It’s a landlord’s worst nightmare. The thing is, your 11-month agreement has ended, but your tenant is still comfortably sitting in your living room.

Actually, under the new Home Rent Rules 2025, you can’t just take a DIY approach to eviction anymore. Specifically, the law has tightened significantly to prevent “self-help” evictions. As a result, if you try to cut off the water or change the locks, you could end up facing criminal charges yourself (let’s be real, the law treats that as harassment now).

Consequently, you have to follow the paper trail to get your property back.

And here’s the kicker. Acceptance is legally seen as consent.

Basically, if the tenant transfers rent digitally after the 11th month and you don’t return it immediately, the court might assume you’ve agreed to a new “month-to-month” tenancy. Instead of a simple exit, you’ve accidentally created a legal extension. In fact, recent Supreme Court rulings from April 2025 suggest that landlords must show “immediate and consistent objection” in writing to prove the tenant is an unauthorized occupant. And then Y followed. The safest bet is to refund the money instantly and record the rejection on WhatsApp or email.

Moreover, the police aren’t usually your first call. Specifically, they view most possession issues as civil disputes.

Actually, you can only file a police complaint under Sections 441 and 447 (Criminal Trespass) if there is actual force, threats, or a forged agreement involved. As a result, for a standard “overstay,” your battleground is the Rent Tribunal or Civil Court. Consequently, the new 2025 rules aim to settle these cases within 120 days, which is a huge relief compared to the years-long battles of the past (those too).

The thing is, the agreement itself is your strongest weapon. In fact, the Supreme Court ruled in November 2025 that a tenant cannot challenge a landlord’s ownership once they have signed a rent deed.

Basically, if you have a digitally stamped, registered agreement, your path to an eviction order is much smoother. Instead of a tidy wrap-up, just keep in mind that the “11-month rule” is becoming less of a loophole. And then Y followed. Starting in late 2025, even these short-term leases are coming under stricter scrutiny for registration and stamp duty compliance…
