Property Rules: Can a flat owner refuse to sell the flat after making an agreement? Know what the laws are regarding this in India. This information will be useful when buying a flat.

Investing in property has become a very good way of investment today. That is why many people buy property. And then later sell it at a good price and make a profit. But some people buy property for living. He looks at the location according to his budget. And then selects the property and makes further deal. Then the entire process of buying the property is done. In which the agreement is signed. And after all the property deals are done, the property becomes his.

But many times people leave the deal midway while buying a house or flat. However, this happens at a very early stage. Talks are going on about buying or selling the property. But what if someone refuses to send the agreement for the flat? So what will happen in such a situation? Can a flat owner refuse to sell the flat after making an agreement? If you are also a landlord or are thinking of buying a flat, then know what the rules are regarding this. Can this be done or not?

Let us tell you that when someone is buying a flat, not only his emotions are involved in it but finances are also involved. How does someone collect money and buy a flat? If someone refuses in such a situation, then loss is inevitable. Therefore, let us tell you that no landlord can do this. If this is done, a case can be registered under Indian New Code i.e. BNS Section 316 Criminal Breach of Trust, in which there is a provision of 3 years imprisonment and fine.

Apart from this, under section 316 (5) of the BNS, a person can be prosecuted for cheating by deceiving or misleading a person, which includes both 7 years of imprisonment and fine. However, the court can give a decision regarding punishment or compensation after looking at the situation and severity of the case.

The post Property Rules: Can the landlord refuse to sell the flat once the agreement is made?

Tips for Renting Out Your House: If you are renting out your flat to someone, then first know about these rules. Otherwise, your tenant can claim your flat.

Often when people leave their city and go to another city, they have to rent a house. Usually in such cases people buy a flat because renting a house in a new big city is very expensive.

So nowadays many people rent out their flats to make them a source of income. Because it is better to earn some income from a flat than to just buy it. This is the reason why people are renting out flats more these days.

But let us tell you that if you give your flat on rent to someone, then you should keep some things in mind, otherwise you may have to face a lot of difficulties in the future.

Many people are not aware of the rules. But let us tell you that the tenant law says that under these rules, your tenant can claim his right on your flat. Therefore, you have to pay special attention to these things.

Let us tell you that if a tenant has been living peacefully in a flat for 12 years without any interruption, then he can claim possession of it under adverse possession. However, this has to be proved legally. The tenant has to prove that he had continuous possession of the flat and the landlord had no objection. And during this time no legal action was taken by him. In such a case he gets possession of the flat. But if you are a landlord, then you don’t need to panic. You should follow the legal rules and while renting out the flat, get a rent agreement made for 11 months. Keep renewing it. Before giving the flat, do a thorough investigation of the tenant and keep visiting your flat.

The post Property rules: Your tenant can also claim your flat, you must know this rule first appeared on Rightsofemployees.com.

Property Rules: Disputes related to property have an old relationship with our country. Disputes related to property have been seen and heard in India since a very old time.

This is the reason why many types of laws and rules have been made regarding property in the Constitution of India. Today we are going to tell you about a law here, which is very important to know. But you may be surprised to know that very few people know about this law. Today we will know here whether a daughter-in-law can also stake a claim on the property of her mother-in-law and father-in-law?

Can a daughter-in-law claim the self-acquired property of her mother-in-law and father-in-law?

Many types of laws have been made regarding who has the right over the property of the mother-in-law and father-in-law. Now a big question arises here that does the daughter-in-law also have a right over the property of the mother-in-law and father-in-law? The simple question is that the daughter-in-law has no legal right over the self-earned property of the mother-in-law and father-in-law. The daughter-in-law gets the right over the self-earned property of the mother-in-law and father-in-law through her husband.

If the mother-in-law and father-in-law want to give their self-earned property to the daughter-in-law, then they can do so. But, if the mother-in-law and father-in-law do not want to give their self-earned property to the daughter-in-law, then the daughter-in-law cannot claim that property. The mother-in-law and father-in-law can give their self-earned property to any relative through a will.

Daughter-in-law has no right on self-earned property of mother-in-law and father-in-law
According to the law, if a family has ancestral property, then the daughter-in-law can claim that property. A daughter-in-law can get a share in ancestral property in only two ways. This is possible if her husband transfers the right of his share of the property in her name. Apart from this, in situations like the death of the husband, the daughter-in-law can claim the ancestral property. Let us tell you that when a girl goes to her husband’s house after marriage, she has no right or claim on the property of her in-laws.

Property Rules: Registry is a very important stage in the entire process of buying any kind of property like house, house, shop or plot.

When a property is transferred from the name of one person to another, this transaction must be formalized through registration in the sub-registrar office after making some necessary payments like stamp duty and registration fees.

This entire process is known as property registration. Property registration also requires two witnesses in front of whom the property deal takes place. Here we will know who can be made witnesses in the property registration?

Witnesses have to register proof of identity and address

The entire process of registration of any property takes place under the Indian Registration Act, 1908. This law provides for registration of documents, preservation of evidence, prevention of fraud and assurance of ownership. The two witnesses you want to present during the registration of a property will have to establish their identity before the sub-registrar. For this, they have to show proof of their identity and address. Along with this, their biometric identity will also be scanned in the process of recording the information of the witnesses in the registry.

Who can be made a witness in the property registry

Now we will talk about the most important issue. Who can be made a witness in the property registry? Any person above 18 years of age can become a witness in the property registry. Here you have to keep in mind that neither of the two witnesses to be made in the property deal should be the seller or the buyer. It is necessary for both the witnesses to be present during the entire process of registration.

Property Knowledge: Real estate is considered the safest investment because it cannot be stolen like money or jewelry. However, there is always a risk with land and houses and that is the business. Especially when you have rented out a house or vacant land to someone or have not paid attention to it after buying it. Many people encroach on vacant land and build temporary structures.

Real estate is considered the safest investment because it cannot be stolen like money or jewelry. But, there is always a risk with land and house and that is business. Especially when you have rented out a house or vacant land to someone or have not paid attention to it after buying it. Many people encroach on vacant land and make temporary constructions. Disputes related to the possession of land and houses are arising every day across the country. People also go to the police station and court regarding disputes related to these lands.

Legal resolution of such disputes can be lengthy, so do not let a situation arise where you have to go to court. Encroachment or illegal possession is considered a crime in India. There are also legal provisions for this. In such a situation, it is important to know the legal ways to deal with land encroachment.

Land encroachment is when a person illegally occupies or usurps the land and property of another. Usually, a person builds a temporary structure to encroach on the land.

What does the law say?

Encroachment on land is considered a crime in India. Section 441 of the Indian Penal Code (IPC) applies to cases related to encroachment on land and property. If a person takes possession of land or house with wrongful intent and in an illegal manner, he can be punished with fine and 3 months of hard labour under Section 447.

What to do if your property is illegally occupied?

Meanwhile, if someone has illegally occupied your land or property, first complain about it to the concerned authorities. The landowner can file a case against the encroachers. After filing a petition in the court, the court can stop the encroachment and also order compensation.

In the case of land encroachment, the court decides the amount of compensation based on the value of the land. In case of any damage to your property during illegal occupation, the complainant can claim compensation under Rules 1, 2 and 3 of Order 39. Also, the problem of land encroachment can be resolved by mutual consent. These include options like mediation, partition of land, sale and lease of property.

Property Rules: Adopted children are often harassed by relatives after the death of their parents. Don’t treat those kids well. That’s why rules have been made for these children in the law. So that they get their rights. The rights of the adopted child are also similar to the rights of the children born in that family.

Children get rights in the property of parents. But what will happen to those children who are adopted (Property Rights of Adopted Child). Do they get the right in the property or not? Many questions arise in the minds of people regarding this. Under the Hindu Succession Act, as soon as the child is born, they become partners in the property. Many times adopted children are not fully aware of their rights. Because of which if the parents die, then these children have to face many problems.

The law has given the rights, after the death of the parents many times the relatives harass the adopted children. Don’t treat those kids well. That’s why rules have been made for these children in the law. So that they get their rights. The rights of the adopted child are also similar to the rights of the children born in that family.

The Hindu Succession Act applies to people of Hindu, Buddhist, Sikh and Jain religions. In which both the boy and the girl have been given equal rights in the property. When the legal process of adoption of a child is completed, then after that that child gets all the rights. He also becomes possessor in the property.

If the will is ready?

If the parents do not make any will and they die then all the children are given equal rights. That is, they will get equal rights in the parents’ earned property and ancestral property.

Rights in the family in which you were born?

This question may also come in the mind of the people that if the child is adopted by some other family then he will get the right in the property in the family in which he is born? This can happen only when the parent leaves the property in the will in the name of that child. The children who are adopted do not have any right on the property of the family in which they are born.
