New Rules For PAN /Aadhaar Card

A big update has come for Aadhaar-PAN card users. The Central Board of Direct Taxes (CBDT) has recently issued a notification.

This notification is for those PAN holders who have obtained their PAN card by providing the enrollment ID of their Aadhaar application on or before October 1, 2024. According to the notification, all those PAN holders will have to provide their Aadhaar number to the Income Tax Department by December 31, 2025.

What is the purpose behind this

The purpose of the Income Tax Department behind issuing this notification is to link PAN and Aadhaar (PAN-Aadhaar link). The notification issued by CBDT states that under section 139AA (2A) of the Income Tax Act 1961, it is mandatory for such persons who have submitted the enrollment ID of Aadhaar while applying for PAN card before October 1, 2024, to update the Aadhaar card number.

This process is for linking PAN-Aadhaar online

If you have got the Aadhaar number, then you can link Aadhaar with PAN card online by following the steps given below.

  • First of all, you have to visit the official website of Income Tax Department www.inmcoetax.gov.in.
  • Now the option of link Aadhaar has to be selected.
  • After this, enter important information like your Aadhar number, PAN number.
  • The process of linking PAN with Aadhaar will be completed after verification through OTP sent to your registered mobile number.

Offline process to link PAN-Aadhaar

If you want to link PAN-Aadhaar offline (Offline process to link PAN-Aadhaar), then we are telling you the method for this as well. Some important documents will be required to link PAN-Aadhaar offline.

Copy of PAN card, copy of Aadhar card, an application form, which you can download from the website of Income Tax Department. Take all these necessary documents and go to your nearest PAN service center or Income Tax Department office. There you will have to submit self-attested copy of PAN and Aadhar and application form. After submitting the form, you will be given a receipt. With the help of which you can easily track the status of the process.

Take special care that all the important details like name, date of birth etc. match in PAN and Aadhaar. If it is not so, then correct the mistakes before linking the two.

Will not have to pay fine

Now the general PAN holder will have to pay a fine for linking PAN with Aadhaar, because the last date for PAN-Aadhaar link was June 30, 2023. On the other hand, for those who used Aadhaar enrollment ID while applying for PAN card on or before October 1, 2024, the deadline is not June 30, 2023. These people have been given the facility to link Aadhaar-PAN till December 31, 2025.

What will happen if Aadhaar-PAN is not linked?

A fine of Rs 1,000 has to be paid for linking PAN-Aadhaar after the deadline. The CBDT notification has given a deadline of December 31, 2025, but there is no mention of the penalty to be imposed from 01.01.2026. It is possible that these people may also have to pay a penalty (PAN Aadhaar Link Penalty) for linking PAN-Aadhaar after the deadline.

  • If the PAN is not linked with the Aadhaar number, it will become inoperative.
  • Any ITR filed without linking Aadhaar-PAN will be considered invalid.
  • No income tax return can be filed with an inoperative PAN.
  • The rate at which TDS/TCS is collected or deducted may be higher.
  • Will not be able to fill 15G and 15H forms.

Therefore, to avoid all these problems, complete the work of linking Aadhaar-PAN before the deadline.
