A new scheme has been approved in the state cabinet meeting held on Tuesday under the chairmanship of Chief Minister Nitish Kumar, under which women employees of the state will be given the facility of house near their office.

Who will be the beneficiaries of the scheme?

The benefits of this scheme will be available to women teachers, women police personnel, all women employees working in Panchayat to Secretariat. This means that any woman who is working in a government department and faces problems due to the distance in commuting to the office every day, this scheme can prove to be a boon for her.

How to get housing?

For this, the state government will form a five-member committee in every district, which will be headed by the District Magistrate (DM). This committee will identify private houses and lease agreements will be made with the house owners as per the requirement. These houses will be selected in such a way that they are close to the workplace of women employees. If any woman employee faces any problem regarding housing, then it will be resolved by the SDO of the sub-division level.

How many women will benefit?

According to government data, about 3.5 to 4 lakh women employees are working in government departments in the state. This scheme has been prepared keeping all these women in mind, so that they can get safe and convenient housing.

Other major decisions of the cabinet

The state cabinet has given the green signal not only to the Mahila Awas Yojna but also to many other important proposals. 8093 lower division clerks and 8414 new job opportunities have been approved in more than 8000 panchayats. A mega skill center will be set up in the state at a cost of Rs 281 crore to train 21600 youth. 36 new posts have been sanctioned for setting up a sports injury unit at the Jayaprakash Narayan Orthopedic Hospital in Patna, along with the creation of 267 other posts for the hospital. This initiative to provide housing facilities to women employees is a strong step towards safety, convenience and self-reliance.

Under the Model Tenancy Act, 2021, no landlord can suddenly increase the rent, for this the landlord will have to give notice to the tenants three months in advance. Also, the rent is negotiated between the tenant and the landlord before entering into the rental agreement. After this, the landlord cannot charge more than the rent mentioned in the rent agreement.

Advance security money

No landlord can collect more than two months advance from his tenant. Additionally, when the tenant vacates the house, the landlord has to return this amount within a month.

Not able to pay rent on time

If for some reason the tenant is not able to pay the rent of his house, then the landlord has no right to deprive the tenant of the facility of electricity and water. In fact, the Supreme Court has said that electricity and water facility is a basic facility.

No right to enter the house without permission

A rented house belongs to the landlord, but this does not mean that he can enter the house without the tenant’s consent. In the absence of the tenant, the landlord cannot enter the house or search the house.

House cannot be vacated without solid reason

The landlord has to give a notice to his tenant before vacating the house. Without any information, the landlord cannot suddenly ask the tenant to vacate the house. If suddenly he has to do this, then a solid reason will also have to be given.

It is not the tenant’s responsibility to repair the house.

If the rented house needs painting or any repairs, it is the responsibility of the landlord. He cannot ask his tenant for this. If he asks the tenant for any kind of repair, he has to pay the amount.

No conditions can be placed after the agreement is made

Whatever conditions the landlord has, they have to be stated at the time of making the agreement. Once the agreement is ready, no conditions can be imposed thereafter.

Landlord’s rights

• Model Rent Act, 2021 Provisions have been made to protect the rights of the tenants as well as the landlord.
• If a tenant has not paid the house rent for the last 2 months, then in such a situation the landlord can get his house vacated.
• If the tenant is doing any kind of illegal or commercial work in the house without informing the landlord, then in such a situation the landlord can ask the tenants to vacate the house.
• In any circumstances, the landlord has to give a notice period of 15 days to evict the tenant from the house.
• The landlord has every right to collect the rent on time, doing so is not a crime. Also, if the landlord feels that the tenants are negligent in maintaining the house, then in such a situation the landlord can stop them, but can also repeatedly complain against the tenant’s negligence.
• If the tenant is thinking of vacating the house on his own will, he has to inform his landlord about it one month in advance.

What to do if the law is violated

If the landlord or tenant violates any law under the Model Rent Act, 2021, they can approach the rent authority to complain against it.

Although this law is of the Center and many states have not implemented it, each state may have its own laws, which are not much different from the laws made by the Center.

Registered Rent Agreement or Notarized Which one is better :-

Notarized Rent Agreement

Notarized agreement is a rent agreement printed on a stamp paper signed by a public notary. In India, notaries public are mainly lawyers and advocates. In case of notarized agreement, the notary attests the identity and documents of both the parties.

Both the parties (owner as well as tenant) will have to appear before a notary for this process. A notarized agreement is much simpler than a registered agreement as it can be done by simply visiting a lawyer’s office, and does not require paying any stamp duty and registration charges.

Only one fee is charged by the lawyer for the notary which usually ranges from Rs.200 to Rs.500 according to the locality. However, it is to be noted that in case of any legal proceedings, the notarized agreement is not admissible in the court, as it does not validate the rental transaction.

Registered rent agreement

Rental agreement may be oral, written or implied. However, the written agreement states the terms and conditions agreed upon by both the parties and serves as proof in case of disagreement.

Registered Rent Agreement is a rent agreement printed on a stamp paper and registered with the sub registrar of the area. Some cities/states offer the facility of online registration of such documents.

Another important advantage of getting the rental agreement registered is that it acts as a legal proof and protects the landlord from any legal disputes in future. If the rent agreement is not registered, then the provisions of Rent Control Act of Central Government as well as various State Governments are not applicable.

If the tenant has to give the property for more than 11 months, then all the properties have to be registered. Registration is not required in the agreement of less than 11 months.
