It was recommended by the Second National Judicial Pay Commission that the salaries of judicial officers should be increased and should be implemented soon. Considering a petition filed by the All India Judges Association, the Supreme Court, while giving its verdict, said on 27 July 2022 that judicial officers do not come under any commission constituted by the government, due to which their pay scale should be increased.

The petition was filed by the Central and State Government

After the direction of the apex court, a review petition was filed by the Center and some states, regarding which the Supreme Court has dismissed the petition and upheld its order of 27 July 2022. A division bench of CJI DY Chandrachud, Justice Krishna Murari and Justice Hima Kohli said that no error is apparent before the record. In such a situation, the salary of judicial officers should be increased under the recommendation of the commission.

Apex court also ordered to pay the dues

The Supreme Court while directing the Central and State Governments said that the officers will have to pay the dues in three instalments. 23 percent in the first installment, then 23 percent after three months and the entire balance will have to be paid by June 2023.

Constitution of judicial officers for review

It may be noted that the second highest National Judicial Pay Commission was constituted in 2017 to review the pay scale and other conditions of judicial officers related to subordinate judiciary across the country. For which a bench of Justices J Chelameswar and Abdul Nazeer appointed former Supreme Court judge Justice PV Reddy as commission chairman and former Kerala High Court judge and senior Supreme Court lawyer R.K. Basant was made a member.
