8th Pay Commission: Soon after the Central Government issued the complete notification of the Terms of Reference (ToR) of the 8th Pay Commission, a major employee organisation has made a serious allegation that 69 lakh pensioners of the country have not been included in the ToR issued. This allegation has been made by the All India Defence Employees Federation (AIDEF). The organisation says that the part related to ‘Review of Pension and Retirement Benefits’ in the 7th Pay Commission notification of 2014 has been removed in the ToR of the 8th Pay Commission.

What was in the 7th Pay Commission’s ToR?

The 7th Pay Commission’s ToR, issued in 2014, clearly stated that the Commission would also review the pension structure for employees who had already retired. The 7th Pay Commission notification stated, “To examine the principles governing the structure of pensions and other retirement benefits for retired employees, including reviewing the pension revisions of employees who retired before the effective date of these recommendations, while also noting that the retirement benefits of all Central Government employees appointed on or after 01.01.2004 are covered under the New Pension Scheme (NPS).”

This section missing from the 8th Pay Commission’s ToR

This entire section is missing from the 8th Pay Commission’s ToR, issued by the Department of Expenditure, Ministry of Finance, on November 3rd. That is, there is no mention of “review of pensions and other retirement benefits.”

AIDEF’s Protest and Demands

On November 4, AIDEF wrote to Finance Minister Nirmala Sitharaman, requesting that the ToR of the 8th Pay Commission be amended to include all pensioners who have retired or will retire before January 1, 2026. The organization stated in the letter, “It is extremely unfortunate that 6.9 million central government pensioners and family pensioners, who have served the country for more than three decades, have been excluded from the scope of the 8th Pay Commission.”

In its letter, AIDEF also suggested that the following issues be included in the ToR of the 8th Pay Commission:

Provision for restoration of the reduced pension amount (commuted value) after 11 years.

5% increase in pension every 5 years from the date of retirement, as per the recommendations of the Parliamentary Standing Committee.

However, amid these allegations and demands, Union Minister Ashwini Vaishnav clarified on October 28 that the 8th Pay Commission recommendations would cover approximately 50 lakh central employees as well as approximately 69 lakh pensioners. Which employees will get how much dress allowance?

As per 7th pay commission

Rs 20,000 per annum to Army officers, Air Force, Navy, CAPF, Coast Guard.

Rs 10,000 per annum to Police officers, MNS officers, Customs, Narcotics, NIA, ICLS, Bureau of Immigration etc.

Railway station masters, employees under defense service, Union Territory Police etc. will get Rs 10,000 annually.

Trackmen, staff car drivers, canteen staff, running staff etc. will get Rs 5,000 annually.

There is good news for central government employees. The allowance given to the employees to buy dress or special dress will now be available more than once a year. Till now this allowance was given only once a year. The ministry issued a circular on March 24, 2025 stating that the employees joining the central government service after July will also get the benefit of this allowance. That is, now the allowance will be available more than once a year.

What is dress allowance?

According to a circular issued by the Finance Ministry on August 2017, uniform allowance includes clothing allowance, initial equipment allowance, kit maintenance allowance, robe allowance, shoe allowance, etc. The proportionate payment of dress allowance will be given using this formula: Amount / 12 x number of months (from the month of joining government service to June of the next year). For example, let’s say an employee joins the service in August of a year, and gets a dress allowance of Rs 20,000 per year. As per this formula, he will get his dress allowance on a proportionate basis, which will be Rs (20,000/12 x 11), i.e., Rs 18,333.

How much uniform allowance is given?

Under the Seventh Pay Commission, the government had fixed different amounts for different categories of central government employees. Officers of the Army, Indian Air Force, Navy, Central Armed Police Forces and Coast Guard are eligible for a dress allowance of Rs 20,000 per year.

The circular further states that “Military Nursing Service (MNS) officers, police officers and officers of the Indian Railways in Delhi, Andaman and Nicobar Islands, Lakshadweep, Daman and Diu and Dadra and Nagar Haveli and Police Service, executive staff of Customs, Central Excise and Narcotics Department, officers of Indian Corporate Law Service (ICLS), legal officers in NIA, Bureau of Immigration Personnel (at Mumbai, Chennai, Delhi, Amritsar, Kolkata) and all checkpoints of Bureau of Immigration are entitled to annual uniform allowance of Rs 10,000.

All personnel below officer rank in Defence Services/CAPFs/Railway Protection Force/Union Territory Police Forces and Indian Coast Guard and Station Masters of Indian Railways are also entitled to uniform allowance of Rs 10,000 per annum. Other category of employees who were issued uniform and are required to wear it regularly, such as trackmen, running staff of Indian Railways, staff car drivers and canteen staff of non-statutory departmental canteens, are entitled to Rs 5,000 per annum.” Are entitled to receive dress allowance of Rs.

Rajasthan government also took decision

Earlier, the Rajasthan government has decided to increase the dearness allowance of state employees by two percent. This will benefit 12 lakh 40 thousand employees and pensioners. During the financial year 2025-26, the state employees have been given the gift of a two percent increase in DA. Pensioners will also be entitled to a two percent increase in dearness relief. Now, under the seventh pay scale in the state, state employees and pensioners will be entitled to 55 percent dearness allowance or dearness relief, increased from 53 percent, from January 1, 2025.

Earlier in the last week of March, the Union Cabinet approved a two percent increase in dearness allowance. This decision will come into effect from January 1 this year. This will benefit about 1.15 crore central government employees and pensioners. Its implementation is expected to benefit about 23 lakh central employees.

What is Unified Pension Scheme

The central government has tried to provide an option for central government employees under this scheme. This scheme will be available as an option under the National Pension System (NPS), in which employees can choose between NPS and UPS.

Special things about UPS

There is a provision of fixed pension in this scheme. Employees who have completed 25 years or more of service will get 50% of the average basic salary of the last 12 months before retirement as pension. At the same time, employees with 10 to 25 years of service will get pension in proportion to the service period. Apart from this, employees who have completed a minimum of 10 years of service are guaranteed a pension of at least Rs 10,000 per month.

Family Pension

Talking about family pension, on the death of a central government employee, his family will get 60% of the employee’s pension. Employees will contribute 10% of their basic salary in the scheme. At the same time, the government’s contribution will be 18.5%. Let us tell you that the government will contribute 14% in NPS. This scheme is applicable for central government employees included in NPS, who choose it. At the same time, employees with a minimum of 10 years of service will be entitled to a fixed minimum pension.

DA likely to increase from 53% to 55%

Dearness allowance is an important part of the salary of government employees, which is revised twice every year (January and July) to give them relief from rising inflation.  

Salary of employees will increase  

For example, if an employee’s Basic Pay is ₹1,00,000, then under the current 53% DA, he is getting ₹53,000. If DA increases by 2% to 55%, then now he will get ₹55,000, that is, there will be a direct increase of ₹2,000.  

Employees and pensioners will get direct benefit  

Dearness Allowance is given to government employees, while pensioners get it in the form of Dearness Relief (DR). This increase will benefit lakhs of central government employees and pensioners. 

How much benefit do Multi Tasking Staff (MTS) and entry-level employees get?  

An entry-level employee, whose basic pay is ₹ 18,000, will also get direct benefit of this increase.  

• Currently at 53% DA: ₹9,540  
• If 55% DA: ₹9,900  
• Direct benefit: Increase of ₹360  

If the DA increase would have been 3%, it would have reached ₹ 10,080, an increase of ₹ 540.  

The increase will be implemented from January 2025, will the arrears also be paid?

Any DA hike by the government will be effective from January 1, 2025. This means that employees will also get arrears from January to March 2025. Last time the government had increased DA by 3% in July 2024, due to which it increased from 50% to 53%. Now after the possible increase this time, DA can reach 55%.  

Now all eyes are on the Modi cabinet meeting to be held on March 19. If the government announces DA hike on this day, then all the employees and pensioners of the central government will get its benefit. This will increase the in-hand salary of the employees. Now it remains to be seen whether the government increases it by 2% this time or gives more relief than expected.

Who is eligible for Unified Pension Scheme?

The Unified Pension Scheme is currently available to all central government employees under NPS and are willing to switch to the new scheme.

Why was this decision taken?

In April 2023, a panel headed by Finance Secretary TV Somanathan recommended restructuring of the NPS. This led to the creation of the Unified Pension Scheme, aimed at providing greater financial security to government employees.

When will the Unified Pension Scheme become effective?

The Unified Pension Scheme will be effective from April 1, 2025. According to Cabinet Secretary TV Somanathan, UPS will be more beneficial for employees in 99% of cases, although some exceptional cases may remain under NPS. The central government has launched the Integrated Pension Scheme as an alternative to the National Pension System (NPS). UPS will be available to those central government employees who are already enrolled in NPS and opt for this new scheme. The Finance Ministry has said that central government employees eligible under NPS now have the option to switch to the Integrated Pension Scheme within the NPS structure.

About the scheme

-Retired persons will now get 50% of their average basic salary in the last 12 months before retirement as pension, provided they have put in a minimum service of 25 years. Also, the government is increasing its contribution from 14% to 18.5%.

-At the same time, the contribution of employees will not increase. In case of unfortunate death of a pensioner, his family will receive 60% of the pension received by the employee. ₹ 10,000 per month will be received as pension on retirement after a minimum of 10 years of service.

-The provisions of UPS will apply to pre-retired employees of NPS (who have already retired). The arrears of the previous period will be paid with interest at PPF rates.

– UPS will be available as an option to employees. Existing NPS/VRS as well as future employees with NPS will have the option to join UPS. Option once chosen will be final.

– UPS is being implemented by the Central Government. It will benefit about 23 lakh central employees. If the state governments also adopt it, it can benefit more than 90 lakh government employees who are currently on NPS.

According to media reports, the government may make a formal announcement before Holi. The government revises DA every year in January and July, although its official announcement is made after some time. Usually the increase in January is announced before Holi, while the July increase is announced around Diwali. The government gives this allowance to maintain the purchasing power of the employees from the effect of inflation.

How much will the increase be this time?

The government may increase the DA by 3% as per the December 2024 figures, taking the DA and DR to 56%. However, the final decision will depend on the approval of the Union Cabinet headed by the Prime Minister.

How is DA decided?

Dearness Allowance is calculated on the basis of All India Consumer Price Index for Industrial Workers (AICPI-IW).

DA (%) = [(Average AICPI of last 12 months – 115.76) / 115.76] × 100

A look at the last DA hike

March 2024 : The government increased DA from 46% to 50%. This announcement was made on 7 March 2024, giving relief to the employees before Holi.

October 2024: The government increased DA by another 3%, taking it to 53%. This revision was effective from July 1, 2024.

8th Pay Commission and future DA hike

Currently, the recommendations of the 8th Pay Commission are likely to be implemented in 2026. During this time it will be seen whether DA will be merged into the basic salary or not. The recommendations of the 8th Pay Commission can be finalized by the end of the financial year 2025-26 and it will be implemented next year. Earlier, under the 7th Pay Commission, two DA hikes are expected in 2025 and one in 2026.

What is Unified Pension Scheme?

The Unified Pension Scheme is a new structure designed to provide more stable and reliable pension benefits than the National Pension System (NPS). Under this scheme, employees will get a pension of 50% of their last salary.

NPS VS New UPS

NPS- NPS is market based, which means the pension amount depends on market conditions. Employee’s contribution is 10%, and government’s contribution is 14%.

UPS- Unlike NPS, UPS is not market based and guarantees a pension of 50% of the last salary. The government’s contribution has increased to 18.5%, while the employee’s contribution will remain the same. Please note that at least 10 years of service is required to get pension through UPS.

Who is eligible for Unified Pension Scheme?

The Unified Pension Scheme is currently available to all central government employees under NPS and are willing to switch to the new scheme.

Why was this decision taken?

In April 2023, a panel headed by Finance Secretary TV Somanathan recommended restructuring of the NPS. This led to the creation of the Unified Pension Scheme, aimed at providing greater financial security to government employees.

When will the Unified Pension Scheme become effective?

The Unified Pension Scheme will be effective from April 1, 2025. According to Cabinet Secretary TV Somanathan, UPS will be more beneficial for employees in 99% of cases, although some exceptional cases may remain under NPS. According to several media reports, the National Council-Joint Consultative Machinery (JCM-NC) has demanded the fitment factor to be at least 2.57 or more. This was the same fitment factor that was implemented under the Seventh Pay Commission. JCM-NC Secretary Shiv Gopal Mishra said that this fitment factor should be 2.57 or more.

Why is the fitment factor important?

The fitment factor is a system that determines the salary of government employees. If the fitment factor of 2.57 is implemented in the 8th Pay Commission, the salary of the employees can increase by about 157%. For example, if the current basic salary of an employee is Rs 18,000 per month, it will increase to Rs 46,260 per month. Along with this, the minimum pension will also increase from Rs 9,000 to Rs 23,130 per month.

This was the fitment factor under the 7th Pay Commission

Let us tell you that the Seventh Pay Commission was implemented on 1 January 2016. During this time, the fitment factor 2.57 was implemented, so the basic salary of central employees increased from 7 thousand to 18 thousand rupees. In such a situation, if the fitment factor 2.86 is also implemented during the Eighth Pay Commission, then the basic salary will increase from 18,000 to 46,260 rupees. But former Finance Secretary Subhash Garg called it difficult and said that the fitment factor of 1.92 could be more practical.

JCM-NC demanded this much fitment factor?

JCM-NC Secretary Shiv Gopal Mishra says that the fitment factor in the 8th Pay Commission should be 2.57 or more. Actually, the old standards are no longer relevant. He also said that the 7th Pay Commission had adopted the principles of the Indian Labor Conference (ILC) of 1957 and Dr. Aykroyd’s minimum living wage, but now these standards have changed. New standards are needed keeping in mind today’s digital age and expenses like internet, mobile, insurance, investment.

7th pay commission latest: If you are a central government employee then this news may be useful for you. Actually, the central government has extended the concession and incentive package for its employees working in the Kashmir Valley for three years. The valley includes 10 districts – Anantnag, Baramulla, Budgam, Kupwara, Pulwama, Srinagar, Kulgam, Shopian, Ganderbal and Bandipora.

What is in the government order

An order of the Personnel Ministry said that it has been decided by the competent authority to extend the package of concessions/incentives to Central Government employees working in Kashmir Valley for an additional period of three years from August 1, 2024. It said that the incentive package is equally applicable to all ministries, departments and public sector undertakings under the Government of India and they should ensure strict adherence to the rates prescribed in the package.

The order states that the employees posted in the valley have the option to take their families to any selected place of their choice in India at government expense. At the same time, TA i.e. transport allowance for the families will be given at the rate of 80 percent of the basic salary of the previous month. The order states that employees who do not want to take their families to the selected place of residence are given an allowance of Rs 141 per day for each day of attendance to compensate for any additional expenses in commuting to and from the office etc.

Pensioners also get relief

The order said that those pensioners of the valley who are unable to receive their monthly pension through public sector banks or Pay and Accounts Office or treasuries would be paid pension outside the valley where they are settled, by relaxing the relevant provisions.

If the government increases DA by 3 percent, then DA will increase to 56 percent.

Dearness allowance will increase on this date of February

The government will make this announcement before Holi. This time Holi is on March 14. The government will also release the installment of PM Kisan on February 28. There will be a cabinet meeting on Wednesday, February 26. After that the government can increase the dearness allowance of central employees.

Will DA be stopped during COVID-19?

Recently, during the Monsoon Session of Parliament, Union Minister of State for Finance Pankaj Chaudhary clarified that the government is not looking at the possibility of releasing the 18 months of DA and DR arrears that were withheld during the COVID-19 pandemic. In response to a question, Minister Pankaj Chaudhary said that the government is not considering releasing the 18 months of DA and DR arrears of central employees and pensioners which were withheld during COVID-19. Three instalments of January 2020, July 2020 and January 2021 were withheld due to the economic distress caused by the COVID pandemic.

The Narendra Modi-led government implemented the 7th Pay Commission in January 2016. Its recommendations will end on December 31, 2025. Earlier, the tenure of the 4th, 5th and 6th Pay Commissions was 10 years.

How much will the salary increase after the 8th Pay Commission

After the implementation of the 8th Pay Commission, there may be a bumper increase in the salary of central employees. According to reports, this time the fitment factor can be fixed at least 2.86. If this happens, the minimum basic salary of the employees will also increase. It can be Rs 51,480. Currently the minimum basic salary is Rs 18,000. Pensioners will also get similar benefits. Their minimum pension can increase from Rs 9,000 to Rs 25,740.

How much did the salary increase when the 7th Pay Commission was implemented
After the formation of the 7th Pay Commission, the minimum salary of central employees was increased the least. In this, the salary was increased according to the Fitment Factor, which was kept at 2.57 times. This made the basic salary Rs 18,000. If this formula is considered as the basis, then in the 8th Pay Commission, the minimum salary will be Rs 26,000 under the maximum range of the Fitment Factor.

What is the Fitment Factor?

The fitment factor is actually a formula used to increase the salary and pension of government employees and pensioners. On this basis, salary is increased at different levels. However, allowances are not added to it.

How did the salary of central employees increase?

• In the 4th Pay Commission, the salary increase of central employees was 27.6 percent. In this, the minimum salary was fixed at Rs 750.
• In the 5th Pay Commission, a big increase of 31 percent was made in the salary. Due to this, the minimum salary of central employees directly increased to Rs 2,550 per month.
• The fitment factor was implemented in the 6th Pay Commission. Then it was kept at 1.86 times. Due to this, the employees got the biggest jump in salary. Their minimum salary increased by 54 percent and the basic salary increased to Rs 7000.
• The 7th Pay Commission was formed in the year 2014. Taking the fitment factor as the basis, an increase of 2.57 times was made. But, the salary increase was only 14.29 percent.

Central Government Employees Gratuity: The Dearness Allowance given to Central Government Employees has crossed 50 percent. Due to this increase in dearness allowance, the gratuity received by central employees on retirement from January 1, 2024 has become Rs 25 lakh, which was earlier Rs 20 lakh. Central employees do not have to pay any tax on gratuity of Rs 25 lakh received on retirement. It is completely tax-free. However, the tax-free gratuity limit for employees working in the private sector is only Rs 20 lakh.

Gratuity has become Rs 25 lakh

The Department of Pension and Pensioners Welfare, under the Ministry of Personnel, Public Grievances and Pensions, has issued an office memorandum, increasing the maximum limit of gratuity after the recommendations of the 7th Pay Commission after the dearness allowance of central government employees reached 50 percent. In this order, it was told that on the basis of the government’s decision to implement the recommendations of the Seventh Pay Commission, the maximum limit of retirement gratuity and death gratuity under the Central Civil Services (Pension) 2021 has been increased by 25 percent and it has been increased from Rs 20 lakh to Rs 25 lakh, which has come into effect from January 1, 2024.

What is gratuity?

Gratuity is the amount which is given to the employees as a mark of respect in lieu of the services rendered by them to their employer. This is given to the employee in lieu of long-term services rendered in his organization on his retirement or on leaving the company after a period i.e. 5 years. Gratuity is a component of the gross salary of any employee but it is not given regularly. Rather, a lump sum payment is made when the employee leaves the company.

This is how gratuity is calculated!

Gratuity is calculated on the basis of the salary received by the employee every month. To get gratuity, it is necessary for any employee to serve continuously for at least 5 years. However, this rule does not apply in case of death or disability of the employee. To calculate gratuity for a period of 5 years, 240 days in a year are counted as working days. Gratuity is given when any employee retires from service, becomes eligible for retirement, resigns after serving the same company continuously for 5 years, dies of an employee or becomes disabled due to illness or accident. Demand for change in gratuity calculation rules

Recently, representatives of trade unions have demanded changes in the gratuity calculation rules in the pre-budget meeting with Finance Minister Nirmala Sitharaman so that employees can get more gratuity on retirement. These organizations have demanded from the Finance Minister to increase the gratuity payment calculation from 15 days’ salary of the year to one month’s salary so that employees can get more gratuity on retirement.

10 proposals passed in Jharkhand Cabinet

A total of 10 proposals were passed by the Cabinet, including administrative approval of Rs 99.56 crore for Multi-Disciplinary Education and Research University (MERU) on the campus of Vinoba Bhave University (VBU), Hazaribagh, under the Pradhan Mantri Uchchatar Shiksha Abhiyan (PM-USHA). “We are ready to move ahead with a visionary mindset for the betterment of Jharkhand,” Soren said.

About 16,000 crore rupees are spent annually on salary allowances.

A total of 5,33,737 posts of different levels are sanctioned in different departments of the Jharkhand government. As against these sanctioned posts, people are working on 1,83,016 posts. About 16,000 crore rupees are spent annually by the state government on salary allowances of employees working on regular posts.

Hike in allowances on 50% DA

Hike in dress and nursing allowance

An increase in Dress Allowance and Nursing Allowance was announced in September 2024.

Dress Allowance: As per the OM dated 17th September 2024 of Ministry of Health and Family Welfare, when DA increases by 50%, the dress allowance is increased by 25%.

Nursing Allowance: This allowance is given to nurses working in all government hospitals and dispensaries. According to the ministry, when DA reaches 50%, nursing allowance is also increased by 25%. This instruction is also applicable to central hospitals like AIIMS, PGIMER, JIPMER etc.

When will the 8th pay commission come

Pay commissions are usually constituted every 10 years. The 7th Pay Commission was set up on 28 February 2014 by the then Prime Minister Manmohan Singh and submitted its recommendations on 19 November 2015. These recommendations were implemented from 1 January 2016. There is no official information yet on the announcement of the 8th Pay Commission, but it is expected to be constituted next year.

New rates of DA under 6th Pay Commission

According to the 6th Pay Commission, dearness allowance for salaried employees has been increased from the current 239% to 246%. This increase will be effective from July 1, 2024. A seven percent increase in dearness allowance has been made under the Sixth Pay Commission. For example, if an employee’s basic salary is ₹ 43,000, earlier he used to get ₹ 1,02,770 under 239% DA. According to the new rate of 246%, now his DA will increase to ₹ 1,05,780. That is, the salary will increase directly by Rs 3,000 per month.

New rates of DA under 5th Pay Commission

According to the 5th Pay Commission, the dearness allowance of the employees receiving salary has been increased from the current 443% to 455%. This will also be applicable from July 1, 2024. That is, DA has been increased by 12 percent directly.

DA rates under 7th Pay Commission

Dearness Allowance and Dearness Relief for central employees and pensioners receiving salary under the 7th Pay Commission has been increased from 50% to 53%. This increase has come into effect from July 1, 2024.

Benefit of dearness allowance

Dearness Allowance is given to government employees and pensioners to provide relief from inflation. It is decided according to the employees working in urban, semi-urban and rural areas. The central government revises the rates of dearness allowance twice every year—in January and July. The Assam Cabinet led by the Chief Minister of the state Himanta Biswa Sarma has approved a 3 percent increase in DA. This increase will be considered effective from July 1, 2024.

According to ANI report, after the 3 per cent hike, the total dearness allowance of Assam employees will now increase to 53 per cent, which is equal to that of central government employees. The new DA will be reflected in the salary from December. Employees will get their DA arrears from December to March, in which the amount will be paid in 4 equal installments.

DA increased for the second time this year

CM Sarma said that the increase in DA is a Diwali gift from the government to the employees. This is the second time this year that the Assam government has increased the dearness allowance for its employees. In March, the state government implemented a 4 percent increase in DA.

Dearness allowance of UP employees increased by 3 percent.

Recently, the Yogi government of UP has issued an order to increase dearness allowance by 3 percent, giving Diwali gift to the state employees. Now the employees of UP will get 53 percent DA. The increased dearness allowance will be available from July 1. Dearness allowance will be added to the salary received on October 30.

Gift to employees of Arunachal Pradesh too

Apart from this, the Arunachal Pradesh government has also increased the DA. The state government has increased the DA by 3% for employees and pensioners.

The date has been fixed. You will get the gift before Diwali. In January, the index number was at 138.9 points, due to which the dearness allowance increased to 50.84 percent.

After this, the index was at 139.2 points in February, 138.9 points in March, 139.4 points in April and 139.9 points in May. On this pattern, the dearness allowance reached 51.44 percent, 51.95 percent, 52.43 percent in April and 52.91 percent by May. The June numbers finalized how much dearness allowance will increase. With the index at 141.4 points in June, the score of dearness allowance has gone up to 53.36 percent.

How much can dearness allowance increase?

There can be an increase of only 3 percent in dearness allowance (DA). If this happens, the dearness allowance of the employees will become 53 percent. There is no possibility of it becoming zero. According to the current trend, even after the June numbers come, it will reach 53.29 percent only. Meaning it will be increased from 50 to 53 percent. Dearness allowance is calculated from the AICPI index. The inflation data collected from different sectors in the index shows how much the allowance of the employees should increase in comparison to inflation. 

Will be implemented from 1 July 2024

The announcement of dearness allowance for central employees is made on 23 October. But, it will be implemented only from July 2024. The payment for the intervening months will be made as arrears. Under the 7th Pay Commission, the AICPI numbers from January to June determine the dearness allowance for central employees. Dearness allowance has reached 53.36 percent. In such a situation, an increase of 3 percent is certain this time. The total dearness allowance will become 53 percent.

On July 30, Minister of State for Finance Pankaj Chaudhary told the Rajya Sabha that two requests were received for the formation of the 8th Pay Commission in June 2024. But at present there is no such proposal with the government. It is worth noting that the 7th Pay Commission was constituted in February 2014 and its recommendations were implemented from January 1, 2016. Usually, the Central Government constitutes a Pay Commission every 10 years to revise the salaries of government employees.

Minister Pankaj Choudhary replied to a question saying, ‘No’, when asked if the government is considering releasing the 18 months of DA/DR arrears of central government employees and pensioners that were withheld during COVID-19.

Due to the economic distress caused by the Covid pandemic, it was decided to freeze the three instalments of January 2020, July 2020 and January 2021 to ease the government’s financial pressure. Hence, there are no plans by the government to release these dues at the moment, and central employees will have to wait for further DA hikes.

The Health Ministry did not even consider it necessary to take the advice of the Central Employees Organizations and the Standing Committee of the Staff Side National Council (JCM) before taking such a decision.

However, meanwhile, an official of the Health Ministry has informed the representative of the employee organization that it is not mandatory to link the CGHS ID card with the Ayushman Bharat Health Account of the Government of India. This decision will remain as an option.

There is no logic behind this decision

In his letter, Shrikumar has informed the government about the doubts of the employees and pensioners. Employees and pensioners believe that they do not see any logic behind this decision of the Health Ministry. The reason is that Ayushman Bharat Health Account (ABHA) is for general citizens, whereas CGHS covers government employees and pensioners. Ayushman works under Bharat Health Account Insurance Scheme.

In this, eligible citizens get an insurance cover of Rs 5 lakh. Its premium is paid by the government. In CGHS, a government employee deposits a fixed amount. Under this, employees get treatment facilities even in expensive private hospitals. The cost of treatment here is not limited to Rs 5 lakh. In ABHA, the government pays the premium, whereas in CGHS, the premium is paid in advance by the retired government employee. In such a situation, how can the two schemes be compared and linked together?

Private hospitals withdrawing from CGHS empanelment

CGHS beneficiaries already face many problems. There is a shortage of doctors and other staff at many wellness centres. There are not enough medicines and resources. Cashless treatment is prohibited in CGHS hospitals. Overcharge is levied at many places. Such private hospitals, which have multispecialty facilities, are removing themselves from the CGHS empanelment. Sreekumar wrote in his letter, in such a situation, linking the CGHS ID card with the Ayushman Bharat Health Account (ABHA) of the Government of India is like sprinkling salt on the wound.

The ‘Department of Expenditure’ of the Finance Ministry has issued a relief order for government employees. The office memorandum issued on April 1 states that if any amount has been deposited in an employee’s account under overpayment, it will not be recovered. In this case, the limit of overpayment amount has been kept at Rs 2 lakh. If money has been transferred to a government servant’s account by mistake, he will not be troubled.

If there has been overpayment, it has been made mandatory to issue an order for its recovery within a month. The Finance Ministry has cited Rule 15 of the Delegation of Financial Powers Rules (DFPR), 2024 in this matter. It states that government employees may be exempted from recovery of overpayments made by a ministry or department. However, for this the concerned department will have to follow certain conditions.

Overpayment cases go on for a long time

Cases of overpayment keep coming to light in various ministries and departments of the Central Government. In some cases notice is given soon, while in many cases the files keep rotating from one table to another for a long time. Many such cases have come to light in which an employee retires, but his overpayment case is not resolved. After retirement, recovery is demanded from him. In May 2022, the Supreme Court had said in a judgment that additional payment made to an employee cannot be recovered after his retirement on the ground that he was given increment due to some mistake.

What does the Supreme Court order say?

A bench of Justice S A Nazeer and Justice Vikram Nath had said, stay on recovery of additional payment is allowed by the courts. This is not because of any right of the employees, but under judicial discretion to save the employees from the hardship caused to them. If the additional amount has not been paid due to any misrepresentation or fraud by the employee, if the excess payment was made by the employer by applying an incorrect principle of calculation of pay and allowances or on the basis of any particular interpretation of the rule which subsequently If found incorrect, the overpayment made is not recoverable. The Supreme Court had said that a government servant, especially one in the lower ranks of the service, spends whatever amount he receives for the maintenance of his family. The Supreme Court held that where the employee knows that the payment received by him exceeds the amount due or has been wrongly paid or where the wrongful payment is soon discovered, the court will not give him relief against recovery.

As per the Office Memorandum of the Finance Ministry, the Financial Advisor ‘FA’ will send the file of overpayment to the Secretary of the concerned Ministry/Department. In that the FA will recommend that the extra payment be waived. Such cases will be dealt with under Rule 15 of the Delegation of Financial Powers Rules (DFPR), 2024. The Departmental Administrator and any other subordinate authority in the Government of India to whom powers may be entrusted by or under a special order of the President may waive recovery of the amount overpaid.

What are the conditions?

In this case the department will have to follow certain conditions. The date of issue of order for recovery of overpayment will be an important input for taking decision regarding rebate. Such order for recovery of overpayment should be issued within one month from the date of detection of overpayment. According to Rule 15 of DFPR 2024, a department of the Government of India can waive recovery of overpayment up to Rs 2 lakh.

Ministries/Departments should examine all proposals as per the provisions prescribed in Rule 15 of DFPR. They should verify that in cases of exemption, there is no serious negligence on the part of any Government servant which may require disciplinary action by a higher authority.

Financial advisors recommend discount cases

If any Ministry/Department believes that the loss caused by overpayment is due to any defect in the existing rules or procedures, it will be brought to the notice of the Department/Ministry with the authority to amend such rules or procedures. Guidelines in this regard have also been issued by DOPT.

The orders issued on 02.03.2016 by the Administrative Ministry/Department will be strictly followed while considering exemption of additional payments made to Government servants. Each case of exemption should be recommended by a financial advisor. It must be approved by the Administrative Secretary.

In cases where waiver of recovery arises from a court direction, the Ministries/Departments should satisfy themselves that there are reasonable justifications for not challenging such court direction. If any recovery, which has subsequently been waived, is due to misinterpretation of rules or procedures, the Ministry/Department will review all the cases held similarly to examine the need for waiver of recovery in future cases.

If any inquiry has been conducted to fix responsibility, the final report as well as the action taken by the Ministry may be placed on record.

Such cases may be sent along with the filled checklist (attached to this Office Memorandum) along with a detailed note including the information given at Para-3. DoPT says that even if any recovery order has been given by the court, study it thoroughly. See that the employee keeps his word. There is no fault of his and the court order is worth challenging, so challenge it. Meaning, no harm should be caused to the government employee.
