Now in its place, USCIS will start a new application process, which is being described as more fair and equal for all applicants.

But now in the new system for H-1B visas, this will be replaced by a more fair method that provides equal opportunities to all applicants no matter how many employers apply for them. In case of applications not being accepted, ‘Not Selected: Not selected – not eligible to file an H-1B cap petition based on this registration’ will appear in the online account. In simple language, this means that you cannot apply for H-1B visa.

In which cases is the H-1B visa quota not applicable?

Actually, H-1B visas are issued in a fixed number, but there are some special cases where the visa quota does not apply. In such cases, applications will continue to be accepted by USCIS. This includes extending the visa period for existing H-1B visa holders, changing job conditions, changing employer/company or allowing to work at multiple places simultaneously.
