Full tax exemption on commuted pension

Commuted pension means that the employee takes a part of his pension first as a lump sum amount. Now if this amount comes from an approved superannuation fund or a recognized pension scheme, then that amount is completely tax exempt.

This rule applies to both government and private sector employees, provided their pension plan is government-recognized. This means that you will not have to pay any income tax on the amount received as commuted pension at the time of retirement.

However, this exemption applies only to the lump sum amount received during commutation. The rest of the monthly pension is taxable under normal tax rules. This facility helps employees save tax and is financially helpful after retirement.

New rules are clear on UPS and NPS

The commuted pension portion received in the Unified Pension Scheme (UPS) will be completely tax free. Whereas, the old rules will apply in NPS i.e. on closing or exiting the scheme, 60% of the total deposit amount can be withdrawn tax free.

Retirement Benefit Account

There is a provision for Retirement Benefit Account in the new bill. These accounts will run approved funds and withdrawal from them will be tax free if the prescribed conditions are fulfilled at the time of retirement. Its purpose is to promote retirement savings in a proper manner.

Discount on family pension continues

The exemption that was already available on family pension will continue. In this, one-third of the pension or ₹ 15,000, whichever is less, will be deducted from the taxable income. This facility will be applicable on the pension received by the spouse or dependents of the deceased employee.

Rules for partial withdrawal fixed

The tax rules for partial withdrawal from pension schemes before retirement have now been clarified, which will reduce disputes and increase transparency.

According to the Finance Ministry, the purpose of these changes is to implement uniform tax rules on different pension sources, clarify the law and ensure financial security after retirement.

What does Kotak’s latest report say?

According to a report by Kotak Institutional Equities, central government employees may get an effective salary hike of only 13% under the 8th Pay Commission. This will be less than the 14.3% hike received in the 7th Pay Commission.

According to the report, this time the fitment factor is likely to be 1.8. In the 7th Pay Commission, it was 2.57. This means that the new basic pay will be determined by multiplying the existing basic pay by 1.8. However, DA (Dearness Allowance) will be started from zero. This will result in a relatively low increase in the total pay.

Basic pay will increase, but here’s the catch…

The basic pay will increase with the implementation of the 8th Pay Commission. For example, if an employee’s current basic pay is ₹18,000, it can go up to ₹32,000 as per the factor of 1.8. However, currently ₹9,900 (55% of DA) is added to it. This takes the total pay to ₹27,900. This benefit will be limited as DA is reset in the new pay structure.

Similarly, those whose basic salary is ₹50,000 can have their new basic salary go up to ₹90,000. However, after the removal of the existing DA of ₹27,500, the effective increase will be only from ₹77,500 to ₹90,000.

Demand for equality like the 7th Pay Commission…

Financial services firm Ambit Capital’s report on the 8th Pay Commission says that a minimum increase of 14% and a maximum increase of 54% in salary is possible. It says that the new pay commission may recommend a fitment factor between 1.83 and 2.46 for employees.

At present, discussions are in full swing regarding the fitment factor. According to experts, it can be up to 2.00, 2.08 or 2.86. If 2.00 is approved, the minimum wage will increase from Rs 18,000 to Rs 36,000 and the pension will increase from Rs 9,000 to Rs 18,000. There have been indications from the government that the 8th Pay Commission will be beneficial for both employees and pensioners. Now all eyes are on when the government implements it and how much salary it increases.

That is, after the implementation of the 8th Pay Commission, employees can expect an even greater increase in their take home salary.

Salary and Pension Calculation

Due to the fitment factor between 2.6 and 2.85, there can be a 25-30% increase in the basic salary along with a proportional pension increase. According to the calculation, the salary of an employee currently getting a basic salary of Rs 20,000 (8th Pay Commission salary structure) can increase to between Rs 46,600 and Rs 57,200. Apart from this, the minimum basic salary (8th Pay Commission Minimum Salary Increase) is expected to be more than Rs 40,000.

In the next step, a committee will be formed to assess the recommendations and finalise them. Once the committee completes its work, it will submit it to the central government. Reports have revealed that the members of the committee may be finalised by the end of this month.

According to a Navbharat Times report, under NPS, the employee contributes 10 percent of his basic salary, while the government contributes 14 percent. The government’s contribution to UPS has increased to 18.5%, while employees will continue to contribute 10 percent of their basic salary and dearness allowance. Apart from this, UPS is only for those government employees. Who have opted for NPS, while private employees can also opt for NPS if their employer has adopted the contribution.

It is known that under the Unified Pension Scheme, the Central Government has made a provision of fixed pension for its employees. Under UPS, government employees will now be entitled to get 50 percent of the average basic salary received in the last 12 months before retirement as pension. Here it must be noted that the minimum service period should be 25 years to get 50 percent of the salary as pension.

The new pension scheme also guarantees a minimum pension of Rs 10,000 per month on retirement after a minimum of 10 years of service. That is, central employees will get a fixed pension of at least Rs 10,000. After the implementation of UPS from April 1, 2025, this contribution of the government will be 18.5% of the basic salary of the employee. In such a situation, the additional burden on the government treasury will be Rs 6250 crore in the first year.

The ministry said in a statement that the first pilot project of CPPS was completed in Karnal, Jammu and Srinagar regional offices in October last year. However, even after this, on the request of employers and employer associations to extend the time to ‘upload’ the salary details, the deadline for submitting salary details etc. online was first extended to 30 September 2023, then to 31 December 2023 and then to 31 May 2024. Despite such a long extension, it was seen that more than 3.1 lakh applications are still pending with the employers for verification of combined options.

The ministry said, therefore, employers are now being given a ‘last chance’ till January 31, 2025 to settle these pending applications and ‘upload’ them soon. Employers were also requested to submit their replies and update the information in more than 4.66 lakh cases by January 15, 2025. Where the Employees’ Provident Fund Organization (EPFO) has sought additional information about the application received and examined by it.

As per the provisions of sub-rule 6 of rule 44 of the CCS (Pension) Rules 2021, pension and compassionate allowance will be given under the rules after the retired government employee attains the age of 80 years or more.

How much additional pension will people of which age group get?

Senior citizens aged 80 to 85 years will be eligible for 20 percent of the basic pension, while pensioners aged 85 to 90 years will get 30 percent of the basic pension. Senior citizens aged 90 to 95 years will be eligible for 40 percent of the basic pension and those aged 95 to 100 years will get 50 percent. Super seniors aged 100 years or more will be eligible for 100 percent of the basic pension. Understand by example – Pensioners born on 20 August 1942 will be eligible for additional pension at the rate of 20 percent of the basic pension from August 1, 2022. Pensioners born on August 1, 1942 will also be eligible for additional pension at the rate of twenty percent of the basic pension from August 1, 2022.

When will the compassionate allowance become effective

The notification of the Department of Pension and Pensioners Welfare states that the additional pension or compassionate allowance will be effective from the first day of the month when the pensioner reaches the prescribed age. These additional pension payments are designed to help pensioners manage the increasing cost of living with increasing age.

The notification states that all departments and banks involved in pension and pension distribution have been directed to disseminate information about the new pension guidelines, so that all eligible pensioners can get proper benefits without delay.

How much salary and pension can increase with the 8th pay commission

There is speculation that the government may revise the pay and pension of central employees based on a fitment factor of 3.68. According to some reports, the pay matrix for the 8th Pay Commission may be prepared using a fitment factor of 1.92.

In such a situation, if the recommendations of the 8th Pay Commission are implemented, the minimum salary of central government employees can increase from Rs 18,000 to about Rs 34,560, that is, an increase of about 92 percent. The minimum pension for pensioners can increase to Rs 17,280.

According to reports, a Joint Consultative Machinery (JCM) meeting will be held in the month of November. This platform helps in resolving disputes between the government and employees. The JCM National Council is headed by the Union Cabinet Secretary and includes representatives of recognized employee unions and service associations. It is possible that after this meeting some concrete information will come out regarding the 8th Pay Commission.

So that, treatment can start immediately without any hassle. The Ministry of Health has issued new guidelines for the cardholders of the Central Government Health Scheme (CGHS).

The purpose of these guidelines is to make health services even easier. So that people can get better service for consultation, investigation and treatment in government and listed private hospitals. In the Office Memorandum (OM) issued on 24 September 2024, the Ministry of Health has changed the old rules related to referral and has issued a Standard Operating Procedure (SOP) regarding the new rules.

New CGHS rules for emergency cases

If there is an emergency, now Healthcare Organizations (HCOs) will not need to take referral or endorsement from CGHS. They can directly provide cashless treatment. Provided that the patient gets an emergency certificate from the expert of the treating hospital. With this certificate, the hospital will upload the treatment claim on the BCA portal.

Even if any test or treatment is not in the CGHS list for emergency treatment, referral will not be required. The hospital can get permission for this through the NHA portal, and there will be no need to take any permission from the local CGHS office for this.

Changes in referral rules

Now the consultation memo received through CGHS will be valid for three months. If a CGHS medical officer refers you to an expert, then you can take consultation from that expert a maximum of six times within three months. If the primary consultation gives advice, then you can also take advice from two additional experts. These rules apply only to referrals given by CGHS medical officers. These rules will not apply to referrals from government hospitals.

Exemption for beneficiaries above 70 years of age

Beneficiaries who are 70 years or older will no longer need a referral to get consultation from any specialist. These beneficiaries will be allowed to directly seek treatment for any registered test or procedure in listed hospitals. However, if any test or procedure is not in the list of CGHS, then permission will have to be taken from CGHS officials for the same.

Follow-up rules for special cases

Beneficiaries suffering from certain specific ailments will be allowed consultation and testing without any time limit on the basis of primary referral. These ailments include:

Post-cardiac surgery cases

Post-organ transplant cases

Post-neurosurgery cases

End-stage renal disease

Cancer Treatment

Autoimmune disorders

Neurological disorders

People suffering from these diseases will not need to take repeated referrals for treatment or investigation.

The Postal Department will provide this service to the elderly at their homes. At present, there are about 68 lakh pensioners in the country only from the Central Government. If the number of pensioners of state governments is added to this, then this figure will increase significantly.

The campaign will run across the country

This information has been received from an official statement issued by the Department of Personnel and Training (DOPT) of the Central Government on Friday. This move is important because the Department of Pension and Pensioners’ Welfare (DOPPW) has decided to organize DLC Campaign 3.0 in all district headquarters and major cities across the country from November 1-30, 2024. The central government statement said that UIDAI and the Ministry of Electronics and Information Technology will provide technical support during the camps. Last year the campaign was run in 100 cities

In the year 2023, DLC Abhiyan 2.0 was organized in 100 cities of the country. In this, 1.45 crore pensioners had deposited their DLCs. Railways will now issue Unique Medical Identification (UMID) cards to all its employees, their dependents and pensioners, through which they will be able to get free treatment in hospitals included in the railway panel and all All India Institutes of Medical Sciences (AIIMS) in the country. This card will be made for Rs 100. This new system will benefit about 12.5 lakh employees, more than 15 lakh pensioners and about 10 lakh dependents of the Railways.

This decision has been taken after complaints from employees and pensioners alleging that doctors issue referrals for their preferred hospitals. Under the new policy, treatment will now be possible without referral. This will provide them medical facilities without any hindrance and complaints related to doctors’ referrals will also be resolved. No referral will be required for treatment in national institutes like PGIMER Chandigarh, JIPMER Puducherry, NIMHANS Bangalore, and 25 AIIMS in the country. Not only treatment, but necessary medicines will also be provided in these institutes.

\. Railway Board Executive Director (Transformation) Pranav Kumar Malik on Monday ordered the issuance of Unique Medical Identification (UMID) cards. According to the official statement, the Department of Pension and Pensioners Welfare (DoPPW) had issued a notification on July 16, 2024, giving information about the Saral Pension Application “Form 6-A”. This form will be available in future/e-HRMS (online module) for all central government employees retiring from December 2024 and onwards.

The statement said, “Retired officers who are on e-HRMS will fill Form 6-A through e-HRMS (for superannuation cases only) and retired officers who are not on e-HRMS will fill Form 6-A on Bhavishya Bhavishya.” The new pension application form will be launched with Bhavishya Bhavishya/e-HRMS platform on 30 August 2024 by Union Minister Jitendra Singh. This simplicity is a major initiative under the “Maximum Governance-Minimum Government” policy. The new form consolidates nine forms and formats into a single simple application.
