Justice Borkar said that the Parliament had passed the Citizenship Act in 1955, which clearly explains who is called a citizen and who is not and who can become one.

He said, ‘In my opinion, the Citizenship Act, 1955 is the only law that defines citizenship and nationality in India. It clarifies who is a citizen, how is a citizen and if citizenship is not there, how can it be acquired.’ Justice Borkar said that just by having an Aadhar card, PAN card or voter ID, one does not become a citizen of India. These documents are there so that the citizen is identified and services can be provided to him. The Citizenship Act, which defines nationality, cannot be rejected on the basis of these documents. This important decision of the court has come at a time when there is a debate going on in Bihar on the SIR of the voter list.

In a notification issued a few days ago, the Railways had said that those passengers whose Aadhaar card is not linked to IRCTC account will not be able to book tatkal tickets from IRCTC website or mobile app. Now the Railways is planning to provide the facility of booking tatkal tickets by verifying IRCTC account with some other identity cards along with Aadhaar card. Currently, out of about 13 crore registered users of IRCTC, only a little more than 10% have linked their accounts with Aadhaar.

A Times of India report quoted sources as saying that the Indian Railways is planning to include other documents present in DigiLocker such as PAN card, driving license and voter ID for user authentication. The ministry may issue a new notification in this regard on Monday. The proposal came up for discussion during a review meeting chaired by Railway Minister Ashwini Vaishnav on Friday.

2.2 lakh passengers book Tatkal tickets daily

Currently, about 2.2 lakh passengers book Tatkal tickets daily through IRCTC website and app. Railways has advised the users of IRCTC app and website to link their IRCTC account with Aadhaar before July 1 so that there is no problem in booking Tatkal tickets. From July 15, OTP linked to Aadhaar will also have to be entered on every Tatkal booking so that the identity of the user can be ensured while booking.

Efforts to curb black marketing

These measures have been taken to prevent black marketing of tickets by fake agents and to provide timely tickets to needy passengers in case of emergency. Tatkal tickets can now be booked only through Aadhaar linked IRCTC account or computerized PRS counters of Indian Railways or authorized agents.

Fake voters will be banned

According to Chief Election Commissioner Gyanesh Kumar, this initiative will make it easier to identify fake voters and remove them from the list. Many political parties, such as Trinamool Congress, Shiv Sena (UBT), NCP (SCP) and BJD, had raised the issue of voters having the same EPIC number. The commission admitted that in some states the same voter ID number was issued twice due to technical reasons, but this cannot be termed as fraud. Now strict steps are being taken to find a permanent solution to this issue.

In 2023, on a PIL in the Supreme Court, the Election Commission had said that providing Aadhaar number is not mandatory, it is optional. However, now the Commission is considering legal and technical solutions, which can make this process mandatory, just like linking Aadhaar and PAN card was made mandatory.

An important part of the Election Commission’s reform plans

The Election Commission has long been supporting Aadhaar seeding (Voter ID-Aadhaar Linking). In 2017, the Commission also filed an application in the Supreme Court seeking permission to link Aadhaar with Voter ID. The Commission believes that this will make the voter list more accurate and transparent. Apart from this, this initiative will also be helpful in other important efforts of electoral reforms such as advance voting system, remote voting for domestic migrants and strengthening the electoral process.

Duplicate voters will be removed in three months

The Commission has also announced that it will complete the process of removing duplicate voter entries in the next three months. For this, District Election Officers in more than 800 districts have been instructed to organize more than 5000 meetings with local political parties. The feedback received from these meetings will be submitted to the Commission by March 31.

This process was introduced so that the voter list could be purified by identifying duplicate voter registrations, but linking Aadhaar was not made mandatory.

Union Labour and Employment Secretary Sumita Dawra, in a review meeting of the functioning of 21 regional offices of EPFO ​​​​across the country, emphasized on Aadhaar to end the delay in settlement of claims due to lack of authentic documents.

The Secretary said that the use of Aadhaar as an identity document simplifies government delivery processes, enhances transparency and efficiency, and also ensures that beneficiaries receive their entitlements seamlessly.

According to him, Aadhaar-based verification will eliminate the need for EPF employees to produce many other documents to prove their identity for settlement of claims. In this regard, while giving UAN number to new members joining EPF, it should be linked to Aadhaar.

Some banks want the Income Tax Act to be amended to avoid unnecessary confusion caused by the current dispensation. The official said a possible clarification on the matter could lay down a specified threshold below which PAN card may not be required.

In fact, some problems had come to the fore during the transaction of money from the bank and PAN card was implemented to prevent fraud and tax evasion. Therefore, if a customer transacts a large amount, then PAN card is required.
