ITR Return 2025: What is the last date for filing income tax return, 31 July or 15 September? There is confusion in the minds of people as to when income tax return can be filed without penalty.

The Income Tax Department has extended the last date for filing Income Tax Return (ITR) for the financial year 2024-25 i.e. assessment year 2025-26 from 31 July 2025 to 15 September 2025. This relief is for those taxpayers whose account does not come under the purview of audit, such as employed people, pensioners and NRIs etc. With this announcement, a big question is arising in the minds of the people that can now self-assessment tax also be deposited till 15 September without any penalty?

What is self assessment tax?

Self-Assessment Tax is the amount that remains due after paying TDS, TCS and Advance Tax. It is usually paid at the time of filing ITR and if not paid on time, it attracts interest at the rate of 1% per month under section 234A.

Will interest under 234A not be charged till September 15?

Now 15 September 2025 will be considered as the due date, so if you file ITR by that date. Also pay self-assessment tax, then you will not have to pay interest under section 234A. According to an old Supreme Court decision and CBDT circular, when the deadline for filing ITR is extended, that new date is considered as the due date and interest is not charged under section 234A. That is, as long as ITR and self-assessment tax are deposited by September 15, interest will not be charged. In previous cases, CBDT had taken a different stand a few times, but there is no such clarification in the 2025 circular, so it would be correct to assume that interest will not be charged.

Penalty on advance tax will continue

However, no relief has been given on the penalty related to advance tax. If you do not pay the advance tax on time in the financial year 2024-25, then you will have to pay interest at the rate of 1% monthly under sections 234B and 234C. 234B is applicable when the amount of advance tax is deposited less or not deposited at all.

What if tax is paid after 15th September?

If you filed ITR after September 15, 2025 and paid self-assessment tax after that, then you will have to pay interest under section 234A.

What is the last date to file ITR?

The last date for filing ITR and self-assessment tax will now be 15 September 2025. There will be no penalty under section 234A if the tax is deposited before this. But interest will have to be paid under 234B and 234C for not paying the advance tax.

The post ITR Return 2025: July 31 or September 15?

New Delhi. The time to file Income Tax Return (ITR) is about to come now. The Income Tax Department is soon going to notify online ITR forms for Assessment Year (AY) 2025-26. As soon as the department does this, the process of ITR filing will formally begin.

The Central Board of Direct Taxes (CBDT) is likely to notify ITR forms and launch the e-filing portal in this month itself i.e. April 2025. The last date for filing ITR returns will be July 31, 2025. Last year also the e-filing portal was opened in April itself. After filing the return, now the refund is received within 7 to 20 days.

However, most salaried people start filing ITR only in late May or June. The reason for this is that companies give Form 16 to employees only after May. This form contains details of the total salary and tax deduction (TDS) for the year. The information recorded in it is very useful for filing the correct return. According to the rules, it is mandatory for employers i.e. companies and government departments to issue Form 16 by June 15.

Refund process has become faster

The Income Tax Department has made the refund process much faster. Now usually the refund is transferred to the taxpayers’ account within 7 to 20 days of filing the ITR. To get a quick refund, it is important to verify the ITR on time and ensure that there are no deficiencies in the return. Experts say that taxpayers who file ITR before the deadline of July 31 are more likely to get a refund quickly.

Pre-filled ITR forms

Apart from this, the facility of pre-filled ITR forms is also made available on the portal, which is especially beneficial for salaried and small taxpayers. However, before submitting the ITR form, it is necessary to thoroughly check the information given in it.

The deadline for income tax payers to declare undeclared income from assessment year 2018-19 is 31 August 2024. For assessment year 2018-19 or subsequent years, if your undeclared income is more than Rs 50 lakh, you may receive a Section 148 notice from the Income Tax Department by August 31, 2024.

In India, if your income is above a certain limit and you fall under the tax bracket, then it is necessary for you to file Income Tax Return. If you make any kind of mistake in filing ITR, then the Income Tax Department has full right to send you an IT notice. The Income Tax Department also has the right to re-evaluate your old ITR.

In this regard, the deadline for income tax payers to declare undeclared income from assessment year 2018-19 is 31 August 2024. For assessment year 2018-19 or subsequent years, if your undeclared income is more than Rs 50 lakh, then you may get a notice under section 148 from the Income Tax Department by August 31, 2024.

Also Read: ITR claims stuck: Many refund claims are stuck due to non-linking of PAN-Aadhaar, know all details

These changes have been made in the rules

Let us tell you that earlier the department was given 10 years from the end of the assessment year to initiate such proceedings. Accordingly, the Income Tax Department would have had time till March 31, 2029 for the assessment year 2018-19, but Budget 2024 has reduced the time limit to restart old cases. In such a situation, if the undeclared income is more than Rs 50 lakh in the assessment year 2018-19 or subsequent years, then taxpayers can be sent a notice by the IT Department under Section 148A and 148. If you have also received a notice from the IT department, then know what to do?

Understand what to do if you receive a notice

Verify Notice

If you receive a notice under section 148A, check whether it has been issued within the given time limit or not. Also check whether it has been sent by the local assessing officer or NFAC.

Respond to the notice

Tax payers are given between 7 to 30 days to respond to the notice under section 148A. You must keep this time limit in mind and submit your response on time.

If the notice is incorrect

If you feel that the notice has been issued in a wrong manner, then while replying to the notice, you should attach your necessary documents and submit them and put forth your side. In such a case, you can ask the Income Tax Department to reopen the case.

According to the Income Tax Department, the last date for filing ITR for FY 2022-23 and Assessment Year 2023-24 is 31 July 2023. The department has issued an online form for filing ITR. In such a situation, do not delay ITR filing thinking that there is time till 31st July.

It is important to do this…

Even if you do not come under the tax net, you should still file ITR. Meanwhile, Form-16 is being made available to the salaried class for ITR filing by the institute. In this case, before filing ITR, match the data given in Form-16 and Annual Information Statement (AIS). So that it can be ascertained that the data being given to the Income Tax Department is absolutely accurate.

Form-16 mentions the details of income as well as deductions for which taxpayers can claim. The employee has to check the details mentioned in Form-16. He has to see whether it matches the amount earned or not. There should be no difference between the details given in the tax return and AIS, otherwise the taxpayer may get a notice.

Let us tell you, Finance Minister Nirmala Sitharaman, while presenting the budget for the year 2023, gave relief to the tax payers under the new tax regime. However, no change was made in the old tax regime on the part of the government.

Income Tax Refund: If you also file Income Tax Return (ITR) then there is good news for you. Now you will be issued a return by the Income Tax Department within 16 days.

Central Board of Direct Taxes (CBDT) Chairman Nitin Gupta has said that there has been a significant reduction in the average time taken to refund taxes. In the last financial year 2022-23, in 80 percent cases ‘refunds’ were issued in the first 30 days of filing returns.

Returns will come in just 16 days

The CBDT chief also said that the use of technology has speeded up the income tax return process and is working to ensure ‘ease of doing business’ for taxpayers by promoting voluntary compliance. Gupta has said that we have speeded up the process of returns and tax refunds are being processed at a faster rate. In the financial year 2022-23, the average time taken for tax refund was only 16 days, which was 26 days in 2021-22.

Income Tax Department gave information

In the online ‘Samvad’ session organized by the Income Tax Department on Thursday, Gupta has said that there has been a significant increase in the matter of completing the process within a day of filing ITR. This assessment has increased from 21 percent in the year 2021-22 to 42 percent in 2022-23.

22.94 lakh returns were settled

Referring to the use of technology, he said that the department disposed of the maximum number of 22.94 lakh returns in a single day on July 28, 2022. To facilitate voluntary compliance and reduce legal disputes, the CBDT chief said that provision has been made to file an updated return (ITR-U) on the e-filing portal so that the taxpayer can file it within two years after the end of the relevant assessment year. Update your return at any time.

24.50 lakh claims settled till March 31.

He has said that till March 31, 2023, more than 24.50 lakh updated returns have been filed and about Rs 2,480 crore has been collected as additional tax. Gupta also said that in the last financial year, more than four lakh assessments have been completed without the officer and the taxpayer coming face to face.

There has been a 60 percent reduction in complaints related to the ‘faceless’ process in 2022-23 as compared to the previous financial year. Gupta said that under the ‘faceless’ system, tax officials have disposed of more than one lakh appeals.

The post Income Tax Order!

The time to file income tax return is fast approaching. In such a situation, many questions will be coming in the mind of taxpayers that which tax system they should choose. On one hand, in the old tax system, where there is a provision of many exemptions. On the other hand, the Finance Ministry has made many changes giving relief to individual taxpayers. For example, no tax has to be paid up to Rs 7 lakh. Apart from this, some benefits will be seen in the new tax regime.

Today we are going to tell you 4 advantages of the new tax system, about which many people will not be aware. Keeping these things in mind, you can choose any one tax regime before filing the tax return. So let’s know about the four major changes in the new tax regime.

New tax slab

The government wants more and more people to shift to the new tax regime. That’s why changes have also been made in the tax slab in the new tax regime. There are 6 tax slabs in the new regime. In this, no tax has to be paid on income up to Rs 3 lakh. After this, 5 percent tax is being increased on every increase of Rs 3 lakh.

Standard Deduction

Earlier, standard deduction was available only to people in the old tax regime. Now those opting for the new tax system will also get its benefit. Taxpayers will get standard deduction of 50,000. This means that apart from Rs 3 lakh and up to Rs 50,000, exemption will be given without any documents. Pensioners can also claim standard deduction of up to Rs 15,000.

Discount limit increased

In the new tax regime, the basic exemption limit has been increased to Rs 3 lakh. It was earlier Rs 2.50 lakh. That is, people earning up to Rs 3 lakh have been freed from the worry of paying tax. In the old tax regime, this exemption is only up to Rs 2.50 lakh.

Tax exemption up to 7 lakhs

Although in the new tax regime, income up to 3 lakhs has been excluded from the tax slab, but even if a person’s income is not reaching Rs 7 lakhs, he will not have to pay any tax. Not only this, if standard deduction is also added, then income up to Rs 7.50 lakh has been made tax-free. However, on earning more than this, tax will have to be paid as per the tax slab. For example, no tax up to Rs 7.5 lakhs, but after 7.5 lakhs, the calculation of tax will start from the slab after 3 lakhs.

Many changes have been made in the budget 2023 regarding income tax. The biggest thing is that now the new tax regime is the default tax regime.

In such a situation, now you have to tell your employer in advance that you would like to file tax in any regime. If you do not choose any tax regime yourself, then your ITR will automatically be filed in the new tax regime. Apart from this, the tax slab of the new tax regime has also been changed.

Now there are only six slabs in the new tax regime. Currently the highest tax rate in India is 30% and surcharge and education cess are also levied on it. These tax slabs decide who will pay how much tax on how much income. Let us see who will have to pay maximum tax in the old and new tax regime.

Who will have to pay maximum tax under the old tax regime?

In the old tax regime, the highest tax rate is for those earning above 10 lakhs. If your income is above 10 lakhs and you choose old tax regime, then you will have to pay tax at the rate of 30%. In the old tax regime, all such individual taxpayers in the age group of 60 years to 80 years come under 30%, whose income is above 10 lakhs.

Who will have to pay more tax in the new tax regime?

The highest rate in the new tax regime is also 30%. But this tax rate is for those above 15 lakhs. That is, if your annual income is above 15 lakhs, then 30% of your income will be taxed. In the old tax regime, where people above 10 lakhs pay more than 30% tax, in the new regime, 10% tax is levied on those above 10 lakhs to 12 lakhs, and 20% on the income from 12 lakhs to 15 lakhs. Taxes apply.

How much will be the surcharge?

Surcharge is a separate charge on income tax, a surcharge is levied on the income which is calculated according to the tax rate.

However, since the tax filing season has just begun, you still have plenty of time. Still, the sooner you get done with tax filing, the better, because filing tax returns in India requires some preparation.

What are FY and AY?

The return you are currently filing is for income earned in the financial year 2022-23, i.e. for income earned between April 1, 2022 and March 31, 2023, you will file the return. The assessment year is the review year for FY 2022-23, where you will file your returns and declare your investments for tax assessment. For income earned during the financial year (here FY 2022-23), the assessment year will be the immediately following year, i.e. 1st April 2023 to 31st March 2024. Therefore, the assessment year will be the assessment year 2023-24.3

If you have not filed Income Tax Return, then do it soon. Its last date is July 31, 2022. Many people are waiting for the Income Tax Department to extend the deadline. So far this has not been indicated by the department. If the Income Tax Department does not extend the deadline, then you may suffer a loss.

If you do not file income tax return by 31st July this year, then you can do so by 31st December this year. For this, you will have to pay interest on penalty and tax. This is called a belated return. Tax experts say that taxpayers should avoid filing belated returns.

For filing the billed return, you will have to pay a penalty of Rs 5000. If the annual income is less than Rs 500000 then the penalty will be Rs 1000. This late fee is levied under section 324F of the Income Tax Act, 1961. You have to pay this late fee before filing the belated return.

One of the disadvantages of filing a belated return is that you will not be able to carry forward certain types of losses. This includes income from other sources, income from capital gains, income from business and profession.

Second, if your income tax refund is made, this money will hang. The refund money will be credited to your account only after you have filed and verified your belated return. Interest is available at the rate of 0.50 per cent every month on the income tax refund amount. There is no interest on your refund amount if you file a belated return.

Apart from the penalty of Rs 5000, you will also have to pay interest on the tax amount. This will be 1% of the tax amount per month. In this way, the disadvantages of filing belated returns are more, the advantages are less.

It is also important to know that if you have not filed the belated return by December 31 this year, then you cannot file the income tax return until the tax department sends you a notice.

Income Tax Department has tweeted from its Twitter handle. It said that till July 28, 4.09 crore income tax returns have been filed. More than 36 lakh returns were filed only on July 28. The Income Tax Department is also sending reminders for return filing to taxpayers through SMS and email.

ITR Refund: The time to file income tax return is now over. The government had fixed July 31 as the deadline for filing income tax returns. In such a situation, now the return is being scrutinized by the Income Tax Department and the refund of the taxpayers whose TDS has been deducted, is being given by the department.

Many taxpayers would have got the refund, but there would be such taxpayers who would have got a notice from the Income Tax Department instead of the refund. This happens when the calculation of income and tax is done wrong.

Department is investigating through AI

This time the Income Tax Department is scrutinizing the returns through a software based on Artificial Intelligence. On the basis of this notice is being given to the taxpayer. If multiple claims are made simultaneously under different sections of the Income Tax Act, a notice can be obtained. In this case, the taxpayer has to verify and revise the ITR.

Why do I get notice from Income Tax?

Tax exemption can be availed on various expenses under Section 80G of the Income Tax Act. Small businessmen or taxpayers claiming exemption under this section are getting more notice. Charitable funds, charitable funds, relief funds come under this purview.

In such a situation, be it salary class or business class, if the calculation of tax and income is wrong, then a notice can be received from the Income Tax Department. If found guilty, a fine of up to 200 percent can be imposed as an action.

What to do when you get a notice

If you have also received a notice from the Income Tax Department, then first of all collect the documents shown in the investment. On the basis of these documents, revise the ITR filing within 15 days from the date of receipt of the notice.

If there are salaried employees, that should match the deduction shown in Form 16. Reconcile all the deductions given in your ITR in Form 26AS. The amount of TDS should be same in Form 16 and Form 26AS. If you see any discrepancy in the form, ask your company to rectify it.

The post ITR Refund Notice: Notice has been received from IT for claiming refund, so do this work to avoid it, know details here first appeared on Rightsofemployees.com.

Updated Income Tax Return: The Income Tax Department has given an opportunity to the taxpayers to file updated returns for the financial years 2019-20 and 2020-21. Updated returns were announced in Budget 2022.

If you come under the tax net, then it is good to file income tax return on time. It saves you from many problems. If you have not filed returns for the financial years 2019-20 and 2020-21 due to any reason, then there is good news for you. Such taxpayers can file the return again. The Income Tax Department (CBDT) has notified the updated return i.e. ITR-U. Keeping in mind the troubles of the taxpayers, Finance Minister Nirmala Sitharaman announced the updated return while presenting the Budget 2020.

What Happens in Updated Return (ITR-U)?

Finance Minister Nirmala Sitharaman had announced the updated return under section 139(8A) of the Income Tax Act in the Finance Act 2022. Under this, an updated return (ITR-U) can be filed for any financial year within the next 24 months. It has been implemented from the financial year 2019-20. If a taxpayer has not filed original return, belated return or amended return, he can also file ITR-U.

When is there a chance to file an updated return?

According to the rules, the assessment year for the financial year 2019-20 is ending on 31 March 2021. There is a chance for them to file updated returns by March 31, 2023. Similarly, the assessment year deadline for the financial year 2020-21 ended on March 31, 2022. Such taxpayers have a chance to file updated returns by March 31, 2024.

Reason for updated return also to be given

If a taxpayer wants to file an updated return, he has to give the reason for it. Eight types of reasons are mentioned here. For these reasons, options like non-filing of returns, not giving correct information of income have been given. In addition, the taxpayer has to select the appropriate form for himself in the various forms of income tax return.

Additional tax will have to be paid up to 50% Penalty will have to be paid on filing the updated return. If ITR-U is filed within 12 months from the end of the assessment year, then 25% additional tax will be levied. If the updated return is filed after 12 months and within 24 months, then 50 per cent additional tax will be levied. This return cannot be filed unless you have some additional tax liability.

The post Updated ITR Filing: You will get a chance to file two years old tax, know what are the rules and deadline? first appeared on Rightsofemployees.com.
