Regular working time and on-call time

Regular working time may not exceed 40 hours per week.

Where necessary with regard to the nature of the work or the working conditions in general
working time may amount to an average of 40 hours per week for a period of at most four
weeks.
Monday is considered the first day of the week, unless another arrangement is in place at the workplace. on-call time may be claimed up to a maximum of 48 hours per employee over a period of 4 weeks or 50 hours per calendar month. The time during which an employee performs work on behalf of the employer is not considered on-call time.

Overtime

‘Overtime’ means working time in excess of regular working time.

When calculating overtime, compensatory rest periods or other rest periods that are scheduled
during the employee’s regular working time or on-call time shall be treated as regular hours
worked or time spent on call. Act (2000:766).

When there is a special need to increase the number of hours worked, overtime may
be worked up to a maximum of 48 hours per employee over a period of four weeks, or 50
hours over a calendar month, with a maximum of 200 hours over a calendar year(general
overtime)

Overtime in excess of general overtime may be worked up to a maximum of 150
hours per employee over a calendar year if there are special grounds for doing so and no other
reasonable solution has been possible (extra overtime).
Together, extra overtime and general overtime may not exceed 48 hours per employee over aperiod of four weeks, or 50 hours over a calendar month.


Total working time

Section 10b The total working time per every seven day period may amount to an average of
at most 48 hours during a reference period of at most four months. When calculating the total
working time, annual leave and sickness absence during times when the employee would
otherwise have worked shall be treated as hours worked. Act (2011:740)

  3. So many people worked on small and big shops. But shopkeepers not follow the rules of shops and establishment. Not give sickness leave, casual leave and privilege leave. The employee fall ill or any emergency the shopkeeper deduct salary amount. Pl. tell me about timing of shops to open and close. I think no change in working time in offices, factories and shops. Those establishment not follow the rules. Govt. What take the steps against shops and establishment under the shops and establishment Act. Pl. explain it.

  4. One should read the employment letter’s clauses and conditions (Allotment Letter) before accepting a job. But always remember – All Clauses and Conditions will suit and will be to the advantages of the Employer; whether private or public sector.

  5. why not indian govt give instructions to pvt industries to follow the above rules / act.
    Private industry has become a big mess in individual employee life, nobody will control it.

    because all big private players support the government during elections

  6. In private companies in time is fixed in between 9 to 10 am but out time is not fixed working hours are more than10 hours.

Despite having worked for several years in an govt. office,no botheration results from the officials in order to result as confirmation for contractual employees.This is despite having worked sincerely by some of them.Load of work is equivalent for contractual and permanent employees.Contractual Employees are given much lesser salary and the expensiveness has increased much more for everybody.The other benefits including medical advantages plus more number of leaves are also not being given to the contractual employees. An analysis can also be made from the Biometric Attendance System,since the time it resulted.

  14. मैं एक पावर हाउस पर नौकरी करता हु 9 pm से9 am तक पूरे 12 घण्टे सेलरी 6948 कोई ओवर टाइम नही मिलता है न ही इ पी एफ का पता है उत्तर प्रदेश सरकार मे बिजली ठेका संविधा कर्मचारीयों का शोषण बरकरार है कोई सुनने वाला नही है क्या करे नौकरी छोड़े तो चार लोग उसी नौकरी को करने के लिए तैयार है बेरोजगारी जो इतनी जादा है

  15. Sirf rule banane se ky hota hai.. aur pata nehi kisne banaya..!! wasi rules ko companies ke upar applu bhi karo sare bade bade companies like Infosys, Wipro, TCS jaise Indian companies 9.5 hours kaam karate haain. But Foreign MNC have good working culture.. 8 hrs..

  16. Salary is very less very less over time. less holiday working hour per week 48 hours 8 am to 5 pm. but in the name of in -creament my employer they come with tears. this year we can’t increase ur salary. we leep qiut what to do. as an individual we can’t do anything.
