Will OTP SMS stop coming from November 1? If TRAI’s new rules are followed, telecom companies will not be able to send commercial SMS. Telecom operators in India have expressed their concern about the new rules of the Telecom Regulatory Authority of India (TRAI) which are going to be implemented from November 1. According to this rule, it will be mandatory to trace transaction and service SMS coming from banks, e-commerce platforms and other financial institutions, which was previously exempted. If there is any interruption in any message, that message will be filtered.

Telecom companies have said that many key institutions (PEs) and telemarketers are not yet ready to comply with these rules, which may hinder the delivery of OTP and other necessary messages. The Cellular Operators Association of India (COAI) has informed TRAI about this issue and has appealed to extend the date of implementation of this new rule. This association includes telecom companies like Jio, Airtel and Voda-Idea. TRAI has directed that telecom companies will not allow messages that cannot be traced to be delivered to customers.

According to the report, telecom operators have stated that telemarketers and PEs have not started implementing the necessary technical solutions. In such a situation, messages containing OTP and other important information will not reach people.

It is believed that around 1.5 – 1.7 billion commercial messages are sent daily in India, so due to these rules, the delivery of messages may take a lot of time or they may reach late. Telecom companies have suggested that these rules should be implemented in ‘logger mode’ from November 1 so that if any wrong signals are sent, they can be noted and appropriate action can be taken. The industry has promised that by December 1, the delivery of ad volumes will be brought in ‘blocking mode’.

On the demand of access service providers and other stakeholders, the regulator has decided to extend this deadline. Recently, TRAI had given a deadline of 31 August 2024 to telecom service providers and telemarketers to whitelist messages containing URL, APK and OTT links to stop fake SMS and calls.

Deadline extended

With the implementation of the new rules of the Department of Telecommunications, messages and calls with fake links can be curbed. However, many telemarketers have not yet whitelisted their message templates, due to which after the implementation of the new rule, users could face problems in receiving messages with OTP and in making online payments etc. Seeing the problems of the users, the telecom regulator has now extended its deadline by 1 month i.e. 30 days. Now these rules will come into effect from October 1, 2024.

TRAI had held a meeting with telecom operators, telemarketers and other stakeholders on August 8 earlier this month, in which it had issued guidelines regarding marketing messages and calls.

TRAI gave strict orders

TRAI had said in its direction that if any entity misuses its SIP/PRI lines for making spam calls, all telecom resources of the entity will be disconnected by its telecom service provider (TSP) and the entity will be blacklisted.

This information will be shared by the Telecom Service Provider (TSP) with all other TSPs who, in turn, will disconnect all telecom resources allocated to that entity and blacklist it for a period of up to two years. No new telecom resources will be allocated to it by any TSP during the period of blacklisting.

From September 1, 2024, no SMS will be allowed to be delivered that contains spam URLs/APK links that are not included in the whitelist. TRAI has now extended this deadline by 30 days. That is, from October 1, messages without whitelisting will not be received by users. Apart from this, the regulator has given telecom service providers time till October 31, 2024 to implement chain binding between the entity and the telemarketer so that such message flow can be traced.

40 to 80 times more expensive

The telecom regulator believes that the price of Wi-Fi broadband used for public data offices is very high, due to which many users are suffering losses. TRAI found in its tariff order note that the Lease Line Tariff (LLT) is 40 to 80 times more expensive than Fiber-to-the-Home (FFTH), due to which users are not using it at all.

TRAI, citing a decrease in data usage in its proposal, said that according to the PM-Wani Central Registry, there has been a significant decline in daily average data usage. Till last year, the average data usage was 1GB daily, which has now come down to a few MB, which is much less than the monthly average data limit.

Advice to reduce price

TRAI has advised to reduce its price, citing a decrease in retail broadband connections. If service providers accept this suggestion of TRAI, then users using public Wi-Fi will benefit from it and data usage will increase. Due to the connection being cheaper, it will affect the overall data usage.

Users with fiber-to-the-home connection from telecom service providers can avail data at a speed of 100Mbps by spending Rs 700 per month. Users will have to spend many times more for a 100Mbps speed plan on leased line public Wi-Fi as compared to FTTH. Due to this, the number of leased line broadband users is also gradually decreasing.

TRAI said it believes that Public Data Offices (PDOs), particularly smaller entities like local shops, retailers etc. generally have low revenues and neither require ILL connections nor can afford the higher backhaul rates applicable to large commercial entities.

“The Authority proposes that for the purpose of providing PM-WANI (Wi-Fi Access Network Interface) scheme, PDOs may be charged the same rate as for retail broadband (FTTH) connections for which the said retail rate is being offered by the service providers to the customers,” the regulator said.

Hearing the petition of lawyer Rajeshwari, the bench of Justices Sanjeev Khanna and SVN Bhatti said that the court is not willing to proceed with the writ petition. It is also stated in the affidavit that the blocked number is not issued to any other customer for 90 days.
