<p>According to the Gratuity Payment Rule 1972, an employee becomes entitled to receive gratuity after completing five years of service in any company or organization. Generally everyone knows this, but do you know that one can get the benefit of gratuity even before completing 5 years.</p>
<p>If you are not leaving the company only because of gratuity, then let us tell you that you can become eligible for gratuity even before completing 5 years.</p>
<h3><strong>Gratuity will be given on completion of 4 years 240 days</strong></h3>
<p>Very few people know that in some situations, gratuity can be received even before 5 years. If you have completed 4 years and 240 days in a company or organization, then you may be entitled to gratuity. Therefore, you must calculate your service period before leaving the job. Suppose if your company refuses to give gratuity, then you can file your complaint in the labor department or court.</p>
<p>According to experts, if an employee completes 4 years and 240 days in a company, then he is eligible to get gratuity. For example, if an employee joins a company on 1 January 2021, then he can take gratuity even after resigning on 29 August 2025, even if 5 years are not completed but he has worked for 4 years and 240 days in the company.<br />
If you want to get gratuity on leaving the job, then keep in mind that the period of your work in the company should be at least 4 years and 8 months. Only after this you will be eligible for gratuity. That is, employees who serve for less than 4 years and 240 days will not get gratuity. Please note that 5 years of service is not necessary in case of death or disability of an employee.</p>
<h3><strong>Rules for getting gratuity</strong></h3>
<p>If an employee has completed 240 days in the 5th year, then it will be considered as complete service of 5 years and he will be paid gratuity amount.</p>
<h3><strong>Can the company refuse to pay gratuity?</strong></h3>
<p>In such cases, the High Court has given different verdicts. For example, according to Delhi and Madras HC, an employee is entitled to gratuity after completing 4 years and 240 days. At the same time, Karnataka HC says that this rule applies only in certain circumstances, such as illness, accident, etc. If the employee resigns voluntarily, then he will have to complete 5 years in the company to get gratuity.</p>
<h3><strong>How is gratuity calculated?</strong></h3>
<p>This formula (Gratuity Calculation Formula) is used to calculate gratuity</p>
<p>(15 x last salary X service period) / 26</p>
<p>For example, if the last salary of an employee is Rs 45,000 and he has worked for 4 years and 290 days in the company, which will be considered equivalent to 5 years. So according to the formula, his gratuity will be Rs 1,29,808.</p>
<p>(15 X 45,000 X 5)/26 = Rs 1,29,808</p>
<h3><strong>Maximum tax-free gratuity limit\\</strong></h3>
<p>Gratuity payment is tax-free, but the government has set a limit for it. According to the rules, gratuity up to Rs 20 lakh is tax free. That is, if someone gets more gratuity than this, then the employee will have to pay tax on the amount above Rs 20 lakh.</p>

<h3><strong>What is Gratuity?</strong></h3>
<p><span>First of all, let us tell you what Gratuity is. Actually, Gratuity is a lump sum amount given to an employee when he leaves the job or retires. It can be said that this is a reward given to the employee by the company, which is given to him for long service. This amount is determined by the final salary of the employee and the number of years he has worked. </span></p>

<div class="blb_crns blb_crns-br">The gratuity limit for central government employees has been increased from the existing Rs 20 lakh to Rs 25 lakh from January 1, 2024. Due to increase in dearness allowance (DA) of central employees by 50%, gratuity has also increased.</div>

<p><span>Let us tell you that the new gratuity limit was announced on May 30, 2024 in a circular issued by the Department of Pension &amp; Pensioners Welfare under the Ministry of Personnel, Public Grievances and Pensions.</span></p>
<h3><strong>Gratuity Act</strong></h3>
<p><span>The Gratuity Act applies to various sectors including factories, mines, oil fields, plantations, ports, railways, motor transport undertakings, companies and shops with at least 10 employees. The Act entitles employees to receive gratuity payment equivalent to 15 days&#8217; wages for every year till the completion of the job. For non-government workers, the limit is Rs 10 lakh. On the other hand, seasonal establishments calculate gratuity on the basis of seven days&#8217; wages in every season. Seasonal establishments, also known as seasonal establishments, are businesses or industries that operate only during a particular period every year.  </span></p>
<p><span>Last year, the gratuity limit for central government employees was raised from Rs 20 lakh to Rs 25 lakh. This hike was done after the 50% hike in the dearness allowance (DA) of employees which took the dearness allowance (DA) to 50% of their basic salary.</span></p>
<p><span>The Gratuity Act guarantees employees better gratuity terms in all agreements or contracts. For companies that come under the jurisdiction of the Central Government or operate in multiple states, the Centre acts as the governing body.</span></p>
<h3><strong>Who will get the benefit of gratuity (Gratuity Eligibility)</strong></h3>
<p><span>Under the Gratuity Act, companies are required to pay gratuity to retired employees or employees who leave the job after at least five years of service. The employee is entitled to receive gratuity in the following cases:</span></p>
<ul>
<li><span>On resignation after completing five years of continuous service</span></li>
<li><span>On taking retirement as per company policy</span></li>
</ul>
<p><span>Under certain circumstances, an employee can get gratuity even if he has worked for less than 5 years.</span></p>
<ul>
<li><span>In case of death of the employee, gratuity is given to the nominee or legal heir.</span></li>
<li><span>If a person becomes disabled due to any accident or illness, even if he has not completed 5 years of service.</span></li>
<li><span>If the workers working in underground mines work continuously for 4 years and 190 days.</span></li>
<li><span>If employees working in other organisations work continuously for 4 years and 8 months i.e. 4 years and 240 days.</span></li>
</ul>
<h3><strong>Gratuity calculation formula</strong></h3>
<p><span>A simple formula is used to calculate gratuity. You can know your gratuity amount by using the formula given below:</span></p>
<p><span>(Last Salary) x (Years of employment) x (15/26)</span></p>
<p><strong><span>Salary components:</span></strong><span> Salary component includes basic salary, dearness allowance (DA) and commission.</span></p>
<p><strong><span>Monthly work days:</span></strong><span> There are 26 working days in a month.</span></p>
<p><strong><span>Method of calculation:</span></strong><span> 15 days average is determined based on half month&#8217;s salary.</span></p>
<h3><strong>How to claim gratuity?</strong></h3>
<p><span>To claim gratuity, a qualified employee has to submit an application in Form I to his company. If for any reason the employee is unable to do so, his nominee or legal heir is allowed to do so on his behalf.</span></p>
<p><span>On receiving the application, the company first verifies the claim, and then it has to immediately calculate the gratuity amount to be paid to the employee. This is necessary to ensure timely payment of gratuity and avoid any delay.</span></p>

<h2><strong>How to calculate gratuity&#8230;?</strong></h2>
<p>Salary is received every month, and so is its pay slip, so every employed person knows how much basic salary he got, how much dearness allowance (DA), how much house rent allowance (HRA) was received, and how much income tax was deducted. But not everyone knows how to calculate how much gratuity will be received on changing the job or retiring, or how much gratuity the employed person is entitled to.</p>

<p>So, today we tell you the formula for calculating gratuity, which is not at all difficult. Gratuity is not given for working for less than five years in any job, but if you spend more time in the company, you are entitled to gratuity for the entire service period. After completion of five years of service, for every year completed in the job, the basic salary of the last month of service, i.e.</p>
<p>the basic salary and <a href="https://www.rightsofemployees.com/69000-teachers-recruited-what-will-happen-to-the-teachers-working-with-the-new-merit-govt-took-a-big-decision/">dearness allowance</a> are added together (those who do not get dearness allowance will have to calculate only from the basic salary) is multiplied by 15. After this, the amount received is multiplied by the number of years spent in service, and the finally obtained amount is divided by 26 &#8211; that is the amount of gratuity you will receive.</p>
<h2><strong>That is, the formula to calculate gratuity is –</strong></h2>
<p>[(Last month&#8217;s basic pay + dearness allowance) x 15 x years of service] / 26</p>
<h2><strong>Now let’s take an example</strong></h2>
<p>Suppose, you worked in a company for 21 years and 11 months. Your last basic salary in that company was ₹50,000, on which you were also given ₹25,000 dearness allowance (DA). Now understand, in this case your service period will be counted as 22 years. Now you will add the amounts of ₹50,000 and ₹25,000, and now you will get an amount of ₹75,000, which will have to be multiplied by 15. Now you will see ₹11,25,000. Now multiply this amount by the total years of service, i.e. 22. After this, the amount that will be in front of you is ₹2,47,50,000, which will have to be divided by 26 as the last step of the formula. Now the amount you will see will be ₹9,51,923, and this will be the gratuity you will receive.</p>
<h2><strong>What part of gratuity is tax-free&#8230;?</strong></h2>
<p>If the gratuity you receive is calculated using the formula mentioned above, and your employer has not given you any other amount as a gift, then up to ₹20,00,000, that is, any amount less than this received as gratuity will remain completely tax-free, that is, you will not have to pay any kind of tax on that entire amount.</p>
