Meaning of Dakhil Kharij

In Dakhal Kharij, Dakhal means that on the basis of registry, your name is included in the government records of ownership of that property . Kharij means that the name of the old owner has been removed from the ownership records. The time for Dakhal Kharij after registry is different in every state. Generally, Dakhal Kharij should be done within 45 days of registry. In some states, the name of Dakhal Kharij is different. In Haryana, it is known as Intakal.

Ownership rights will be obtained after mutation

Understand in simple language that before the registry, if the people in whose name the land is, stake their claim in the court, then you may have to fight a legal battle again. But after the mutation is done, you will have the right to own that land.

• Compulsory Registry: According to Section 17 of the Registration Act 1908, if the value of any immovable property is more than Rs 100, then it is necessary to get it registered. Since at present no property is available at such a low price, registration of almost all property transactions is necessary. This rule also applies in cases of gift deed.
• Required Documents: The documents required for property registry include sale deed, identity proof (Aadhaar card, PAN card), address proof, property tax receipts and other legal documents related to the property.
• Stamp and Registration Charges: Property registration requires payment of stamp duty and registration charges, which depend on the value of the property and the rules of the respective state.
• Need for witnesses: Two witnesses are required at the time of property registration. It is important to note that persons below 18 years of age, mentally ill persons or persons directly involved in the transaction cannot become witnesses.

• Importance of Mutation: Mutation is the process through which a change in ownership of a property is recorded in government records. This process helps in registering the name of the new owner for property tax, but it is not a legal proof of ownership.
• Offline Application: Application has to be submitted in the concerned Tehsil, Municipal Corporation or Gram Panchayat office.
• Apply Online: Many states have started the online mutation application process, making the process easier and faster.
• Documents Required: Certified copy of sale deed, proof of identity and address, property tax receipts, succession certificate in case of inheritance or will.
• Fee and time: Mutation fee varies from state to state and can range from Rs 25 to Rs 200 or more. The time taken to complete the process also depends on the state and local administration.

Special things related to mutation

• Legal importance of mutation: According to the Supreme Court, mutation is only for revenue purposes and is not a legal proof of ownership. The registered sale deed is more important for legal rights of ownership.
• Timely Mutation: It is advisable to get the mutation done immediately after purchasing the property, so that any legal disputes can be avoided in future and the name of the correct owner is registered for property tax.

Sampada 2.0: Expansion of digital registry process

The state government of Madhya Pradesh has launched Sampada 2.0 software to make property registration simple and transparent. Through this software, tasks like biometric identification, digital document formatting and mapping of property for registry will be completed automatically. Under this, the need to appear in the sub-registrar office has been eliminated. The identity of both the buyer and the seller will be verified online through e-KYC.

Khandwa’s sub-registrar, Brajkishore Chauhan, said that this new software will benefit the general public, especially the elderly and those who found it difficult to come to the registration office again and again. Along with this, fraudulent activities in the registry process will also be stopped, because through e-KYC, the identification of witnesses will also be completely correct and digital.

Biometric and digital identity: Fraud will be stopped.

The biggest feature of this new software is that biometric identification has been included in the e-KYC process. Due to this, the need for witnesses during registration has been eliminated, and all documents are being formatted digitally in a secure and authentic manner. This will also eliminate the possibility of fraud. Earlier, problems like server down or delay in paperwork of documents were faced, now with the arrival of this software, all these processes will become easier.

The public will get direct benefit

The people of Madhya Pradesh will get direct benefit from the new digital registry system. The time taken in registry work will be reduced and people will not have to visit offices again and again. Along with this, these new rules implemented in all 55 districts will bring transparency and simplicity in the process.

This step of the state government is an important initiative towards Digital India, which will save the time and labour of the people and also control the fraud in property registration.
