If a person has documents like Aadhar card, PAN card or voter ID, it does not mean that he will become a citizen of India. Bombay High Court said this while refusing to grant bail to a person accused of illegal infiltration from Bangladesh. The person is accused of living in India for about a year by making fake documents. Justice Amit Borkar’s bench said that the Citizenship Act clarifies who can be a citizen of India and who cannot. This Act explains how citizenship can be acquired.

The bench said that Aadhaar card, PAN card and voter ID are only for identification of citizens or for providing services to them. With this, the court refused to grant bail to Babu Abdul Rauf Sardar. Babu Abdul is accused of entering India without a valid passport or visa. He had got all the documents ready after coming here, which included Aadhaar card, PAN card, voter ID and Indian passport. Justice Borkar said that the Parliament had passed the Citizenship Act in 1955, which clearly explains who is called a citizen and who is not and who can become one.

Documents like Aadhaar, PAN are only for identification, not citizenship

He said, ‘In my opinion, the Citizenship Act, 1955 is the only law that defines citizenship and nationality in India. It clarifies who is a citizen, how is a citizen and if citizenship is not there, how can it be acquired.’ Justice Borkar said that just by having an Aadhar card, PAN card or voter ID, one does not become a citizen of India. These documents are there so that the citizen is identified and services can be provided to him. The Citizenship Act, which defines nationality, cannot be rejected on the basis of these documents. This important decision of the court has come at a time when there is a debate going on in Bihar on the SIR of the voter list.

The bench said that the 1955 law clearly states the difference between Indian citizens and intruders. He said that people who enter India illegally do not have any right to acquire Indian citizenship. He said that the difference between a citizen and an intruder is important because it protects the sovereignty of the country. It is this that ensures that citizens get their rights and no illegal person is able to acquire them. The bench ordered the investigation against the accused Bangladeshi to continue and said that if he is taken out, he will run away.

A senior Delhi Police official said that this decision has been taken on the instructions of the central government. During the verification campaign running since October last year, it was observed that a large number of illegal foreign nationals, especially Bangladeshis and Rohingyas, were claiming themselves to be Indian citizens with the help of Aadhaar, PAN and ration cards.

According to the Hindustan Times report, the police officer said, “Many illegal migrants have been found to have Aadhaar, ration card, PAN card and even cards issued by UNHCR (United Nations High Commissioner for Refugees). This made it difficult to correctly identify Indian citizenship. Therefore, now voter ID card or Indian passport has been made mandatory.”

Delhi Police has instructed DCPs of all districts to increase surveillance on suspicious persons in their areas. The officer said that the campaign against illegal immigrants will continue until even the last person is sent back to his country.

3500 Pakistani citizens in Delhi

Along with this, Delhi Police has also intensified action against citizens coming from Pakistan. According to information, out of about 3,500 Pakistani citizens living in Delhi, about 520 are Muslims, out of which more than 400 people have returned to Pakistan through Attari border so far.

After the recent terrorist attack in Pahalgam, the central government has decided to cancel the visas of Pakistanis. Under this, only citizens with medical, diplomatic and long term visas (LTV) have been exempted. Medical visas will also be considered invalid after April 29. Delhi Police and intelligence agencies have been ordered to collect information about Pakistani citizens living in Delhi and ask them to leave the country immediately. The government has also clarified that the visas of Hindu Pakistani citizens who are already on long term visas will remain intact.
