Landlord’s Eviction Blueprint: The 4-Step Legal Process

The goal is simple: regain possession. The method must be strictly legal.

I. The Initial Warning Shot (Step 1)

Before you talk to any court, the tenant must be formally warned.

Review the Contract: First thing: Check the rental agreement. You need a valid ground for eviction (e.g., non-payment, major violation, personal need). No valid ground, no case. Check the termination and notice clauses too.

Draft the Legal Notice: Prepare a formal, written notice. This must clearly state the reason for eviction and give the specified notice period—often 15 to 30 days, depending on the state’s Rent Act or the agreement itself.

Serve the Proof: Send the notice via registered post (or courier with tracking). Getting the delivery confirmation is your proof of service for the court later.

II. Filing the Suit (Step 2)

The tenant ignored the notice. Now you involve the judicial system.

Gather Your Arsenal: Collect everything: the rental agreement, the copy of the legal notice you sent, and the proof of delivery (the postal receipt/tracking confirmation).

File the Petition: Once the notice period is over, and the tenant is still there, file an eviction petition. You file this with the Civil Court that has jurisdiction over the property. If your state uses specific Rent Control Acts, you go to the Rent Controller Court—they handle these specialized cases.

III. The Judicial Process (Step 3)

The court takes over. This takes time.

Attend Hearings: The court will summon the tenant. Both parties present their evidence and arguments. You must be able to prove your ground for eviction is valid and that the notice was properly served.

Wait for the Order: If the court agrees the eviction is justified, it issues a final eviction order. This specifies the exact date the tenant must vacate the property.

IV. Enforcement (Step 4)

The tenant has lost in court but still refuses to move.

Request Law Enforcement: Do not use force. It is a criminal act to change the locks, disconnect water, or intimidate the tenant yourself. Instead, you request the court to use law enforcement (like a bailiff or court officer) to implement and enforce the official eviction order.

The entire process must move at the speed of the court. Patience is mandatory here.

The BJP government has extended the current excise policy in Delhi for three months. The circular issued by the Excise Department said that the validity of L-1 (Indian liquor), L-1F (foreign liquor) and L-2 (beer) licensees has been approved to be extended till June 30, for which three months’ fee will have to be deposited.

This policy was first implemented in September 2022, when the then AAP government abruptly scrapped the controversial New Excise Policy (2021-22). This policy was also extended for six months in September last year, the deadline of which expired on March 31. In fact, a final decision has not been taken on the new policy yet, hence the decision to extend it has been taken.

The draft of the new policy prepared by the Delhi government is pending with the cabinet and some changes are expected to be made in it. Now that the new government has come to power, the reform process may take more time. In such a situation, it has been decided to continue the old policy for the next three months as a temporary solution.

There has been uncertainty over the liquor policy in Delhi for a long time. The new excise policy implemented in the year 2021-22 was cancelled due to corruption allegations, after which the old policy was implemented temporarily. However, this temporary solution has been in force for the last two years.

After the formation of the new government, it is expected that the new excise policy will be finalised in the coming months, which will provide stability to the process of liquor sale and revenue collection.

New Delhi: Fire is raining from the sky in the country’s capital Delhi. The temperature is close to 50 degrees Celsius. People are now groaning due to this terrible heat. Tuesday was the hottest day of the year in Delhi.

Meanwhile, another mountain of trouble is about to fall on the people of Delhi. On one hand, the bodies of the people of Delhi are getting drenched in the scorching heat, while on the other hand, their throats are going to dry up without water. Yes, amidst the scorching heat, there is now a shortage of water in Delhi. If you live in the country’s capital, then you have to use water very wisely, otherwise you may get a big shock.

Delhi’s Water Minister Atishi has warned of challans for wasting or overusing water. She said that one can be fined for washing cars with tap water or allowing water tanks to overflow. Delhiites are getting this warning at a time when the temperature is around 50 degrees. The city is burning with severe heat. Fire is raining from the sky everywhere. The maximum temperature has reached 49.9 degrees Celsius at some places. The entire Delhi-NCR is in the grip of severe heat and heat wave. Due to heat wave, cases of heat stroke are also increasing now.

Also Read: RBI launched a mobile app, government securities can be bought and sold

Delhi government told the reason

Atishi also accused Haryana of not releasing Delhi’s share of water. She said that Haryana is not giving Delhi’s share of water since May 1. Due to this, the Delhi government will implement several measures, including rationalizing the water supply in the national capital. If this issue is not resolved soon, then Delhi will knock the doors of the Supreme Court. Atishi said in a press conference on Tuesday evening that if the supply of Yamuna water to Delhi does not improve in the coming days, then the Delhi government can approach the Supreme Court. According to Atishi, many areas of Delhi are facing water shortage.

So will you be fined now?

This is the reason why the government has appealed to use water properly and efficiently in Delhi. The government has warned that if Delhiites do not pay heed to this appeal and do not use water properly, then they may be fined for excessive use or wastage of water. Atishi has also appealed to people not to wash vehicles with water through pipes. According to her, if people do not pay heed to this public appeal, then the government may have to issue a challan for excessive use of water. Misuse of water is extremely irresponsible. It is also being said that in the places in Delhi where water used to come twice a day, now it will come only once.

Mercury around 50 in Delhi

In fact, like many areas of north-west India, Delhi is also in the grip of severe heat.
