<p>With this the government&#8217;s appeal has been rejected. It has been directed that the amount deducted from the gratuity rate be returned to the respondent.</p>
<p>Allahabad High Court has given a big decision in an important hearing. During the hearing on Friday also, Allahabad High Court said that the deduction of Sixth Pay Commission dues from the gratuity amount is completely illegal. Heard the appeal challenging the order passed by a bench of Justice Salim Kumar Rai and Justice Surendra Singh. Meanwhile, Rural Development was directed by the Single Judge to pay the amount deducted from gratuity to the respondent.</p>
<p>In such a situation, after the order of the Double Bench, the amount deducted will be paid to the Assistant Engineer working in Rural Development. In the case, the petitioner was posted on the post of Assistant Engineer DRDA Chandauli in the pay scale of Rs 8000 to 13500. The petitioner said that on the basis of his services, he was given revised pay scale as per the recommendation of the Sixth Pay Commission. The arrears of salary were also paid to the petitioner as per the accepted rules of implementation of the recommendations of the Sixth Pay Commission.</p>
<p>In this case, a proposal for grant amount was sent to the Commissioner of Rural Development, Uttar Pradesh. Proposals for a grant amount of Rs 44, 56,620 were sent to the state government for payment of outstanding salaries to DRDA employees when implemented as per the Sixth Pay Commission. When this proposal was rejected by the government, the project director was given by the Commissioner of Rural Development to the development agencies in the district village for the payment of employees. Instructions were issued to recover the amount.</p>
<p>After the recovery order was issued by the government, the case was challenged in the court. On which the Allahabad High Court bench, citing the case of Syed Abdul Qadir vs. State of Bihar, said that relief against recovery is given by the court not because of any right of the employees but by exercising judicial discretion to give relief to the employees if the recovery There will be difficulty if an order has been made but if in a given case it is proved that the employees knew that the payment received was more than the amount due or wrong payment was made then in such cases the error can be rectified. Could. In such a case, depending on the circumstances, an order for recovery of the overpaid amount may be issued.</p>
<p>The Court also cited the case of Thomas Daniels vs. State of Kerala. Where the additional amount was not paid to the employees due to any mistake or misrepresentation on the part of the employees but due to an error in the interpretation of the service rules. In such a situation, recovery orders become unjust and arbitrary.</p>
<p>A double bench of the High Court ordered that recovery of 6th Pay Commission dues would be unjust and arbitrary and cannot be allowed. In view of the above rule, the bench rejected the challenged appeal. <p>The state government has amended the Uttar Pradesh Government Servant Rules-2011 to include oxygen concentrator, CPAP and BIPAP in the list of artificial organs.</p>
<p>A total of 21 lakh serving and retired personnel will be benefitted by this. The state government will reimburse Rs 50,000 to Rs 1.20 lakh on the purchase of these equipments. Lung related disease is increasing rapidly due to corona pandemic and air pollution. In such a situation, oxygen concentrator, CPAP and BIPAP machines are required to maintain the level of oxygen in the body.</p>
<p>The committee headed by the Chief Medical Officer (CMO) will consider and dispose of the applications related to reimbursement. Medical consultation and all necessary test reports related to lung disease will have to be attached with the application form. Two respiratory specialist doctors nominated by the CMO will also join the committee. Dr. Ved Prakash, chairman of the Department of Pulmonary and Critical Care Medicine, KGMU, says that people&#8217;s lungs are getting worse due to air pollution, smoking, excessive obesity and corona infection.</p>
<p>The damaged lung has difficulty in maintaining the amount of oxygen in the body as compared to the normal lung. In such a situation, they need oxygen therapy for a long time. In such a situation, one has to buy oxygen concentrator, CPAP and BIPAP machines. For the time being, the reimbursement of money on purchase of these by the government will benefit the serving and retired employees and officers.</p>
<p><strong>Oxygen concentrator will be able to be changed after five years-</strong></p>
<p>Since oxygen concentrator, CPAP and BiPAP machines are life saving devices and they can work well only for five years. In such a situation, the government has given permission to replace these equipments and get new equipments after five years. If the service manager of the company having this equipment fails to repair it and declares it defective, the workers will be able to replace it with a new one.</p>
<p>He will also give an undertaking to the government that he will not claim reimbursement for the purchase of these equipments for five years. He will deposit the same defective oxygen concentrator, CPAP and BiPAP machine with the CMO of his district and the CMO will deposit these defective equipment in the Directorate General of Health.</p>

<p>In fact, from January 1, 2016 to June 30, 2017, the arrears of salary for 18 months were to be paid in 6 equal annual installments. Earlier, an order for payment of the fourth installment was issued on December 1, 2021.</p>
<p>Now before Diwali, the state government has issued an order regarding the payment of the 5th installment of the 7th pay scale arrears. Salary from January 2017 to March 2017 will be paid as the fifth installment. The state government will pay the arrears in 6 installments.</p>
<p>Let us inform that Chhattisgarh State Employees Officers Federation was continuously taking initiative regarding the arrears of the seventh pay scale. Kamal Verma, convenor of Employees Officers Federation, had also corresponded with the state government in this regard, after which the employees are now being paid the fifth installment of arrears amount before Diwali.</p>
<p><strong>Dearness allowance may increase again</strong></p>
<p>Chhattisgarh&#8217;s 3.80 lakh government employees can get another big gift before Diwali. An important cabinet meeting is to be held under the chairmanship of Chief Minister Bhupesh Baghel on October 17, there is a possibility that the dearness allowance may once again increase by 3 to 6 percent in this meeting.</p>

<p>Punjab Education Minister Gurmeet Singh Meet Hair says that the issue is under consideration of the Punjab government. The Chief Minister has already directed the Chief Secretary of the State to look into the possibilities of restoring the old pension. Every promise made by the state government to the people is being fulfilled. Apart from this, the promises which were not fulfilled are also being fulfilled, such as one MLA, one pension etc.</p>
<p>Earlier, Chief Minister Bhagwant Mann had tweeted that the Punjab Government is considering to bring back the Old Pension System (OPS), I have spoken to my Chief Secretary and asked him to study about its implementation.</p>
<p>We are committed to the welfare of our employees. Now on his decision, Delhi CM and AAP supremo Arvind Kejriwal also tweeted that very good! a great decision. All government employees across India want the old pension scheme to be restored.</p>
<p>Let us inform that recently the Hemant Government of Jharkhand has approved the Standard Operating Procedure (SOP) while implementing the old pension scheme. The old pension scheme in the state was discontinued on 1 April 2004 and it was replaced by the National Pension System (NPS). If the old pension is restored in the state, it will be the fourth state after Rajasthan, Chhattisgarh and Jharkhand. Where will the old pension system be.</p>

<p><strong><span>Appointment, Salary/Wage, Casual Labor Leave</span></strong></p>
<ul>
<li><span>1993 Plan (Grant of Temporary Status and Regularization of Casual Labour).</span></li>
<li><span>Additional benefits to casual workers with temporary status (CL-TS) in continuation of the 1993 plan.</span></li>
</ul>
<p><strong><span>Issuing an order on casual labor, it has been said that the rules of their appointment will be different, under which certain conditions have been prescribed:-</span></strong></p>
<ul>
<li><span>Daily wage earners (informal workers) should not be recruited for work of regular nature.</span></li>
<li><span>Daily wage earners can be recruited only for work which is casual or seasonal or intermittent in nature or for work which is not of full time nature for which regular posts cannot be created.</span></li>
<li><span>The work currently being done by the regular employees should be re-evaluated for production and productivity by the respective administrative departments so that the work being done by casual workers can be assigned to the regular employees. Departments may also review staff norms for routine work and take steps to revise them</span></li>
<li><span>Issuing an order, the DOPT said that it has been observed that in spite of strict guidelines on appointment of daily wage laborers vide above mentioned OM, various Ministries/Departments continue to participate in work of regular nature against the policies of the Government. Continuing to hire casual workers.</span></li>
<li><span>Therefore, it is reiterated that all Ministries/Departments should ensure strict compliance of the guidelines on appointment of casual labour. Negligence in implementing these guidelines should be viewed seriously and brought to the notice of appropriate authorities for taking prompt and appropriate action against the defaulters.</span></li>
</ul>
<p><strong><span>Salaries &amp; Wages</span></strong></p>
<ul>
<li><span>Where the nature of work assigned to casual employees and regular employees is similar, temporary employees may be paid at the rate of 1/30th of the minimum relevant scale of pay and dearness allowance for 8 hours per day work . ,</span></li>
<li><span>In cases where the work performed by a casual employee is different from the work performed by a regular employee, the casual employee may be paid only the minimum wages notified by the Ministry of Labor and Employment or State Government/UT Administration</span></li>
<li><span>whichever is higher as per the Minimum Wages Act, 1948, however, if a department is already paying daily wages at a higher rate, this practice may be continued with the approval of its financial advisor.</span></li>
</ul>
<p><strong><span>Leave Rules Amendment</span></strong></p>
<ul>
<li><span>Casual workers may be granted a paid weekly off after six days of continuous work.</span></li>
<li><span>Payment to casual workers can be restricted to only those days on which they actually perform duty under the government, as mentioned above.</span></li>
<li><span>In addition, they will also be paid for a national holiday, if it falls on a working day for casual workers.</span></li>
<li><span>It has also been decided that casual workers working in offices having a five-day week may be granted one day&#8217;s weekly off, provided they have worked for at least 40 hours during the said week.</span></li>
</ul>
<p><strong><span>Benefits</span></strong></p>
<ul>
<li><span>Wages at daily rates with reference to the minimum scale of pay for the concerned regular (erstwhile) Group &#8216;D&#8217; officer including DA and HRA.</span></li>
<li><span>The benefits of increment at the same rate applicable to a (erstwhile) Group &#8216;D&#8217; employee shall be taken into account for computing the pro-rata pay for each one year of service, provided the performance of duty for at least 240 days to be done.</span></li>
<li><span>The entitlement of leave will be on proportionate basis at the rate of one day for every 10 days of work.</span></li>
<li><span>No casual or any other kind of leave will be admissible except maternity leave.</span></li>
<li><span>They will also be allowed to carry forward the leave on their credit on their regularization. They will not be entitled to the benefits of encashment of leave on termination or leaving the service for any reason.</span></li>
<li><span>Women casual laborers were to be allowed maternity leave admissible to regular Group &#8216;D&#8217; (erstwhile) employees.</span></li>
<li><span>50% of the service rendered under temporary status will be counted for the purpose of retirement benefits after regularization.</span></li>
<li><span>After rendering three years of continuous service after grant of temporary position, casual laborers shall be treated at par with temporary (erstwhile) Group &#8216;D&#8217; employees for the purpose of contribution to the General Provident Fund, and shall be eligible for further</span></li>
<li><span>Festival Advance/Flood Advance is granted on the same conditions as are applicable to temporary erstwhile Group &#8216;D&#8217; employees, subject to production of two sureties from the permanent Government servants of their department.</span></li>
<li><span>Unless they are regularised, they will be entitled to productivity linked bonus/ad-hoc bonus, as applicable to casual labour.</span></li>
<li><span>No other benefit was admissible to the temporary workers in temporary status other than those specified above.</span></li>
<li><span>The pay of temporary employees with temporary status on regularization in the same grade for Group &#8216;D&#8217; (erstwhile) (and now Group &#8216;C&#8217;) posts shall be determined taking into account the increments already earned by them in Group &#8216;D&#8217; . (Formerly) (and now Group &#8216;C&#8217;) pay scale which was taken into account for payment of wages while working as casual employee with temporary position.</span></li>
<li><span>Such calculation of previous increments earned on regularization shall be for the purpose of fixation of pay only and they shall not be entitled to claim any other benefit like seniority or promotion etc. on the basis of such casual service.</span></li>
</ul>
<p><strong><span>Salary/Wage as per 7th CPC</span></strong></p>
<ul>
<li><span>As per Government of India notification dated 25th July, 2016 on implementation of the recommendations of 7th Central Pay Commission, casual workers in temporary position will continue to receive their salary as per provisions of casual workers from 01.01.2016.</span></li>
<li><span>Grant of Temporary Status and Regularization) scheme, prepared on the basis of Group &#8216;C&#8217; pay scales as per Level 1 of the Pay Matrix recommended by the Seventh Central Pay Commission and approved by the Government, provided they are matriculated.</span></li>
<li><span>The above benefit of wages is applicable with effect from 01.04.2015 in case of similarly placed non-matriculation pass casual workers with temporary status.</span></li>
<li><span>The extension can be done only after imparting the requisite training on the lines indicated in MoF&#8217;s OM No. 1/1/2008-IC dated 24.12.2008 by the concerned Administrative Ministries/Departments dated 01.01.2016.</span></li>

The employees of Binod Bihari Mahto Koyalanchal University (BBMKU) will get the advance of 7th pay scale (7th pay scale). Apart from this, other allowances have also been increased. This decision was taken in the meeting of the Finance Committee of the University on Tuesday.</p>
<p>According to media reports, in the meeting of the Finance Committee, a conditional decision has been taken to give Rs 1.50 lakh to class III employees and Rs 1 lakh to class IV employees as advance in seventh pay scale (7th pay scale). Under this, this amount will be adjusted in the seventh pay scale (7th pay scale) within the next 2 years, if it does not happen then the employees will have to return this amount.</p>
<p>Under the meeting, a grant of Rs. The Finance Committee has reduced the cost of residential office by 10 thousand rupees.</p>
<p>Earlier, 25 thousand rupees were given by the university every month for the residential office of the Vice Chancellor. Along with this, a contingency fund of Rs 10 thousand will be given for the expenses of the office of the Vice-Chancellor.</p>
<p>Apart from this, the Finance Committee of the University also took many other decisions. 										<content:encoded><![CDATA[<p>Central government employees and pensioners are expected to get double benefits this Diwali. Apart from the announcement of four per cent dearness allowance payable from July 1st, government employees can also be given arrears of 18 months during the corona transition. At present, dearness allowance is being received at the rate of 34 percent.</p>
<p>If there is an increase of 4 per cent, the DA/DR rate will be 38 per cent. For this, the Central Employees Organization is constantly under pressure on the government. The opposition is also attacking the central government regarding inflation. Apart from this, the central government employees have now raised the issue of old pension. In these circumstances, the central government can pacify its employees and pensioners for some time by giving DA / DR and 18 months arrears during the Corona period.</p>
<p><strong>This trend has changed since few years.</strong></p>
<p>Dearness allowance and dearness relief, these have been increasing every year from 1st January and 1st July. However, this trend has changed in the last few years. Now instead of the above date, there is a delay of several months in the release of allowances. The increase in DA which was to be done from July this year has not happened so far.</p>
<p>There is a lot of pressure from the central workers on the government to release the arrears. The Secretary of the National Council of Staff Side Shiv Gopal Mishra has written a letter to the Cabinet Secretary and Chairman of the National Council &#8216;JCM&#8217; in this regard on August 18 itself. According to an official of the Employees Association, a report has been given to the government to issue arrears of DA / DR with effect from January 1, 2020 to July 1, 2020 and January 1, 2021.</p>

<p><strong>Government should prepare the mechanism &#8211; National Council</strong></p>
<p>The Secretary and Members of the National Council of Staff Side are ready to discuss the method of release of arrears. He has asked the government that these arrears must be released. Even though some mechanism can be devised to issue it. In this regard, the employees&#8217; organizations are ready to cooperate with the Central Government.</p>
<p>In his letter to the Cabinet Secretary, the JCM Secretary has referred to a decision given by the Supreme Court in February 2021. In this decision, the Supreme Court had said, due to economic crisis, the salary or pension of the employees can be temporarily stopped. It will have to be given back to the employees when the situation improves. This is the legal right of the workers. They should be paid according to the law.</p>
<p><strong>The government saved 40000 crores like this</strong></p>
<p>The central government had announced in early 2020 that government employees would not get DA/DR and other allowances. JCM member C. Sreekumar said, the Central Government had banned the DA / DR of government employees and pensioners under the guise of Kovid-19. At that time, the central government had saved Rs 40,000 crore by stopping the payment of 11 per cent DA of the workers. Employees organizations had suggested various options to the central government regarding the payment of 18 months arrears of central employees.</p>
<p>These included the one-time payment of arrears. Staff Side Secretary Shiv Gopal Mishra and other members had also told the government about the release of arrears that if it wants to discuss any other way, then the employee organizations are ready for that too. When the Central Government had announced to give DA after the Corona period, it had mentioned that from January 1, 2020 to June 30, 2021, the rate of DA and DR would be considered as 17 percent only.</p>
<p><strong>Allowance given at the rate of 28%</strong></p>
<p>Union Minister Anurag Thakur had said, now dearness allowance will be available at the rate of 28 percent. At that time he did not say anything about the arrears. The meaning of the announcement of the Union Minister was that the rate of increased DA should be assumed to be 28 percent from July 1, 2021. According to this, between June 2021 and July 2021, there was a sudden 11 percent increase in DA, while no increase in DA rates was recorded in the period of one and a half years.</p>
<p>DA / DR was frozen from January 1, 2020 to July 1, 2021. This issue of arrears was raised by the representatives of the employees&#8217; unions in the meeting of the JCM. On behalf of the staff side, the central government was told that it would have to pay the arrears of the workers. It cannot be stopped for long.</p>

Now half day off will be deducted for the employees coming to the late office.</p>
<p><strong>Only two days discount</strong></p>
<p>In fact, despite the instructions, biometric attendance was not being imposed in many departments and offices on time. On this information, the Principal Secretary, Department of General Administration, Dr. B. Rajender has issued a clear instruction.</p>
<p>He said that in special circumstances, the officer-employee who got the prior permission would be allowed to come to the office late for a maximum of two days in a month. If any officer-employee comes to the office after one hour from the scheduled time without permission, then half day&#8217;s leave will be deducted from his casual leave.</p>
<p><strong>This action will also be taken against late coming employees</strong></p>
<p>If any employee comes late to the office repeatedly, then in such a situation the concerned officers will initiate disciplinary action against them. However, in the guidelines issued, it has also been said that in the event of an emergency, any employee or officer can come to the late office for a maximum of two days in a month after taking permission from his superior officer. If you come late without informing then action will be taken directly.</p>

										<content:encoded><![CDATA[<p>In this proposal, the Finance Department has included Administrative Police Service Cadre and other officers who came in the service of the State after 2005, including the Administrative Officer Employees who came in service after 2004. This will be the first time that the officer employees will get the facility of choice filling.</p>
<p>Let us tell you that according to the rules till now, the government used to calculate the money deposited by the employees, but now a new facility is being given to the employees joining NPS. Talking about the figures, so far 16000 crores of employees have been deposited in the National Pension System.</p>
<p>Now employees can change the use of this amount according to their benefit. Under the new facility, the officer employees will choose their amount from among the other five options including SBI, LIC, UTI, HDFC, ICICI. The facility will be given to deposit that amount according to the choice filing of the employees.</p>
<p>Under the National Pension System, 10 percent of the salary of the employees is deducted every month in the form of NPS. Whereas in this 14% amount is mixed by the state government. In such a situation, government officials-employees deposit Rs 10000 every month from their salary as NPS, while 14000 are deposited by the government.</p>
<p>A minimum of 8000 is deducted in the salary of the employees. With this, now NPS officers will have to decide under the new facility where they want to invest their deducted amount.</p>
