The Central Government has made important changes in the rules related to family pension. The government has allowed women employees to nominate their son or daughter for family pension instead of their husband. Earlier, women employees did not get this facility.

Earlier, family pension was given to the spouse of the deceased government employee or pensioner while other family members became eligible only after the ineligibility or death of the spouse. This new rule of the government will provide relief to those women employees who do not get along with their husbands or are getting divorced. Now such women will be able to secure the future of their children.

What did the minister say

Giving information about this new rule, Union Minister of State for Personnel Jitendra Singh said that the Department of Pension and Pensioners’ Welfare (DOPPW) has introduced an amendment in the Central Civil Services (Pension) Rules, in which the pensioners will be given a pension in place of their spouse after their own demise.

But pension will be given to the child/children. He said that this amendment will be effective in situations where divorce proceedings take place due to marital discord. Similarly, cases are registered under laws such as the Protection of Women from Domestic Violence Act, Dowry Prohibition Act or the Indian Penal Code. In all these circumstances, changes can be made in the family pension as per one’s convenience.

According to the official statement issued by the government, the female government employee or pensioner will have to make a written request to the concerned office head. This request letter must state that family pension should be given to her eligible child/children before her husband. If the female government employee or pensioner dies during this process, the family pension will be distributed as per the request letter.

If the woman is widow and does not have children?

If a government female employee is a widow and has no one else, then in such a situation no one has any claim. If a widow is the guardian of a minor child or a child suffering from mental disorder, then family pension will be payable to the widow as long as she remains the guardian. Once the child attains adulthood and is eligible for family pension, it will be payable directly to the child.

In cases where the deceased woman Government servant or pensioner is survived by a widow and children who have attained majority but are still eligible for family pension, family pension will be payable to such children.
