted from the output tax, thereby reducing the total GST liability of the business. Under the new rules, it will be mandatory to use the ISD system so that ITC is distributed correctly.

What are the new rules

Earlier, businessmen had two options to allocate common ITC to their other GST registrations. These two options were ISD mechanism or cross-charge method, but now from April 1, 2025, ITC will not be given for the recipient location if ISD is not used. If ITC is wrongly distributed, the tax authority recovers the amount along with interest. Along with this, a penalty will also be imposed for irregular distribution, which will be more than the amount of ITC or Rs 10,000.

GST System

It is believed that this change is another big step towards making the GST system more organized. The ISD system will not only distribute tax revenue among the states, but will also help businesses manage their tax liabilities better. This step will prove to be very good for preventing tax evasion and bringing transparency in the system.

The Goods and Services Tax Network (GSTN) has improved the system keeping in mind the convenience of entrepreneurs. Now the promoters and directors of a company can complete their biometric authentication to complete the GST registration process in their home state itself.

Earlier, to obtain GST registration, either an OTP verification process was required or biometric authentication had to be done by visiting the GST Facilitation Center in the registered jurisdiction of the company.

Now biometric authentication will be done in your home state as well

Biometric authentication used to happen only in the state where you are registering your GST. However, now the biometric authentication process can be completed in your home state instead of the state where GST registration is being sought.

For example, if your company is getting registered in Delhi and you are from Maharashtra, then you have to go to Delhi and complete the GST registration. With this update made by GSTN on March 3, 2025, now you can complete the GST registration from Maharashtra itself without coming to Delhi.

Biometric authentication was introduced to curb fake registrations

Experts say that the government had introduced biometric authentication to curb fake registrations for claiming input tax credit (ITC). By choosing the option of biometric authentication, taxpayers get separate evidence about the physical verification of company officials, which can strengthen the case in court if needed.

What do experts say

Experts say that all those registering for GST should always opt for biometric authentication as it adds an extra layer of security and authenticity to GST registration. Earlier, when the biometric authentication option was not available, there were many fake registrations and misuse of input tax credit (ITC).

GST on selling old cars: Recently, the GST Council has decided to increase the rate of Goods and Services Tax (GST) applicable on the sale of old cars from 12% to 18%. Earlier, it was levied at different rates depending on the type of vehicle.

The GST Council has decided to increase the rate of Goods and Services Tax (GST) applicable on the sale of old cars from 12% to 18%. Earlier, it was levied at different rates according to the type of vehicle. People have many questions in their minds about the new GST rules (Used Car GST Rates) imposed on old or second-hand cars. Like, how much GST has been imposed on it? Will GST have to be paid on selling the car? If the car is sold at a loss, will tax still have to be paid? And to whom will these rules apply? Let us tell you the answers to all these questions one by one.

To whom will the new GST rules apply?

This new GST rule will apply to those who are GST registered and deal in old cars. The government has clarified that this rule will apply only to those who do business of buying and selling old or used cars, such as companies like Spinny, Car Dekho, Cars24. GST registration is mandatory for these businessmen, and they will have to pay 18% GST.

According to the new rules, a registered dealer will have to pay GST on the sale of an old or used car only if he earns a margin on selling the vehicle. This means that when the selling price is more than the depreciation adjusted cost of the vehicle, only then will he have to pay GST as per the new rules.

What impact will it have on the common man?

If you are a common citizen and want to sell your old car, then there is relief for you. This new GST rule will not have any effect on the common man. If you sell your old car, then you will not have to pay GST. This rule applies only to those who buy and sell old cars for business.

Will GST have to be paid even if the sale is sold at a loss?

If a GST registered businessman sells an old car and incurs a loss, he will not have to pay GST. GST will be applicable only in the case when the businessman makes a profit on the sale of the car, that is, GST will have to be paid on the profit, but in case of loss, no tax will be levied.

Tax on used car sales

Currently, all old and used automobiles including EVs are eligible for 12% GST. Old and used petrol cars with engine capacity of 1200 cc or more and length of 4000 mm or more, diesel vehicles and SUVs with engine capacity of 1500 cc or more and length of 4000 mm are eligible for 18%. Now the GST Council has imposed 18% GST on all cars including EVs.

According to the Finance Minister, the Council has decided to increase the tax rate on the sale of all used EVs from 12% to 18%, just like non-electric vehicles. And this will apply only on the margin value.

The new GST rule has no significant impact on the common man

The increase in GST will have the biggest impact on those businesses that claim input tax credit (ITC) on the purchase of vehicles. For consumers, this rule will depend on whether they bought the vehicle from a registered seller or an unregistered seller. The new GST rules are applicable only to GST registered businessmen and it will not have any significant impact on the common man. Apart from this, businessmen will not have to pay GST on sales at a loss. This rule has been brought with the aim of ensuring transparency and tax collection in the business of buying and selling old cars.

Tax System in India: The government has approved a proposal to implement a ‘track and trace’ mechanism for some goods suspected of tax evasion. Under this, a unique code will be put on such goods or packets so that they can be traced in the supply chain.

Taking an important step to prevent Goods and Services Tax (GST) theft, the GST Council on Saturday approved a proposal to implement a ‘track and trace’ mechanism for some goods suspected of tax theft. Under this, a unique code will be put on such goods or packets so that they can be traced in the supply chain.

The government aims to implement this system by incorporating a provision through Section 148A in the Central Goods and Services Tax (CGST) Act, 2017 to empower the government to implement a track and trace mechanism for products that are prone to tax evasion.

The code will be pasted on the items or packets

Giving information about the decisions taken in the 55th meeting of the Council here, the Finance Ministry said, “This system will be based on a unique identification mark, which will be affixed on the said goods or their packets. This will provide a legal framework for developing such a system and will help in the implementation of the mechanism for tracing specified goods in the supply chain.”

It said, “It is clarified that in respect of supply of ‘online services’ such as online money gaming, OIDAR services, etc. to unregistered recipients, the supplier is required to mandatorily mention the name of the State of the unregistered recipient on the tax invoice and such name of the State of the recipient shall be deemed to be the address on record of the recipient for the purpose of section 12(2)(b) of the IGST Act, 2017, read with the proviso to rule 46(f) of the CGST Rules, 2017.”

Regarding the decision taken regarding the GST rate on goods, Finance Minister Nirmala Sitharaman said that the Council has decided to reduce the rate on ‘Fortified Rice Kernel’ (FRK) from 18 percent to five percent and also exempted gene therapy from GST.

To make the Indian tax system easy and convenient, the Goods and Services Tax (GST) system was implemented by the Government of India on 1 July 2017. GST registration is necessary to do business in India. But do you know for which traders it is necessary? Today we will tell you about this.

GST Number: With the aim of making the Indian tax system better, easier and convenient, the system of Goods and Services Tax (GST) was implemented by the Government of India on 1 July 2017. Today, it has been more than 7 years since GST was implemented and now GST registration is very important for doing business in India. But people still do not know many things related to GST. For example, people still do not know for whom GST registration is necessary? Today we will tell you which traders will not need to get GST registration for business.

They do not need

If the annual turnover of any business dealing in goods is less than Rs 40 lakh (Rs 20 lakh in hilly areas and northeastern states), then GST registration is not necessary for such business. Whereas, if the annual turnover of any business providing services is less than Rs 20 lakh (Rs 10 lakh in hilly areas and northeastern states), then GST registration is also not mandatory for such business.

GST is not required to sell these products

Not only business, there are many products in India for which GST registration is not required to do business. You do not need GST registration to sell vegetables, fruits, milk, eggs and fish etc. GST registration is not required to do business of products like food items that do not come with branded packaging, raw silk, khadi, unspun jute and unprocessed coffee.

GST Council: The meeting of the Goods and Services Tax Council (GST Council) is scheduled to be held on September 9. In this, the proposal to impose 18 percent GST on payment aggregator companies like BillDesk and CCAvenue can be discussed.

If this decision is taken, then they may have to pay GST even on payments of less than Rs 2000 through debit and credit cards. At present, they have been given exemption on small transactions. The GST Fitment Panel believes that these companies cannot be placed in the category of banks.

80% of digital payments are worth less than Rs 2,000

A report by CNBC TV18 claims that the GST fitment panel believes that GST should be imposed on payment aggregator companies. This will prove to be a big blow to all payment aggregator companies because currently more than 80 percent of the total digital payment transactions in the country are worth less than Rs 2000. According to a government notification issued during demonetisation in 2016, payment aggregators were barred from levying tax on services provided to merchants on small transactions.

At present, fees ranging from 0.5% to 2% are charged

Payment aggregators currently charge 0.5% to 2% on every transaction from merchants. If GST is implemented, they can pass on the additional cost to merchants. Currently, payment aggregators do not pay GST on transactions less than Rs 2000. They provide payment facilities through many digital payment systems like QR code, POS machine and net banking. If this happens, it will have a bad impact on small businessmen. Most of their payments are less than Rs 2000. If a businessman currently has to pay a fee of Rs 10 along with 1% gateway fee on a payment of Rs 1000, then after GST, he will have to pay Rs 11.80.

GST will be applicable only on payments made through debit and credit cards

Currently, UPI has become the most popular method of digital payment. In the financial year 2024, UPI transactions have increased by 57 percent on an annual basis and have crossed 131 billion. UPI’s share in digital payments has exceeded 80 percent. GST is applicable only on digital transactions done through debit and credit cards. Merchant Discount Rate (MDR) is not applicable on UPI transactions, so there will be no impact on them even after GST is imposed.

New Delhi: Goods and Services Tax (GST) officials across the country have sent thousands of notices to taxpayers claiming shortfall in tax payments for FY 2018.

The deadline for issuing notices is September 30 and taxpayers have been given 30 days to respond to these automated notices. According to the report, central and state GST officials have sent these notices in the last fortnight. These notices mainly relate to mismatch in GST output and liability, input tax credit, ineligible tax credit claims and reversal of credit in case of exempted supplies. Tax officials can send notice even after September 30, but they will have to prove the case of tax evasion or fraud on behalf of the taxpayer.

Tax experts said this will lead to an increase in litigation in the next three months, while the cash flow of companies will be affected as they will have to deposit 10% of the total liability as deposit to file appeals. Tax expert Bipin Sapra, partner at EY, said that given that the decision deadline for these show cause notices is December 31, we will see a lot of litigation in the next three months.

PwC partner Pratik Jain observed that many of the notices appear to have been issued without proper analysis of facts and figures. He said many of them should be removed later, although this would cause controversy and paperwork for the industry. Officials would like to plan ahead so that these incidents can be reduced.

Deloitte partner Mahesh Jaisingh said underpayment of tax on related party transactions, wrong claims of input tax credit, export status (including refunds given), and state-wise credit availment and distribution are some of the common areas of disputes.

The post Income Tax Notice: Big Update!

GST New Rule; Under the Goods and Services Tax, the new rule is going to be implemented from August 1. This new rule will be applicable to companies with a turnover of Rs 5 crore.

Under the Goods and Services Tax (GST), new rules are going to be implemented from August 1. This new rule is related to companies whose turnover is 5 crores or more. Earlier this new rule was applicable to annual turnover of Rs 10 crore or more, but now it has been reduced to half.

As per GST guidelines, it is mandatory for companies with B2B transaction value of Rs 5 crore to issue electronic invoices. On July 28, the Central Board of Indirect Taxes and Customs had informed about the change in the rule by tweeting.

Scope will increase under GST

In its tweet, CBI said that GST taxpayers whose aggregate turnover in any financial year is more than 5 crores, they will have to compulsorily furnish e-invoice for B2B supply or export of goods or services or both from 1st August 2023 . In May, notification was issued by CBIC for businesses with lower limit. This step will help in boosting the collection and compliance under GST.

GST E-Invoice Rules

Experts believe that the change in e-invoice rule and inclusion of companies with low turnover can help in promoting MSME units. According to a PTI report, Deloitte India Partner Leader Indirect Tax Mahesh Jaising said that with this announcement, the scope of MSMEs under e-invoicing will be expanded and they will be required to implement e-invoicing.

GST revenue will increase

New GST Rule: The Goods and Services Tax (GST) Council is preparing to bring a new law. Under this new law, if a company or businessman has claimed more Input Tax Credit (ITC), then he will have to explain the reason for this or deposit the excess amount in the government treasury.

ITC returned with interest

Sources said the law committee comprising tax officers from the Center and states is of the view that where the ITC claimed in GSTR-3B return exceeds a certain threshold from the amount reported in GSTR-B generated, the registered person should be liable to pay tax through the portal. This information should be given through Along with this, he should be directed to explain the reason for this difference or return the excess ITC with interest.

On which amount the provision will be applicable

The committee has suggested that if the difference is more than 20 percent and the amount is more than Rs 25 lakh, then this provision should be applicable.

The meeting will be held on July 11.

A final decision can be taken on the recommendations of the committee in the 50th meeting of the GST Council to be held on July 11. Currently, businesses use the tax paid by their suppliers to settle their GST liability in GSTR-3B.

GST Network generates Form GSTR-2B, which is a generated document. This shows the availability or non-availability of ITC in each document submitted by the suppliers. Sources said the Law Committee is of the view that a registered person should not be allowed to file monthly statement of outward supplies or GSTR-1 unless he has satisfied the tax authority about the discrepancy or has not refunded the excess ITC claimed.

Fake GST to be stopped

GST authorities last month took steps to check similar tax evasion in cases of difference in tax liability declared in GSTR-1 and tax paid in GSTR-3B. The purpose of this step is to curb the cases of fake invoices. Fraudsters usually use this route to avail ITC wrongfully without actual supply of goods or services.

2-month campaign launched

GST officials have launched a two-month special campaign to detect fake registrations under GST. Such registrations are done for the purpose of issuing fake bills or invoices and defrauding the government.

1.01 lakh crore GST evasion

The Directorate General of GST Intelligence (DGGI) has detected GST evasion of more than Rs 1.01 lakh crore in the financial year 2022-23, which is double the figure compared to the previous year. Of these, 14,000 cases have been registered by the authorities.

The post New GST Rule: Government is making plans regarding GST, new GST rules will be applicable first appeared on Rightsofemployees.com.

GST Registration: Many types of news about GST keep coming out across the country. Many times fake GST is also seen. In view of this, a big step has been taken by the Central Government. The tax officials will launch a special campaign for two months to detect fake GST registrations and identify fraudsters who take undue advantage by claiming bogus Input Tax Credit (ITC).

Fake ITC claims

After making fake registration on the Goods and Services Tax (GST) platform, fraudsters claim ITC on the basis of fake receipts and deposit the amount in their account without supply of any kind of service or product. .

The GST policy cell of the Central Board of Indirect Taxes and Customs (CBIC) said that the problem of wrongly taking input tax credit by issuing fake registrations and fake receipts has become serious. In this, unscrupulous people cause huge loss of revenue to the government through dubious and complicated transactions.

CBIC gave the information

CBIC said in a notification that all the tax departments of the Center and the states will run a special campaign in this regard from May 16 to July 15. During this, along with identifying suspicious GST accounts, necessary steps will be taken to weed out fake bills from the GST Network (GSTN). At present, there are 1.39 crore taxpayers registered under the GST system across the country. Out of these, detailed data analysis and risk parameters on GSTN will be used to identify bogus registrations.

VERIFICATION OF GST NUMBER

Steps will be taken to verify the suspected GST identification number after receiving the information of fake registration. If during verification the concerned taxpayer is found to be fictitious then immediate steps will be taken to cancel that registration. The growing problem of creating fake GST accounts in the names of other people was noticed in the national coordination meeting of the GST officers of the Center and the States held on 24 April.

Budget Expectations: Before the general budget, some non-governmental organizations (NGOs) have suggested steps to be taken for the betterment of the country’s elderly population.

These include measures to increase old age pension, additional income tax relief and exemption of Goods and Services Tax (GST) on products frequently used by older people.

Know which NGO raised this demand

NGO Agewell Foundation said that in view of the increasing gap between old and young generation, changes in the lifestyle of older people in the light of longer life span, favorable provisions should be made in the budget. The Foundation said in a statement that it is necessary to engage with a large number of retired people to keep them continuously active.

The Foundation has appealed to the Finance Ministry and other stakeholders to consider its recommendations and suggestions while finalizing the next budget. The statement said that the old age pension should be revised according to the current inflation.

Demand to increase the share of old age pension to Rs 3000

“The present share of the central government in the monthly old age pension should be increased to Rs 3,000 per month for each eligible old age person. The state government should also be advised to revise its share accordingly,” the statement said. Apart from this, the foundation has demanded an increase in the interest rate on bank, post office and other deposit and investment schemes for the elderly as part of financial security measures. It has been said that more relief should be given in income tax, especially for old people.

GST exemption should be given on these products

The NGO also sought GST exemption on services and products frequently used by the elderly such as audit diapers, medicines, healthcare equipment like wheelchairs and walkers, hospitalization of elderly patients above 70 years, mediclaim policies and medical consultation fees Key’s.

The Finance Ministry has said that in case the supplier does not deposit the tax due by September 30, GST taxpayers will have to return their ITC claims made in the previous financial year by November 30. In a statement, the ministry informed about this change made in the Goods and Services Tax (GST) provision. Along with this, the ministry has said that these taxpayers can claim ITC again after the tax is deposited by the supplier.

How will taxpayers get benefit?

Changes have been made in Section 37A of the Central Goods and Services Tax (CGST) Rules to give effect to this new provision. The ministry said that if a registered taxpayer has claimed input tax credit. But if the supplier has not deposited the tax due for that period by 30th September, then that input tax credit will have to be reversed by 30th November.

Rajat Mohan, senior partner, AMRG & Associates, said the change would only benefit select cases. Explaining the reason for this, Mohan said that firstly, this is a possible change, due to which no benefit will be available till the financial year 2021-22. Secondly, very few cases will be able to satisfy the conditions laid down in these rules.

On this change, Saurabh Agarwal, tax partner of EV, said that GSTR-1 will contain details of supplies made by the seller to multiple buyers. But it would be very difficult for the buyer to ascertain whether the tax has been deposited by the seller or not.

Let us tell you that GST is an indirect tax. It was implemented in 2017 to replace Variety of Previous Indirect Tax (VAT), Purchase Tax, Excise Duty and many previous indirect taxes. The registration limit for GST in India was earlier Rs 20 lakh. Now it has been increased to Rs 40 lakh. Now it is necessary for all the businesses having turnover of more than Rs.40 lakhs to get GST registration done.

To register under GST 2017, the turnover should be Rs 10 lakh for North-Eastern states including Himachal Pradesh, Uttarakhand, Jammu and Kashmir. In most states, restaurants with a revenue of more than Rs 20 lakh have to register for GST.

There are crores of people in the country who eat gutkha-paan masala everyday and this industry is huge. The government has recently issued some instructions regarding Gutkha-Pan Masala and soon the government is going to take a big decision on it. Let’s know the whole news

A Group of Ministers (GoM) has proposed to impose 38 percent ‘Specific Tax Based Duty’ on Gutkha-Pan. If it is approved, the government will get more revenue from the sale of khutkha and pan masala. This tax will be linked to the retail price of these items. At present, 28 percent GST is levied on these items and compensation charges are levied according to their price.

In fact, the Goods and Services Tax (GST) Council had asked a group of ministers to consider imposing capacity-based taxation on these tax-evading items. After this, the committee of ministers headed by Odisha’s Finance Minister Niranjan Pujari has presented its report and asked to impose 38 per cent tax.

Tax evasion will be curbed

According to media report, this report presented by the committee, if approved, will help in stopping tax evasion on Gutkha-Pan Masala items. Tax evasion can be stopped at the retail trader and supplier level. Along with this, the revenue will also increase.

What the committee said in the report Quoting the report of the Business Standards Committee, it has been said that small and retail traders do not come under the purview of GST registration, due to which tax evasion is increasing in the chain after the supply of such things. . In this case, there is a need to levy specific tax based charges. The GoM has proposed 38 percent special tax on items like pan masala, hookah, chillum, chewing tobacco, which can range from 12 percent to 69 percent of the retail sale price of these items.

Who will have to pay tax?

Suppose Rs 1.46 is paid by the manufacturer on a packet of Pan Masala worth Rs 5, Rs 0.88 is paid by the distributor and retailer, then the total tax will be Rs 2.34. According to the proposal presented there, the tax will increase, but will be within Rs 2.34 only. This means that Rs 2.06 tax will be paid by the manufacturer, Rs 0.28 tax by the distributor and retailer.

GST Return: CBIC tweeted on Friday, “GST Council has approved the extension of due date for filing GSTR-3B Return for September, 2022 from October 20, 2022 to October 21, 2022.”

New Delhi. The Central Board of Indirect Taxes and Customs (CBIC) has extended the deadline for filing Goods and Services Tax (GST) returns for the month of September by a day to October 21. Taxpayers had to face problems due to the slow working of the GST portal on Thursday. October 20 was the last date for filing monthly GST returns for some taxpayers.

On the slow running of the portal, CBIC had said that extension of the deadline is being considered. “The GST Council has approved the extension of due date for filing GSTR-3B Return for September, 2022 from October 20, 2022 to October 21, 2022,” CBIC tweeted on Friday.

The CBIC said that Thursday was the last date for filing GST returns for some categories of businessmen, but many taxpayers complained about the slow running of the portal, forcing them to submit their monthly GST return Form GSTR 3B. Could not fill

Earlier, the CBIC had said that they had received a complaint from the GST Network (GSTN) along with a proposal. In which it has been said that due to the slow running of the GST portal, there is a problem in filing monthly returns, so its deadline should be extended. At the same time, due to this decision of CBIC, there will be no burden of late fee or interest on the taxpayers.

Explain that in different states, taxpayers file monthly return and tax payment form GSTR-3B in different ways between 20th, 22nd and 24th of every month.

The post GST Return: Good news for small businessmen, will be able to file GST return for September till October 21 first appeared on Rightsofemployees.com.
