<p>The Calcutta High Court has given an important decision and set the limits of the powers of the traffic police. The court has made it clear that the traffic police can confiscate the driving license, but it has no right to suspend or cancel it.</p>
<h3><strong>What is the whole case?</strong></h3>
<p>This case is related to a person named Shri Panda, who filed a petition in the court alleging that a traffic police sergeant confiscated his driving license and also fined him ₹ 1,000 without any valid reason. The petitioner claimed that this entire action was in violation of Section 206 of the Motor Vehicles Act, which clarifies the process of license confiscation.</p>
<h3><strong>What did the High Court say?</strong></h3>
<p>While hearing the case on July 24, 2025, a single bench of Justice Parthasarathi Chatterjee clarified:</p>
<p>Limits of seizure – Police can only temporarily seize the license, but it will be mandatory to send it to the court or RTO.</p>
<p>Power to suspend or cancel – This power is only with the licensing authority (RTO), not the police.<br />
Written reasons required – Police will have to give a solid reason in writing before seizing the license or issuing a challan.</p>
<p>Acknowledgement mandatory – If the license is seized, the police will have to give a temporary acknowledgement under section 206 (3).</p>
<h3><strong>The High Court has directed the administration</strong></h3>
<p>to send a copy of its decision to the state Home Department and the Director General of Police so that the traffic police can be trained and such arbitrariness can be stopped in future.</p>
<h3><strong>Why is this decision important for drivers?</strong></h3>
<p>This decision will not only help in stopping the increasing arbitrariness and illegal recovery of the traffic police, but it will also give confidence to the citizens that their rights are protected.<br />

										<content:encoded><![CDATA[<p><strong>Driving License: Bihar Traffic Police has recommended cancellation or suspension of driving licenses (DL) of about 10,000 people who have violated traffic rules more than three times. An official gave this information on Monday.</strong></p>
<p>Additional Director General (ADG) of Bihar Police (Traffic) Sudhanshu Kumar told reporters on Monday, &#8220;Driving license will be cancelled or suspended for repeated violation of traffic rules (more than three times). The traffic police has recommended cancellation or suspension of driving licenses of about 10,000 people who have violated traffic rules more than three times in various districts of the state.&#8221; He said that the recommendations have been sent to the concerned officials in the districts. The official said, &#8220;If someone violates more than three times, his driving license will be suspended and if even after that the driver is found violating the rules, his driving license will be cancelled.&#8221;</p>
<p>The ADG said that action will be taken to cancel the license of a person who receives more than three consecutive challans for offenses like jumping red light, overspeeding, overloading, using mobile phone while driving. The officer said, &#8220;From January 26, all 54 traffic check posts in Patna will be controlled by women police personnel. These check posts will be controlled by more than 310 women police personnel including officers.&#8221;</p>

										<content:encoded><![CDATA[<h3><strong>The month of November is being celebrated as &#8216;Road Safety Month&#8217; by the traffic police, regarding which various awareness programs are being conducted in Noida and Greater Noida.</strong></h3>
<p>Awareness programs were organized at Okhla Bird Century Metro Station, Sector 94, Kalindi Kunj and other prominent places on Thursday. Additional speed-controlled drives are also being planned on the Noida Expressway connecting Noida and Greater Noida.</p>
<p>The traffic police issued 150 e-challans within 8 hours from 6:30 am on Thursday while cracking down on speeding vehicles on the Yamuna Expressway. In view of the winter season, security has been increased on this 165.5 km long expressway from Greater Noida to Agra.</p>
<p>Currently, the speed limit on the Yamuna Expressway is 100 km per hour for light vehicles and 80 km per hour for heavy vehicles. This system is implemented due to the lack of visibility in winter.</p>
<h3><strong>If you drive too fast, you will be fined</strong></h3>
<p>Rs 2,000 on light vehicles and Rs 4,000 on heavy vehicles for violating the speed limit. To ensure safe winter travel, the speed limit may be reduced further between December 15 and February 15, with the speed set to 75 kmph for light vehicles and 60 kmph for heavy vehicles.</p>

										<content:encoded><![CDATA[<h3><strong>Traffic Diversion: Delhi Traffic Department has closed the road due to the construction work of Metro Tunnel. This road will remain closed for general traffic for 45 days. A new route has been decided for commuters on this route.</strong></h3>
<p>New Delhi. To get rid of traffic jams in the capital Delhi, roads, metro and flyovers are being continuously improved. In this sequence, a new metro line is being developed. Therefore, traffic on the road is being stopped for the construction of the metro line. As per the advisory issued by the traffic department, this road is being closed for the next 45 days. The traffic police has said that this road has been closed till November 18.</p>
<p>According to the traffic advisory, Roshanara Road in North Delhi has been closed from October to 18 November. Delhi Metro work is going on near this road and the twin tunnel of the metro will be built by closing the road. Delhi Traffic Police issued an advisory stating that the road on both sides is being closed from Roshanara Road to Pulbangash Metro Station. Metro construction work will be done during this time.</p>
<h3><strong>What is the new divert route?</strong></h3>
<p>According to the advisory issued by the traffic police, after closing this road, a new route has been made for buses and heavy vehicles. Under this, vehicles going from ISBT to Shakti Nagar via Roshanara Road will have to go to Shakti Nagar Chowk via Shamnath Marg, Civil Lines, Mall Road via Khalsa College. Similarly, vehicles coming from the other side will also have to follow the same route.</p>
<h3><strong>Second route for light vehicles</strong></h3>
<p>The traffic department has decided a second route for light vehicles like cars and bikes. Such vehicles will reach Parshuram underpass via Barfkhana Chowk via Lala Jagannath Marg, Chowk Tower and Chaudhary Nandlal Marg via Dinanath Marg and from there will go to Shaktinagar Chowk. Vehicles coming in the opposite direction will also have to follow the same route.</p>
<h3><strong>Using the metro is better.</strong></h3>
<p>The traffic police has issued advisories for people and diverted the routes and has also appealed to use public transport. The traffic police says that to avoid traffic jams and problems, use transport options like the metro. This will not only help you avoid getting stuck in traffic jams, but using the metro will also be convenient.</p>

<h3><strong>No right to take out the keys</strong></h3>
<p>Under the Indian Motor Vehicle Act 1932, only an ASI level officer can issue a challan for traffic violation. ASI, SI, Inspector have the right to impose spot fines. Traffic constables are there only to assist them. They do not have the right to take away anyone&#8217;s vehicle keys. Not only this, they cannot even deflate your vehicle&#8217;s tyres. They cannot talk to you in a wrong way or misbehave with you. If a traffic policeman is harassing you without any reason, then you can also take action against him.</p>
<h3><strong>You should also keep these things in mind</strong></h3>
<p>To issue a challan, the traffic police must have a challan book or an e-challan machine. If they do not have any of these two, then your challan cannot be issued. It is also necessary for the traffic police to be in uniform. The uniform must have the buckle number and the name. In case of not wearing a uniform, the policeman may be asked to show his identity card.</p>
<p>The head constable of the traffic police can fine you only Rs 100. Only a traffic officer i.e. ASI or SI can impose a fine higher than this. This means they can issue a challan of more than Rs 100. If a traffic constable takes out the keys of your vehicle, then make a video of that incident. You can go to the police station of that area and show this video to a senior officer and complain about him.</p>
<p>While driving, you should have the original copy of your driving license and pollution under control certificate. Photocopy of vehicle registration and insurance will also do. If you do not have money on the spot, you can pay the fine later. In such a situation, the court issues a challan, which will have to be paid in the court. During this time, the traffic officer can keep your driving license with him.</p>

<p>To ensure smooth flow of traffic at night in Gurugram, Deputy Commissioner of Police (DCP) Traffic, Gurugram has reportedly issued instructions to traffic police personnel not to stop any vehicle at night and also not to issue challans. According to a report by news agency ANI, in a letter issued by DCP Traffic Virender Vij, traffic police personnel have been strictly prohibited from stopping any vehicle at night.</p>
<p>The move apparently comes following complaints from commuters about the large-scale random checking of vehicles being carried out by traffic police personnel across Gurugram. However, it is unclear how traffic officials are now expected to check and prevent cases of traffic violations, which range from speeding and signal jumping to drunk driving.</p>
<p>According to ANI, the new instructions are clearly stated in a letter from DCP Traffic Virender Vij dated May 28. “Traffic inspectors are ordered to order all the staff posted in their jurisdiction that no vehicle should be stopped at night and no challan should be issued,” the letter reads. “If it is very necessary to issue a challan to the driver as per the Motor Vehicles Act, then in that case the challan of that vehicle should be issued as per the rules only after bringing it to the notice of the concerned gazetted officer/signatory and obtaining permission.”</p>

<p>The letter also states that if any traffic policeman fails to follow the instructions, he will have to face action. “The orders should be strictly followed. In case of negligence and laxity, strict departmental action will be taken against the concerned traffic police officer as per rules with immediate effect.”</p>
<p>The letter also underlines the need to implement these new instructions. “It has come to the notice of the above that the traffic policemen deployed at night are harassing the common people by unnecessarily stopping their vehicles and also issuing challans to vehicles without any reason.”</p>
<p>Instead, traffic police officials have been instructed to play a role that ensures smooth flow of vehicles. “Traffic personnel deployed at night should play a vital role as Gurugram Traffic Police by guiding and helping the common people and drivers and arranging safe passage for them to their destination and in case of a road accident, the injured should be immediately admitted to the nearest trauma centre and the accident vehicles should be immediately removed from the main road and traffic should be allowed to move smoothly.”</p>

<p><strong>Do not drive on footpaths and cycle tracks</strong></p>
<p>In metro cities like Delhi, traffic jams are common. In such a situation, many drivers violate traffic rules and drive their vehicles on footpaths or cycle tracks. By doing this, a person violates rule 39(3)MVDR/177A of the Motor Vehicle Act (MVA). After which a Court Challan is issued by the traffic police.</p>
<p><strong>Violation of Stop Sign</strong></p>
<p>Zebra crossing and stop sign are made near the red light on the roads. Usually STOP is written in English. But many drivers violate this rule near the red light. This is a violation under section 184 of the Motor Vehicle Act and a Court Challan can be issued by the Traffic Police.</p>
<p><strong>Court challan even under 18 years of age</strong></p>
<p>If a crime is committed on the road by a person below 18 years of age, i.e. a juvenile, then the traffic police takes action under Motor Vehicle Act 199A and issues a court challan.</p>

<p><strong>Driving old vehicles</strong></p>
<p>If any person is found driving a diesel vehicle older than 10 years and a petrol vehicle older than 15 years on the road, then it is a violation under 39/192/207 MVA. In such a case, the traffic police issues a court challan.</p>
<p><strong>On jumping the red light</strong></p>
<p>If any vehicle ignores traffic rules and jumps a red light, then the police can issue a court challan for violating 184 MVA. The traffic police also issues a court challan under 184 MVA in case of wrongly overtaking vehicles.</p>
<p><strong>Dangerous and wrong driving</strong></p>
<p>If any person is found driving dangerously on the road or driving in the wrong direction, then he is found guilty of violating 184 MVA. After which the traffic police can issue a court challan.</p>
<p><strong>Do not drink alcohol and drive</strong></p>
<p>While advising on safe driving, the police informs that one should never drive after drinking alcohol. But if a person is found doing so, it is a violation of 185 MVA. After which a court challan can be filed by the police.</p>

<p><strong>Now 2000 rupees invoice</strong></p>
<p>The Government of India has made changes in the 1998 Motor Vehicles Act. In which an immediate fine of up to Rs 2,000 will be imposed on two-wheeler riders for not wearing helmets or not wearing helmets properly. That is, if the bike rider is wearing a helmet, but it is open, then a fine of Rs 1,000 will be imposed on it. Even if you are wearing a helmet and have not worn the head strap tightly, you will be fined Rs 1,000. Overall, the helmet now has to be worn completely properly. If this does not happen, then you will have an invoice of Rs 2000.</p>
<p><strong>Must have ISI mark on the helmet</strong></p>
<p>If the helmet does not have BSI (Bureau of Indian Standards ISI) mark, you can be fined 1,000. That is, you have to wear only ISI marked helmet while driving bike-scooter. If this does not happen, then under Section 194D MVA of the Motor Vehicle Act, you will be fined Rs 1,000. However, the Delhi Police is currently challaning people for Rs 1000.</p>

<p>According to Police Commissioner Laxmi Singh, such vehicle owners who have bought old vehicles will have to update the registration of the vehicle. If a vehicle owner is caught without updated registration, then the vehicles can be confiscated.</p>
<p>The Gautam Buddh Nagar Police is all set to launch a drive for random checking and verification of documents of vehicles owned by more than one person. Police teams in all three zones Noida, Central Noida and Greater Noida will soon start checking such old vehicles and will impound them if their ownership and registration documents are not updated.</p>
<p>Police has no idea about the car Police has started this initiative after a hit and run case in Greater Noida on New Year&#8217;s Day, in which three B.Tech students were hit by a speeding car. One of these students, Sweety Kumar, was seriously injured and had to undergo surgery. It was a completely plain case, in which even after more than 15 days, the police could not arrest any of the accused. The police commissioner said, “It was a blind case, with almost no leads. <p>The yatra will take rest at Ashram Chowk in the national capital at 11 am and then resume at 1 pm. Traffic is expected to be disrupted in many parts of central Delhi when the yatra will proceed towards Red Fort via Mathura Road, India Gate and ITO.</p>
<p><strong>Pedestrians will be traveling in large numbers</strong></p>
<p>It has been said in the advisory that the yatra will reach Jaidev Ashram near Ashram Chowk at around 10.30 am and end at Red Fort at around 4.30 pm. A large number of pedestrians and vehicles are expected to participate in the yatra at different stretches on this route.</p>
