<p>Some people leave their jobs without thinking, and then regret it later. If you too have been working in an organization for a long time, then keep some things in mind before switching jobs. Especially, take steps to change jobs only after gathering information about gratuity.</p>
<p>If you miss out on gratuity for a few months, then my advice would be not to rush into changing jobs. You will benefit by changing jobs after taking advantage of gratuity, anyway, gratuity is the most discussed topic in the salaried class. Most people know that an employee gets gratuity after working continuously for 5 years in an institution. But if you do a private job, then you should know that gratuity is also available for jobs of less than 5 years. There are some special rules for this. If you have any questions related to gratuity in your mind, then you will find its answers below.</p>
<h3><strong>Question- What is Gratuity?</strong></h3>
<p>Answer- Gratuity is given by the company to its employees. It is a way of expressing gratitude to the employee on behalf of the company in return for continuous service.</p>
<h3><strong>Question- Are all private employees entitled to gratuity?</strong></h3>
<p>Answer- The Payment and Gratuity Act applies to all factories, mines, oil fields, ports and railways in the country. Along with this, employees of shops and companies employing more than 10 people also get the benefit of gratuity.</p>
<h3><strong>Question- After how many years of work does one get gratuity?</strong></h3>
<p>Answer- Generally, employees working continuously for 5 years in any institution become eligible for gratuity. But in some cases, gratuity benefit is available even for less than 5 years of service. &#8216;Continuous work&#8217; is clearly defined in section 2A of the Gratuity Act. According to this, many employees can get the benefit of gratuity even if they do not work for the full 5 years.</p>
<h3><strong>Question- Do we get the benefit of gratuity before 5 years?</strong></h3>
<p>Answer- According to Section-2A of the Gratuity Act, if the employees working in underground mines complete 4 years and 190 days continuously with their employer, then they get the benefit of gratuity. Whereas, the employees working in other organizations become eligible for gratuity after working for 4 years and 240 days (i.e. 4 years and 8 months).</p>

										<content:encoded><![CDATA[<p>An employee becomes entitled to receive gratuity after completing five years of service in any company. This rule is according to the &#8216;Gratuity Payment Rules 1972&#8217;. However, many employees are not aware that if they leave their job before completing 5 years of service with the company, they also become entitled to gratuity. In this, it becomes necessary for the employees to complete a certain time. If you have an offer from another company and you are not able to go only because of gratuity, then know how you become eligible for gratuity in 4 years?</p>
<h3><strong>Gratuity will be received in 4 years 240 days</strong></h3>
<p>Let us tell you that employees do not need to serve for 5 years in a company to get gratuity. Actually, an employee becomes eligible to get gratuity when he has worked for more than 4 years and 240 days in a company. Suppose, an employee joins a company on January 1, 2021, if he leaves the job after August 29, 2025, then he becomes entitled to get gratuity. This is because by that date the employee would have completed 4 years and 240 days in service. For this, the employee will not have to wait till January 1, 2026 to complete 5 years.</p>
<h3><strong>After how many days of work one does not get gratuity?</strong></h3>
<p>According to media reports, 240 days are equal to 7.89 months. Every employee must note that their working period should be 4 years and 8 months. Only after this they will be eligible for gratuity. Employees who serve for less than 4 years and 240 days will not get gratuity. However, 5 years of service is not necessary even in case of death or disability of an employee.</p>
<h3><strong>What is gratuity?</strong></h3>
<p>According to the Payment of Gratuity Act, gratuity is the amount that the company pays to any employee for his work. This amount is made by combining the employee&#8217;s salary, dearness allowance and commission. To avail this benefit, employees have to work in the same company for at least 5 years or 4 years 240 days.</p>

<p>In India, gratuity is regulated under the Payment of Gratuity Act, 1972, under which employees get a lump sum amount after leaving the job or retiring.</p>
<h3><strong>When does one become entitled to gratuity?</strong></h3>
<p>To get gratuity, an employee must work continuously for at least 5 years in the same company. However, if an employee dies or suffers from a serious physical disability, this rule does not apply and gratuity benefits are available even without completing 5 years. Who gets its benefit? This benefit is available to those employees who work in a factory, mine, plantation, shop or any such institution where at least 10 people work.</p>
<p>Gratuity is available in situations like retirement, resignation, dismissal from job or death/disability of the employee. How is gratuity calculated? Gratuity is calculated on the basis of the employee&#8217;s last salary and years of work. There are two ways for this &#8211; one for those employees who come under the Gratuity Act and the other for those employees who are not covered under this Act.</p>
<p>If the employee comes under this Act, then his gratuity is calculated using this formula:</p>
<h3><strong> Gratuity = (Last Drawn Salary × 15 × Number of Years of Service) / 26</strong></h3>
<div class="jsx-ce101e81366c6549 articleWrap"><span>Suppose an employee&#8217;s last basic salary and dearness allowance was Rs 50,000 and he worked for 10 years.</span></p>
<p><span>(50,000 × 15 × 10) / 26 = Rs 2,88,461.54</span></p>
<p><span>If the employee falls in a category not covered under the Act, the formula is different:</span></p>
<p><strong><span>Gratuity = (Last Drawn Salary × 15 × Number of Years of Service) / 30</span></strong></p>
<p><span>This calculation takes 30 days, which reduces the gratuity amount.</span></p>
<p><strong><span>Is there any tax to be paid on gratuity?</span></strong></p>
<ul>
<li><span>The tax rules on gratuity are different for government and private sector employees.</span></li>
<li><span>If someone is a government employee, he gets the entire gratuity tax free.</span></li>
<li><span>For private sector employees, gratuity up to Rs 20 lakh is tax free under the Gratuity Act.</span></li>
<li><span>If an employee is not covered under the Act, he is eligible for tax exemption on the lowest of three conditions – (1) actual gratuity received, (2) Rs 20 lakh, or (3) gratuity calculated as per the prescribed calculation.</span></li>
</ul>
<p><strong><span>Some important things related to gratuity</span></strong></p>
<ul>
<li><span>This amount is not deducted from the employee&#8217;s salary, but is completely funded by the company.</span></li>
<li><span>Maternity leave and other paid leaves are also counted in 5 years of service.</span></li>
<li><span>An employee can appoint a nominee for his gratuity so that the family can receive the money whenever required.</span></li>
<li><span>If an employee dies or becomes disabled while on the job, gratuity is paid immediately even if he has not completed 5 years.</span></li>
</ul>

<h3><strong>Question- How is the amount of gratuity calculated?</strong></h3>
<p><strong>Answer-</strong> It is a very easy way, you can calculate your gratuity yourself.<br />
Total gratuity amount = (last salary) x (15/26) x (number of years worked in the company).</p>
<p>Understand with an example: Suppose you have worked in the same company for 7 consecutive years. If the last salary is Rs 35000 (including basic salary and dearness allowance), then the calculation will be something like this &#8211;<br />
(35000) x (15/26) x (7) = Rs 1,41,346. An employee can get a maximum gratuity of Rs 20 lakh.</p>
<p>It is worth noting that as per the rules till now, to get gratuity, it is necessary for the employee to work continuously for 5 years in a single company. However, the central government is considering reducing it to 3 years. If this happens, employees working in the private sector will benefit on a large scale.</p>

<p>According to the rules, if you work honestly for 5 years or more in a company, then you become entitled to gratuity. This amount is given to the employee at the time of leaving the job or at the time of retirement by calculating the total period of his job. But suppose you worked in a company for 5 years, but the company still did not give you gratuity, then what will you do? After all, in what situations does the company have the right to stop your gratuity? If the company is not giving gratuity with the intention of usurping it, then what rights do you have? <h4><strong>In these situations the company has the right to stop gratuity</strong></h4>
<p>If an employee is accused of unethical behaviour or if the company has suffered a major loss due to his negligence, then the company has the right to not pay his gratuity amount. But to stop the gratuity, the company will first have to present evidence and the reason for it. Whatever reason the company is giving, it has to issue a show cause notice to the employee for that.</p>
<p>After this, both the parties are heard. The gratuity money will be stopped only after the employee is found guilty. But even in such a case, the company will deduct only the amount of loss it has suffered. Apart from this, when the company or institution is not registered under the Gratuity Act, then the employees do not come under the Gratuity Act. In such a situation, it is the discretion of the company to pay or not pay gratuity.</p>
<h4><strong>If the company has stopped the money with the intention of usurping it then…</strong></h4>
<p>If you worked in a company with full dedication and hard work for 5 years, but even after this the company did not give you gratuity, then in such a situation you have the right to take action against the company. In this situation, the employee can send a notice against the company. If even after this his problem is not resolved and he is not paid the amount, then the employee can complain against the company to the District Labor Commissioner. If found guilty in the case, the company has to pay the gratuity amount along with penalty and interest.</p>
<h4><strong>These are the rules of gratuity</strong></h4>
<p>&#8211; If 10 or more people work in a private or government company, then that company should give the benefit of gratuity to all the employees. Apart from the company, shops, mines, factories also<br />
come under the purview of this rule.</p>
<p>&#8211; If an employee has worked for 4 years and 8 months in the company, then his job will be considered for a full 5 years and he will get the amount of gratuity as per 5 years. If he has worked for less than 4 years and 8 months, then his job period will be counted as 4 years and in such a case he will not get gratuity.</p>
<p>&#8211; If an employee dies during his job, the entire amount deposited in his gratuity account is given to his nominee (Gratuity nominee). In such a case, the condition of working for at least 5 years does not apply.</p>
<p>&#8211; The notice period of the employee is also counted in the period of gratuity. Suppose you resigned from a company after working for four and a half years, but served a notice period of two months after resignation. In such a case, your period of employment will be counted as 4 years and 8 months only. And the amount of gratuity will be given by considering it as 5 years.</p>
<p>&#8211; Any company can give its employee a maximum of Rs 20 lakh as gratuity. The amount received as gratuity is tax free. This rule applies to both government jobs and private jobs.</p>

<p>This month, Allahabad Court gave an order regarding gratuity that if the employee chooses retirement after 60 years or takes <a href="https://www.rightsofemployees.com/vehicle-owner-update-get-high-security-number-plate-installed-in-the-vehicle-by-this-date-otherwise-heavy-fine-will-be-imposed/">retirement</a> at 62 years, he will get the benefit of gratuity in both the forms.</p>

<p>Actually, many companies did not provide the benefit of gratuity to the employee because the employee had selected the option of retirement at 62 years.</p>
<h4><strong>What is gratuity?</strong></h4>
<p>Gratuity is given by the company to its employees. When an employee works in the same organization for 5 years, he gets gratuity as a mark of gratitude. The benefit of gratuity is available to all government employees as well as <a href="https://www.rightsofemployees.com/driving-license-rule-major-change-in-the-rules-of-driving-license-test-will-be-implemented-from-june-1/">private employees</a>.</p>
<p>The Payment and Gratuity Act is applicable on all the companies, factories, mines, oil fields, ports and railways of the country. At the same time, even if more than 10 people work in a company or shop, they still get the benefit of gratuity.</p>
<h4><strong>When is gratuity received?</strong></h4>
<p>Employees become eligible to receive gratuity after working in any organization for 5 years. But in some cases this time limit is less. According to <a href="https://www.rightsofemployees.com/visa-rules-this-country-made-a-big-change-in-its-visa-policy/">Section-2A</a> of the Gratuity Act, if an employee works in an underground mine, then he can avail the benefit of gratuity after completion of 4 consecutive years and 190 days.</p>

<p>Whereas in other organizations, gratuity is given only after 4 years 240 days (i.e. 4 years 8 months). The benefit of gratuity is available after leaving the job or after retirement. You cannot take advantage of this while working. You get this benefit when you resign from the company.</p>
<p>Let us tell you that notice period is also counted in gratuity. Actually, notice period also comes under &#8216;<a href="https://www.rightsofemployees.com/children-will-get-pension-every-month-for-25-years-details/">continuous service</a>&#8216;.</p>
<h4><strong>How is gratuity calculated?</strong></h4>
<p>You can calculate gratuity very easily. You can easily calculate gratuity by adding basic salary and dearness allowance x (15/26) x (number of years worked).</p>
