Big news for employees, this order issued regarding reservation in promotion, will get such benefits

The Yogi government of Uttar Pradesh (UP Employee) has given great relief to the differently-abled employees. The state government has issued detailed guidelines regarding increasing the reservation of disabled employees in promotion from 3% to 4%. Under this, promotion of any employee cannot be stopped on the ground of disability. Additional Chief Secretary, Personnel has issued an order in this regard.

According to media reports, the calculation of reservation in promotion will be based on the total number of vacant posts in the establishment. Promotion of handicapped employees will be done only on the posts earmarked for them.

If any department exempts any establishment from the provision of reservation for employees on the basis of the nature of work, then the matter will be sent to Chief Minister Yogi Adityanath through the Department of Divyang Welfare. After this, it will be considered by the Chief Minister. The data related to promotion of Divyangjan in each department will be prepared like direct recruitment and then will be sent to the Department of Empowerment of Persons with Disabilities.

As per the order of the UP government…

  • If an employee becomes disabled while in service or is unable to discharge his responsibility, he will be shifted to another post in the same pay scale and services.
  • Neither he shall be removed from service nor shall he be reduced to any rank.
  • In the absence of adjustment in any other post, he will be kept in a supernumerary post until a suitable post becomes available to him or he retires.
  • If such disabled employees become eligible for promotion to higher pay scale and it is not possible to be adjusted against any other post, then supernumerary post of next level will be created for them.
  • The supernumerary post of the previous level in which he is posted will be dedicated to him.
  • If the employee is disabled before joining the service, then he will be entitled to get the benefit of this reservation. Provided the level of disability is 40% or more.
  • For this, 4% vacancies in promotions from Group D to C, Group C to B and Group B to A will be reserved for Persons with Disabilities.
  • According to this, the share of direct recruitment to the lowest rank posts in Group ‘D’ to ‘C’ and Group ‘C’ to ‘B’ and Group ‘B’ to ‘A’ should not exceed 75 per cent.
  • Four per cent vacancies will be reserved for them, out of which one per cent each will be reserved for ‘A’, ‘B’ and ‘C’. Group ‘D’ and ‘D’ will be given one percent profit.
  • These posts will be for blindness, low vision, deaf hearing loss, cerebral palsy, treatment, leprosy, dwarfism, acid attack victims and locomotor disability including muscular dystrophy.
  • Person with disability cannot be denied promotion merely on the ground that no vacancy is marked for his/her category.
