										<content:encoded><![CDATA[<h4><strong>The Karnataka Cabinet has approved a bill providing 100 per cent reservation for Karnataka residents in Group C and D posts in private companies in the state, Chief Minister Siddaramaiah said on Tuesday.</strong></h4>
<p>The Chief Minister said the decision was taken in a Cabinet meeting on Monday. &#8220;The Cabinet meeting held yesterday approved a bill making it compulsory for all private industries in the state to recruit 100 per cent Kannadigas (Kannada-speaking) for Group C and D posts,&#8221; he said in a post on X. According to Law Department sources, the bill will be introduced in the Assembly on Thursday.</p>
<h4><strong>100% reservation in private jobs</strong></h4>
<p>Let us tell you that a copy of this bill is with the news agency PTI, according to which any industry, factory will appoint 50 percent local candidates in management categories and 70 percent in non-management categories. Along with this, if the candidates do not have a secondary school certificate with Kannada language, then they will have to pass the proficiency test specified by the nodal agency.</p>

<p>Also, this bill states that if there are not enough local candidates, then the establishments will have to apply for exemption from this Act. All industries, factories or other establishments will have to follow this Act. Let us tell you that the Congress government came to power in Karnataka only last year. Since then, the Congress government has been continuously working on many important decisions. However, this is not the first time that a decision is being taken regarding reservation in employment.</p>

Let us tell you that it is not so. Even if you are a <a href="https://www.rightsofemployees.com/">government employee or doing a private job</a>, the rules of gratuity are the same for you.</p>
<p>This month, Allahabad Court gave an order regarding gratuity that if the employee chooses retirement after 60 years or takes <a href="https://www.rightsofemployees.com/vehicle-owner-update-get-high-security-number-plate-installed-in-the-vehicle-by-this-date-otherwise-heavy-fine-will-be-imposed/">retirement</a> at 62 years, he will get the benefit of gratuity in both the forms.</p>

<p>Actually, many companies did not provide the benefit of gratuity to the employee because the employee had selected the option of retirement at 62 years.</p>
<h4><strong>What is gratuity?</strong></h4>
<p>Gratuity is given by the company to its employees. When an employee works in the same organization for 5 years, he gets gratuity as a mark of gratitude. The benefit of gratuity is available to all government employees as well as <a href="https://www.rightsofemployees.com/driving-license-rule-major-change-in-the-rules-of-driving-license-test-will-be-implemented-from-june-1/">private employees</a>.</p>
<p>The Payment and Gratuity Act is applicable on all the companies, factories, mines, oil fields, ports and railways of the country. At the same time, even if more than 10 people work in a company or shop, they still get the benefit of gratuity.</p>
<h4><strong>When is gratuity received?</strong></h4>
<p>Employees become eligible to receive gratuity after working in any organization for 5 years. But in some cases this time limit is less. According to <a href="https://www.rightsofemployees.com/visa-rules-this-country-made-a-big-change-in-its-visa-policy/">Section-2A</a> of the Gratuity Act, if an employee works in an underground mine, then he can avail the benefit of gratuity after completion of 4 consecutive years and 190 days.</p>

<p>Whereas in other organizations, gratuity is given only after 4 years 240 days (i.e. 4 years 8 months). The benefit of gratuity is available after leaving the job or after retirement. You cannot take advantage of this while working. You get this benefit when you resign from the company.</p>
<p>Let us tell you that notice period is also counted in gratuity. Actually, notice period also comes under &#8216;<a href="https://www.rightsofemployees.com/children-will-get-pension-every-month-for-25-years-details/">continuous service</a>&#8216;.</p>
<h4><strong>How is gratuity calculated?</strong></h4>
<p>You can calculate gratuity very easily. You can easily calculate gratuity by adding basic salary and dearness allowance x (15/26) x (number of years worked).</p>

<p>For example, your basic salary and dearness allowance together is Rs 35000 and you have worked in the company for 7 years, then the total gratuity you will get is 35000 x (15/26) x 7 = Rs 1,41,346.</p>

										<content:encoded><![CDATA[<p><strong>Private Job Quota: The controversial law mandating 75 percent reservation in private sector jobs for residents of the state in Haryana has been canceled by the Punjab and Haryana High Court. The court has declared it unconstitutional.</strong></p>
<p>Under the Haryana State Employment of Local Candidates Act passed in 2020, a provision was made to reserve 75 percent of private sector jobs with a monthly salary or wage of less than Rs 30,000 for residents of the state. For this, domicile certificate was made necessary. The domicile requirement was reduced from 15 years to 5 years.</p>
<p><strong>Will the court&#8217;s decision prove to be a blow to the Khattar government?</strong></p>
<p>This decision of the High Court has come at a time when less than a year is left for the assembly elections in Haryana. This decision is being seen as a big setback for Manohar Lal Khattar&#8217;s government.</p>
<p>This Act, passed by the Haryana Assembly in November 2020, received the assent of the Governor in March 2021. The law was seen as the brainchild of the Jannayak Janata Party (JJP), an ally of the BJP in the state and whose leader Dushyant Chautala serves as the Deputy Chief Minister of Haryana. The promise of reservation was also prominent among the promises made by Chautala before the 2019 assembly elections.</p>
<p><strong>Gurugram Industrial Association and other companies had filed a petition</strong></p>
<p>Gurugram Industrial Association and other employer bodies had filed a petition in the High Court against this law of Haryana . The petitioners had argued that the concept behind the law violates the constitutional rights of employers. He had also said that this Act is against the principles of justice, equality, liberty and fraternity enshrined in the Constitution.</p>
<p>The Punjab and Haryana High Court had stayed the Act in February 2022, but a few days later, after the appeal of the Haryana government, the Supreme Court canceled the High Court order.</p>
<p>The Supreme Court had asked the High Court to take a decision on the petitions soon. At the same time, the benefit of this scheme can be availed only if the employee has served for at least (continuous or non-continuous) 10 years. <p>Employees have to fulfill these qualifications to avail pension under the Employees&#8217; Pension Scheme.</p>

&#8211; Must have attained at least 50 years of age for withdrawal from EPS pension at the reduced rate.</p>
<p><strong>Do not change UAN number</strong></p>
