The properties of the Waqf Board illegally occupied in UP will be confiscated. According to the report, for this, the government has directed all the District Magistrates to run a campaign and identify these properties. After this, the Yogi government will confiscate the properties illegally declared as Waqf Board across UP. An investigation by the Uttar Pradesh government has revealed that many properties have been wrongly declared as Waqf properties. These also include lands like barns, ponds and puddles in rural areas.

According to media reports, according to the UP Revenue Department, only 2,963 Waqf properties are registered in their official records. The rest of the properties have been illegally declared as the property of the Waqf Board. The BJP government says that government and village society lands cannot be Waqf properties. Despite this, thousands of properties have been illegally declared as Waqf.

Officials said that government and village society lands cannot be declared as Waqf property. They said that after the pond land in Pilibhit was declared as Waqf, the case is also going on in the High Court. On this basis, the Revenue Department is conducting a survey in the whole of UP to find out how many such properties have been declared as Waqf land illegally. A detailed report has been sought from all DMs about this.

Chief Minister Yogi Adityanath on Thursday launched a frontal attack on the Waqf Board, accusing it of land encroachment and asserting that its arbitrary claims on public and historical sites will not be tolerated for long.

Addressing a public meeting in Shringaverpur, Prayagraj, he said, “You are seeing the occupation of the mythological land of Nishadraj here. There have been occupations in the name of Waqf at many places in the city. Even during the Kumbh Mela, statements were made that the land of Kumbh also belongs to Waqf. We had asked – has the Waqf Board become a land mafia?”

He emphasised that such encroachments have been removed under his government. He said the mafias have been driven out of Uttar Pradesh. “Many places, including the holy land associated with Nishad Raj, were encroached upon in the name of Waqf. But this will not be allowed to happen. Despite their objections, a grand and divine Kumbh Mela was organised,” the CM said.

The chief minister also praised Prime Minister Narendra Modi and Union Home Minister Amit Shah for taking legislative action against the alleged irregularities of the Wakf Board. “We are thankful to the Prime Minister and the Home Minister for curbing the arbitrariness of the Wakf Board. An important bill to address this issue has already been passed in the Lok Sabha and will now be passed in the Rajya Sabha as well,” he said.

The Waqf (Amendment) Bill was passed in the Rajya Sabha on Thursday after the Lok Sabha. CM Yogi Adityanath said the state will no longer tolerate illegal claims and national interest must come first. He said, “Those who are loyal to the nation will always find their way.”

The Waqf (Amendment) Bill 2024 provides for the abolition of Section 40 of the Waqf Act. This section allows the Waqf Board and Tribunal to declare any land as Waqf property. Law Minister Kiren Rijiju has described it as the “most draconian” provision. He alleged that it was misused to grab land on a large scale. The new bill provides that the decision to declare any land as Waqf can be challenged in court.

Rijiju said, “The most stringent provision in the Waqf Act was Section 40. Under this, the Waqf Board could declare any land as Waqf property. We have removed that provision.”

The minister said that the Waqf Bill will not take away the land of the Muslim community. Some opposition leaders are misleading the people. Some people are misusing Section 40 of the existing Waqf Act for their own selfish interests. Due to this, the Waqf property has increased by lakhs.

These provisions were in section 40 of the Wakf Act

Under Section 40 of the Wakf Act , the Wakf Board has the power to decide whether a property is a Wakf property or not. The decision of the Wakf Board is final. It can be cancelled or amended by the Wakf Tribunal. One could not appeal against the decision of the Tribunal in the court.

If a property is declared a Waqf then you can go to court within 90 days
In the Wakf Amendment Bill, the provisions that consider the decisions of the Wakf Tribunal as final have been removed. After the bill is passed, if any property is declared Wakf, then an appeal can be made against it in the High Court within 90 days.

However, opposition MPs condemned the proceedings of the meeting and accused Pal of “distorting” the democratic process. “It was a farcical exercise. We were not heard. Pal has acted in a dictatorial manner,” TMC MP Kalyan Banerjee told reporters.

At the same time, Jagadambikaa Pal rejected all the allegations of the opposition and said that the entire process was democratic and the view of the majority remained intact.

After the meeting, he said, “Today, there was a clause-by-clause meeting. Opposition members presented amendments on 44 clauses. I asked the members if they were presenting amendments. They said they would present amendments. Nothing can be more democratic than this. The kind of amendments that have been passed today, I think a better bill will be prepared from this.”

These important amendments were made

One of the more significant amendments proposed by the committee is that existing waqf properties cannot be questioned on the ground of ‘waqf by user’, which existed in the current law.

Jagadambika Pal said that the amendments moved by NDA members in 14 sections of the bill have been accepted. He said that opposition members moved hundreds of amendments in all 44 sections and all of them were defeated by vote.

There was a lot of commotion in the meeting

It is worth noting that the JPC meeting witnessed uproar many times. In a meeting held a few days ago, Jagadambika Pal accused TMC MP Kalyan Banerjee of abusing him. After this, 10 opposition MPs were suspended on the proposal of BJP MP Nishikant Dubey. At the same time, during the meeting on October 22 last year, there was a situation of fighting between many leaders.

During the clash, Kalyan Banerjee picked up a glass water bottle kept there and hit the table and accidentally injured himself.
