According to the Indian Motor Vehicles Act 1932, only a traffic police personnel above the rank of an assistant sub-inspector can impose fines for violating traffic rules. The traffic policeman can impose fine on you only if he has a challan book or e-challan machine. Without any of these things, he cannot fine you. The traffic police should be wearing a uniform bearing their name badge. If the traffic police is in civil dress then you can also ask them to show their ID card. The thing to keep in mind is that the head constable of the traffic police can impose a fine of just Rs 100 on anyone. Only an ASI or SI rank policeman can impose a fine of more than Rs.100.

If a traffic policeman does this, then you can record this incident. By recording, you can complain about this to the senior officer in the nearest police station. Keep in mind that you must have your driving license and pollution control certificate while driving. Apart from this, you should also have a copy of your car’s registration and insurance papers. You can also use the digital format of these papers.
